AND WELCOME TO THE, UH, PLANNING AND ZONING COMMISSION MEETING FOR THE CITY OF LEANDER.

TODAY IS THURSDAY, AUGUST 26TH, 2021.

AND THE TIME IS 7:00 PM.

LET THE RECORD SHOW THAT ALL THE COMMISSIONERS ARE PRESENT, UH, THE MEET RULE REVIEW, THE MEETING PROTOCOL

[3. Director’s report to the Planning & Zoning Commission on actions taken by the City Council at the August 19, 2021 meeting]

OR WHAT WE DO THE DIRECTOR'S REPORT FIRST.

YEAH.

YEAH.

SO YOU DON'T HURT MY FEELINGS.

OKAY, GOOD EVENING.

I'M REPORTING ON ACTION TAKEN BY THE CITY COUNCIL DURING THE AUGUST 19TH MEETING.

UM, THE COUNCIL COMPLETED THE SECOND READING OF THE ORDINANCE FOR THE MONARCH PUD AND THE CONCEPT PLAN.

THEY MADE SOME CHANGES TO THE REQUEST.

THERE'S NOW A MASONRY SCREEN WALL.

THAT WALL WILL BE ADJACENT TO EXISTING RESIDENTIAL PROPERTIES, AS WELL AS THAT ROAD ON THE WEST SIDE.

UM, THEY ADDED GUEST PARKING ADDITIONAL SETBACKS WHERE THE COMMERCIAL IS PROPOSED TO BE ADJACENT TO EXISTING RESIDENTIAL.

SO IT'LL SOLVE THE REDUCED STEP BACK WHERE IT'S, UM, PROPOSED RESIDENTIAL AS PART OF THEIR OWN PROJECT.

THEY ADDED, UM, INTERIOR LIGHTING AND SIDEWALKS WILL BE ON BOTH SIDES OF THE STREET.

UM, THE NEXT STEP IS GOING TO BE THE PRELIMINARY PLAT, WHICH WILL COME BEFORE THE COMMISSION.

I'M SORRY.

THE FINAL PLAT, UM, COUNCIL APPROVED THE AMENDMENT TO THE TRANSPORTATION PLAN THROUGH THE COLLECTOR ROADWAY, CONNECTING COLLABORATIVE WAY TO HERITAGE GROVE.

THEY DENIED THE COMPREHENSIVE PLAN AMENDMENT AND ZONING CASE FOR THE PROPERTY LOCATED AT 500 HERITAGE GROVE ROAD.

THEY FELT LIKE THE ZONING DISTRICT DID NOT PROVIDE A TRANSITION BETWEEN THE HAVEN SUBDIVISION AND THE PROPOSED INDUSTRIAL USES TO THE EAST.

UM, THEY POSTPONED ACTION ON THE IRVANA PUD.

UM, THE COUNCIL HAD CONCERNS ABOUT THE PROPOSED REDUCTION IN PARKING, THE WAY THE ORDINANCE WAS STRUCTURED.

IT WAS 1.8 SPACES PER UNIT, AND IT WASN'T BASED ON THE UNIT SIZE OR THE NUMBER OF BEDROOMS. SO THEY WANTED TO SEE SOME MODIFICATIONS TO SHOW HOW THAT WOULD WORK.

UM, THIS WILL BE HEARD BY THE COUNCIL, UM, ON SEPTEMBER 2ND FOR THE FIRST READING, AND THEN THEY'LL HAVE TO GO FOR THEIR SECOND READING ON SEPTEMBER 16TH.

UM, THEY COMPLETED THE FIRST PUBLIC HEARING AND APPROVED THE FIRST READING OF THE ORDINANCE FOR THE ZONING REQUEST, JUST DOWN THE STREET FROM US AT 2 0 3, 2 0 8 AND TWO 10 NORTH BRUSHY STREET.

THIS CASE WILL BE ON THE SEPTEMBER 2ND AGENDA FOR FINAL RATING.

AND IN ADDITION TO THE COUNCIL MEETING, WE ALSO HAD A RETREAT ON MONDAY.

UM, DURING THE RETREAT, WE TALKED ABOUT A LOT OF DIFFERENT ITEMS. THE MAIN ONES THAT PERTAIN TO THE COMMISSION ARE THE WATER CONSERVATION INITIATIVES.

UM, STAFF IS WORKING ON SOME POLICIES AND ORDINANCES TO IMPLEMENT WATER CONSERVATION.

WE'RE GOING TO MAKE SOME CHANGES TO THE LANDSCAPE ORDINANCE AND DEVELOPMENT STANDARDS TO HELP WITH THAT.

THEY'RE ALSO WORKING ON RULES OF PROCEDURE FOR BOARDS AND COMMISSION.

ONE THING THAT CAME FROM THE MEETING WAS CHANGING THE TIME OF THE PLANNING AND ZONING COMMISSION TO SIX O'CLOCK.

WE'RE GOING TO HAVE THAT AS AN AGENDA ITEM FOR THE NEXT THING YOU NEED TO TALK ABOUT AND TO VOTE ON AND ANY CHANGES LIKE THAT WOULD TAKE EFFECT.

UM, AFTER, UM, OCTOBER, WHEN WE HAVE ANY NEW APPOINTMENTS, UM, FINALLY WE HAVE A NEW BUDGET COMING FORWARD.

THAT'LL BE ON THE AGENDA FOR SEPTEMBER 2ND AND INCLUDES PURCHASING NEW IPADS FOR THE COMMISSION.

I'M VERY EXCITED ABOUT THAT.

Approval of Subdivision Case 19-FP-002 regarding Travisso Phase 4, Section 4 Final Plat on one parcel of land approximately 23.108 acres ± in size, more particularly described by Travis Central Appraisal District Parcel 353024; generally located to the west of the western terminus of Travisso Pkwy, more specifically to the west of the intersection of Sorvino Walk and Travisso Pkwy, Leander, Travis County, Texas. ]

DID YOU HAVE SPECIFIC QUESTIONS OR DO YOU WANT ME TO SPEAK ABOUT THE ITEM THAT, YOU KNOW, I, I'M JUST CURIOUS AS TO WHERE THIS PERSON IS GOING SO WRONG ON THIS.

UM, SO THIS, THIS IS THE SECOND TIME THE COMMISSION HAS HEARD THIS REQUEST.

UM, IT WAS REVIEWED BY THE COMMISSION COMMISSION ON MARCH 11TH.

UM, AND, AND WHAT'S HAPPENED IS IN 2019, WE ADOPTED SOME NEW PROCEDURES FOR SUBDIVISION.

SO THERE ARE TWO OPTIONS YOU CAN DO ALTERNATIVE AND STANDARD.

THIS IS THE SCHEDULE THAT, THAT Y'ALL APPROVE ABOUT EVERY SIX MONTHS.

IF YOU DO ALTERNATIVE, UM, WE GO BACK AND FORTH ON REVIEW COMMENTS, AND THEN ONCE THE COMMENTS ARE RESOLVED, WE TAKE IT TO THE COMMISSION, UM, ON THIS ONE, THEY CHOSE STANDARD.

SO, UM, THE WAY STANDARD WORKS, YOU TURN IN YOUR APPLICATION AND LET'S SAY, DO IT SEPTEMBER 1ST.

IT HAS TO BE SCHEDULED FOR A P AND Z MEETING ON THE 30TH TO ISSUE THE COMMENTS.

SO THIS IS A CASE WHERE THEY CHOSE TO GO THAT ROUTE.

INSTEAD OF WORKING THROUGH IT WITH STAFF, WHAT WOULD BE THE BEST WAY IN YOUR OPINION TO RESOLVE THIS? UM, I'VE RECOMMENDED TO THEM THAT THEY DO THE ALTERNATIVE PROCEDURE AND WE'RE GOING TO GO BACK TO THEM AGAIN WITH IT.

SEEMS TO BE THE BIGGEST PROBLEM IS THEY'RE JUST NOT GETTING THEIR STUFF TO Y'ALL.

WELL, IF YOU LOOK AT THE COMMENT LETTER, UM, ONE OF THE PRIMARY COMMENTS WAS ABOUT, UM, AN ADDITIONAL REVIEW BY TRAVIS COUNTY.

ANYTIME YOU PROPOSE A PROJECT IN THE COUNTY, THAT'S ON A SEPTIC SYSTEM, THE COUNTY HAS TO SAY THE LOTS WORK FOR SEPTIC, AND THEY HAVEN'T GOTTEN THAT FEEDBACK.

SO WE CAN'T APPROVE, UM, THE LOT CONFIGURATION WITHOUT KNOWING THAT THEY MEET THEIR REQUIREMENTS, RIGHT.

YOU GOT TO GO THROUGH THE PARK TEST AND ALL THAT STUFF BEFORE THEY CAN DO IT.

WHAT ELSE IS HOLDING THEM UP? UM, THERE'S THE COMMENT LETTER IN YOUR PACKET? UM, THERE ARE A FEW CONCERNS WITH THE SURVEY, SO THEY DIDN'T PROVIDE THE POINT OF BEGINNING.

UM, THAT'S IMPORTANT FOR THE, THE CLOSURE FOR THE MEETS AND BOUNDS.

SO WE KNOW THAT IT ACTUALLY WORKS.

UM, THEY ADDED, UM, SOME, SOME NOTES ABOUT THE ETJ THAT WE WEREN'T COMFORTABLE WITH AND, UH, THEY REMOVED THE COMMISSIONER COURT'S APPROVAL STATEMENT, WHICH IS ALSO REQUIRED.

SO THIS HAS TO GO TO COMMISSIONER'S COURT AS WELL.

I FEEL LIKE THESE ITEMS, UM, COULD EASILY BE ADDRESSED IN OUR PLAN IS TO REACH OUT TO THE APPLICANT.

OKAY.

I NOTICED THAT THEY'RE JUST CUTTING TO TWO ACRES OUT OF THIS.

IS THIS SOMEBODY MOVING BACK HOME AND THEY'RE CUTTING IT? HMM.

THEY DON'T GIVE US THAT KIND OF INFORMATION.

THEY'RE JUST PROPOSING A PLAT FOR TWO LOTS.

SO IT COULD BE SOMETHING THAT'S NOT RESIDENTIAL BECAUSE WE DON'T HAVE ANY, UM, LIKE LAND USE REGULATIONS IN THAT AREA.

IF THEY HAD DONE THIS TO WHERE BOTH LOTS WERE FIVE ACRES OR MORE, WOULD THAT HAVE HELPED THEIR PROCESS ANY, UM, TH WE HAVE AN EXEMPTION ON OUR ORDINANCE THAT IF IT'S GREATER THAN FIVE ACRES, THEY DON'T GO THROUGH A PLOTTING PROCESS.

IF IT HAS ACCESS TO UTILITIES AND RIGHT AWAY, I THINK THE COUNTY'S MORE RESTRICTIVE AND THEY REQUIRED 10 ACRES.

SO THAT MIGHT'VE BEEN PART OF THE HURDLE ON THIS ONE.

OKAY.

AND I NOTICED THAT THEY HAVE TO PAY PAYMENT IN KIND FOR PARKS.

AND I, I GUESS THE REASON I WAS ASKING THIS IS IF THESE PEOPLE ARE JUST CUTTING OUT TWO ACRES FOR A SON OR DAUGHTER TO MOVE BACK IN, IT SEEMED A LITTLE HEAVY-HANDED TO MAKE THEM PAY WHAT IT WAS $1,400 FOR PAYMENT AND CON FOR A PARK.

YEAH.

THAT'S, UM, THAT'S OUR ORDINANCE REQUIREMENT AND THEY HAVEN'T RESPONDED TO THE COMMENTS OR REACHED OUT TO TALK ABOUT THEM.

UM, AND THAT'S SOMETHING ELSE THAT, THAT WE DO IS WHEN WE SEND THE COMMENT LETTER, WE'RE AVAILABLE TO TALK THROUGH THEM.

AND IF THEY DON'T CALL, WE CAN'T FORCE THEM.

OKAY.

I WAS JUST CURIOUS IF THIS IS SOMEBODY MOVING BACK AND IT'S APPARENT CUTTING OUT TWO ACRES FOR THEIR, THEIR CHILDREN.

IS THERE ANY WAY TO, UH, WAIVE THE PAYMENT IN KIND FOR PARKS? BECAUSE IT SEEMS A LITTLE HEAVY HANDED FOR SOMEBODY, SOMETHING THEY WORK WITH THE PARKS DIRECTOR.

UM, IT ALSO DEPENDS IF THEY'RE RESTRICTED TO RESIDENTIAL OR NOT, BUT IT'S ONE OF OUR SUBDIVISION ORDINANCE FOR CHRONIC.

ONE OTHER THING THAT I SAW HERE, IT SAYS HERE THAT, UH, IN TRAVIS COUNTY RAINWATER HARVESTING SYSTEM, PROVIDING STORAGE OF AT LEAST 2,500 GALLONS OF POTABLE OR NON-POTABLE WATER MUST BE INSTALLED ON EACH LOT WHEN A NEW STRUCTURE IS ERECTED.

IS THAT A TRAVIS COUNTY? OKAY.

AND TRAVIS COUNTY HASN'T REVIEWED THE PLOT.

SO I DON'T KNOW IF THEY'RE REQUIRING THAT OR NOT.

IT COULD BE, I'M JUST NOT FAMILIAR WITH IT.

CURIOUS IF TRAVIS COUNTY IS REQUIRING EVERYBODY OUT THERE TO PUT A RAINWATER COLLECTION SYSTEM, IT MIGHT BE A COMPROMISE SOMETIMES WHEN YOU DON'T HAVE WATER TO THE SITE, THAT'S SOMETHING THAT THEY DO LIKE FOR FIRES.

WELL, THAT ANSWERS ALL MY QUESTIONS.

SO IT JUST, IT, IT STRUCK ME AS A LITTLE BIT LIKE, GOSH, IT SEEMS LIKE WE COULD GET THIS THING DONE.

SO ARE WE BEING MORE PROACTIVE WITH THESE GUYS AND REACHING BACK OUT TO THEM? OR ARE WE JUST WAITING FOR THEM TO RESPOND? THAT'S PREPARING THE DOCUMENT AND HE'S DONE IT WITH US.

I JUST WANTED TO MAKE SURE THAT WE'RE NOT OVERLOOKING THESE GUYS BECAUSE THEY'RE NOT USED TO IT WITH THE PLAT.

THEY ALWAYS HAVE A PROFESSIONAL CAUSE YOU HAVE TO HAVE A SURVEYOR PREPARE IT.

MOVE ON TO AGENDA.

ITEM, NUMBER 11, CONDUCT A PUBLIC HEARING AND CONSIDER ACTION REGARDING ORDINANCE CASE 21.

TWO TO AMEND THE COMPOSITE ZONING ORDINANCE TO UPDATE THE NEIGHBORHOOD OUTREACH REQUIREMENTS LISTED AND TITLE ARTICLE X, SECTION THREE D, AND TO PROVIDE FOR A LATER MANNER MATTERS WILLIAMSON COUNTY AND TREVOR WILLIAMSON AND TRAVIS COUNTY, TEXAS STAFF PRESENTATION.

SO THIS IS A PUBLIC HEARING FOR AN AMENDMENT TO THE ZONING ORDINANCE.

UM, AND THIS IS IN RESPONSE TO SOME CONCERNS THAT THE COMMISSION'S HAD WITH OUR NEIGHBORHOOD OUTREACH.

UM, WE DID, UH,

LISTEN TO YOUR CONCERNS AND MAKE UPDATES TO THE ORDINANCE, UM, AND ALSO TAKE INTO ACCOUNT SOME OTHER FEEDBACK THAT WE'VE RECEIVED.

UM, WE ADDED REQUIREMENTS FOR CASES WHERE PROPERTY DOES NOT HAVE FRONTAGE ON OUR RIGHT-OF-WAY.

UM, WE DO HAVE SOME INSTANCES WHERE YOU GUYS ACTUALLY HAD A RECENT ONE, UM, WHERE IF THE PROJECT ISN'T ADJACENT TO THE ROUTE OF WAY, THEY DON'T HAVE TO POST A SIGN.

SO A LOT OF PEOPLE DRIVING BY WOULDN'T SEE IT.

SO WE ADDED THAT AS A REQUIREMENT.

UM, WE ALSO ADDED A REQUIREMENT FOR THEM TO, UH, CONFIRM THE SIGNAGE IS UP AND GIVE THEM A TIMEFRAME FOR HOW LONG IT SHOULD STAY UP.

AND WE UPDATED THE TIMING FOR THE COMPLETION OF THE NEIGHBORHOOD OUTREACH.

UM, AND WE'RE OPEN FOR ANY DISCUSSION OR OTHER IDEAS THE COMMISSION MIGHT HAVE TO ADD.

AND I CAN ANSWER ANY QUESTIONS AFTER THE PUBLIC HEARING.

SO, UM, UNDER FIVE C WE CHANGED IT TO SAY THE NEIGHBORHOOD OUTREACH SHALL BE COMPLETED PRIOR TO SUBMITTING THE ZONING APPLICATION.

UM, SOMETHING WE DID ADD TO THAT WAS, UM, THIS REQUIREMENT MAY BE DELAYED IF THEY'RE DOING A PLANNED UNIT DEVELOPMENT, BECAUSE THEY HAVE TO WORK THROUGH THOSE NOTES, THE EXAM TIME TO GET THAT STRAIGHT, BUT THEY WOULD HAVE TO COMPLETE IT BEFORE WE DID A PUBLIC NOTICE.

AWESOME.

THE ONLY ONE I HAVE IS THAT YOU QUITE CLEARLY STATE HOW LONG IT NEEDS TO STAY UP.

WHAT ABOUT MAKING THEM TAKE THEM DOWN? THAT'S A GOOD IDEA BECAUSE THEY, FOR INSTANCE, I'LL SAY THAT THAT ONE THAT'S OUT THERE ON 1 77 AND 1 76, THE BIG ONE THAT'S OUT THERE BY THE NICE LITTLE BRIDGE THAT GOES OVER THAT I SEE WHAT THOSE PEOPLE ARE TALKING ABOUT IS SCARY, BUT, UM, THOSE SIGNS ARE STILL UP OUT THERE AND THAT PUBLIC HEARING HAS BEEN GONE OVER FOR A COUPLE OF THAT.

ONE HAS ANOTHER PUBLIC HEARING THOUGH, FOR COUNCIL.

UM, YEAH, THERE ARE, YOU'RE CORRECT.

IT'S AN ISSUE, BUT THAT ONE NEEDS TO STAY BECAUSE THEY HAVE A COUNCIL MEETING STILL TO GET THROUGH.

SO MAYBE WE JUST NEED TO WRITE SOMETHING IN HERE THAT SAYS AFTER PUBLIC HEARINGS ARE CLOSED, YOU HAVE A COUPLE BECAUSE OTHERWISE THEY TURNED THE LID.

AND THAT'S SOMETHING WE CAN WORK ON ADDING TO THIS.
