FOR ITEMS ON THE AGENDA, I WILL CALL ON SPEAKERS PRIOR TO THE DISCUSSION OF THE AGENDA ITEM AND DURING THE PUBLIC HEARING, INDIVIDUALS THAT SUBMITTED

[00:05:01]

COMMENTS VIA THE WEBSITE WILL ONLY HAVE POSITIONS READ INTO THE RECORD.

ANY WRITTEN COMMENTS HAVE BEEN SHARED WITH THE COUNSEL AND WILL BE MADE A PART OF THE OFFICIAL RECORD.

IT'S IMPORTANT TO NOTE THAT DURING PUBLIC COMMENTS, IT IS YOUR TIME TO COMMUNICATE WITH US.

WE CANNOT HAVE A BACK AND FORTH THOUGH, BECAUSE THAT WOULD BE DELIBERATION.

UM, WHEN I CALL YOU UP, YOU WILL HAVE THREE MINUTES UP.

FIRST IS KATHY BERNARDI.

GOOD EVENING, MS. BON BERNARDI.

PLEASE GIVE YOUR NAME AND ADDRESS.

YOU'LL HAVE THREE MINUTES.

HELLO, CITY, COUNCIL, MAYOR AND CITY MANAGER.

FIRST OF ALL.

OH, MY NAME'S KATHY PAN BERNARDI 1412 VALENTI LANE IN LEANDER.

FIRST OF ALL, I WANT TO THANK WHATEVER DEPARTMENT IS IN CHARGE OF CHANGING THE US AND TEXAS FLAGS ON MUNICIPAL AND BAGHDAD.

THEY LOOK FANTASTIC.

THEY WERE ALL RAGGEDY AND NOW THEY ARE BRAND NEW.

I WAS VERY HAPPY TO SEE THAT.

I DON'T KNOW, I DIDN'T PUT IN A BLURB FOR THAT, BUT SOMEBODY DID.

ALSO, THANK GOODNESS FOR THIS TRAFFIC SIGNAL BEING INSTALLED AT BAGHDAD AND SUNNY DRIVE.

THAT IS MY SUBDIVISION RIGHT THERE AT MASON HILLS, AND IT'S BEEN VERY DANGEROUS TO CROSS OR TURN NORTH FROM MASON HILLS SUBDIVISION.

MY NEIGHBORS ON THE FACEBOOK PAGE WERE QUITE PLEASED WITH THIS NEWS.

IT WAS GOOD TO SEE SOME OF YOU AT THE OLD TOWN CHRISTMAS FESTIVAL ON SATURDAY, DECEMBER 3RD.

THE LEANDER ACTIVE ADULTS PARTICIPATED FOR THE FIRST TIME WITH A FLOAT THAT WE PUT IN MANY HOURS AND OUR OWN MONEY.

WE WALKED HANDED OUT CANDY AND MADE MANY CHILDREN AND ADULTS SMILE.

GETTING THE COMMUNITY IN THE CHRISTMAS SPIRIT.

I WAS DISAPPOINTED THAT, THAT SOME OF YOU DID NOT MAKE THE EFFORT TO CROSS THE STREET FROM PARKS AND REC OFFICE TO COME AND TALK TO US AND JUDGE THE FLOAT.

WE WERE PRETTY PROUD OF IT EVEN IF WE DIDN'T GET A MENTION.

I KNOW NOT EVERYONE GETS A TROPHY.

NOT IN MY WORLD.

ANYWAY.

OUR OWN ALICE IN HER TUTU DID MAKE ONE OF THE PICTURES ON THE CITY FACEBOOK PAGE, WHICH WE ALL MADE A BIG MENTION OF.

UM, AND THEN HERE'S A FEW PICTURES FROM THAT WE POSTED, WE HAD ON OUR FLOAT, AND WE WERE VERY HAPPY ABOUT ALL OUR ACTIVITIES THAT THE SENIORS DO, AND WE NEED TO ENCOURAGE DOING MORE.

SO THE ACTIVE ADULTS ARE STILL WAITING FOR WORD AS TO WHEN WE WILL HAVE SHOVELS IN THE GROUND FOR OUR CENTER.

I UNDERSTAND THE PROJECT IS OUT FOR REED WITH SOME MAYBE SOME ANSWERS IN MARCH OR APRIL OF 2023.

THE NEXT ACTIVE ADULT COMMITTEE MEETING IS JANUARY 18TH AT THREE 30.

MAYOR CHRISTINE WILL BE OUR LIAISON AND MR. CUMMINS IS SCHEDULED TO, UM, MAKE AN ATTENDANCE AND GIVE US AN UPDATE ON THE CENTER.

WE HAVE FIVE NEW MEMBERS THAT HAVE NOT SEEN THE DESIGN AND ARE BRAND NEW ON BOARD.

PLUS CHRISTINE, OR EXCUSE ME, KIRSTEN, NANCY, AND MYSELF HAVE NOT SEEN AN UPDATED VERSION.

IT WILL BE NICE TO GET US INFORMED IN CLOSING, AS I DID LAST YEAR WITH THE SAME REQUEST.

PLEASE GO INTO THE NEW YEAR REMEMBERING THE ACTIVE ADULTS AS OTHERS.

OOPS, LET ME TURN THIS UPSIDE DOWN.

AND OTHER SENIORS IN LEANDER.

THE PROMISES THAT WERE MADE IN 2021 ARE STILL ON EVERYONE'S MIND IN ADDITION TO KNOWING A BOND IN 2016 WAS PASSED TO COVER PART OF THE EXPENSE.

THANK YOU FOR YOUR TIME.

MERRY CHRISTMAS TO ALL AND TO ALL GOODNIGHT.

SEE YOU IN 2023 AND HAPPY BIRTHDAY, CHRIS.

OH, AND HERE'S SOME COLE FOR THOSE THAT WERE NAUGHTY .

THANK YOU, MS. BON BERNARDI.

UH, WHILE WE CANNOT HAVE BACK AND FORTH IN DELIBERATION, WE CAN HAVE STATEMENTS OF FACT.

AND IT IS A FACT THAT I AM SORRY I DID NOT SEE YOUR FLOAT.

I WAS UNAWARE THAT THERE WERE ANY FLOATS OFF OF THE ROUTE.

SO I'M SORRY.

I DON'T KNOW WHO ELSE MISSED IT, BUT THERE WAS NO MEMO THAT WENT OUT THAT TOLD US Y'ALL WERE SOMEWHERE ELSE, BUT I WAS VERY HAPPY TO SEE YOU IN THE PARADE.

.

THANK YOU.

UH, ALL RIGHT, UP NEXT IS CHEYENNE GUTTI.

I'M SO SORRY IF I PRONOUNCED THAT WRONG.

PLEASE COME UP.

PLEASE STATE YOUR NAME AND ADDRESS.

YOU'LL HAVE THREE MINUTES.

SURE.

MY NAME IS SHAM GRI AND UH, MY ADDRESS IS 1900 EQUINE ROAD, LEANDRO, TEXAS 78 6 41.

UH, HELLO MAYOR AND ALL THE REPRESENTATIVES.

THANK YOU FOR GIVING ME THE OPPORTUNITY TO SPEAK HERE.

UH, THIS IS REGARDING, UH, THE ROAD.

I THINK FEW OF MY, UH, FRIENDS HAVE ALREADY RAISED THE CONCERN ON THE EQUINE ROAD, WHICH IS, UH, THE INTERSECTION OF A COUNTY ROAD IS 2 67 AND KAUFMAN LOOP, THE ROAD IS ANGLED IN A WAY THAT THE TRAFFIC, I MEAN THE, THE SPEED IS 30, BUT IF YOU GET ON THE ROAD AUTOMATICALLY, YOU GET ON 45 BECAUSE THE ANGLE IS THAT WAY.

IT'S 45 DEGREES DOWN, AND THE HOMES UP FRONT ARE, IT'S A ONE ACRE LOT.

SO THE SIDE, UH, THE SIDEWALKS WERE NOT GIVEN

[00:10:01]

AS WELL AS, UH, STREET LAKES ARE NOT GIVEN.

SO IN THE NIGHT IT'S BECOMING SO DIFFICULT, EVEN THE, TO GET THE KIDS OUT BECAUSE IT'S SO HAZARD THAT PEOPLE ARE GOING AT A 60 SPEED.

SO, UH, WE, WE DON'T KNOW.

WE ACTUALLY TALKED TO HITCH A TO GET SOME SIDEWALKS, AND THEY HAVE NOT CONSIDERED THE, UH, A REQUEST.

THEY HAVE CANCELED IT BECAUSE IT COSTS MONEY.

AND THEN WE, WE TRIED TO HIRE AN ATTORNEY.

IT WAS COSTING A LOT AS WELL TO TALK TO HITCH A.

SO NOW WE ARE KNOCKING YOUR DOOR AND SEE THAT IF YOU CAN HELP OUT, UH, BECAUSE IT'S REALLY BECOMING A PROBLEM FOR THE KIDS EVEN TO GET OUT AFTER SIX O'CLOCK.

IT'S VERY DARK.

SINCE IT'S A ONE ACRE LOT, THE LIGHTS ARE ALSO NOT UP THERE.

SO IT'S, IT'S GETTING TO A POINT WHERE LIKE, UH, AFTER SIX O'CLOCK WE ARE SHUTTING OUR DOORS AND STAYING INSIDE.

SO I WOULD REALLY, REALLY REQUEST, UH, IF YOU CAN TAKE THIS AS A REQUEST AND SEE IF YOU CAN GET AT LEAST SOME SPEED BOMBS OR STOP SIGNS, OR AT LEAST A TRAFFIC COP BEING THERE.

I MEAN, TO BE FRANK, RIGHT, IF, IF A COP GETS THERE ONE DAY, HE CAN MAKE THE MONEY FOR THE FULL MONTH.

IT'S, IT'S THAT WAY.

, IT'S, IT'S, IT'S REALLY THAT WAY.

AND BECAUSE THE PEOPLE ARE NOT STOPPING AT ALL, AND UNFORTUNATELY THERE IS A HECHE BEE RIGHT NEXT TO IT ON THE, ON THE KAUFMAN LOOP.

SO ALL THE TRAFFIC FROM, UM, OUR COMMUNITY WANTED COMMUNITY AND LARKSBURG AND ACHAR RIDGE, ALL OF THEM TAKE THAT ROUTE TO GET TO THAT H HEB, BECAUSE THAT'S EASIER ROUTE.

SO THE TRAFFIC FOR EVERY MINUTE, I WOULD SAY AT LEAST A COUNT OF 6,200 VEHICLES GO ON IF I COUNTED.

I MEAN, I WAS GIVING THE JOB TO MY KID AND JUST TO, TO JUST TO COUNT IT UP.

BUT IT WAS CLOSE TO THAT.

SO, UH, I REALLY WANTED TO BRING THIS UP TO YOUR ATTENTION AND SEE IF WE CAN HELP IN ANY WAY.

THANK YOU AGAIN FOR GIVING ME THE OPPORTUNITY TO BE HERE AND, UH, HEARING MY REQUEST.

THANKS AGAIN.

THANK YOU.

UH, UP NEXT IS .

PLEASE GIVE YOUR NAME AND ADDRESS.

YOU'LL HAVE THREE MINUTES.

UH, HI, I'M KAUL GUNTHER.

UH, I'M AT 1912 EQUIN ROAD, LEANDER, TEXAS 78 6 41.

THANK YOU VERY MUCH FOR HEARING, UH, GIVING ME AN OPPORTUNITY TO SPEAK HERE.

UH, I'M SHAMS NEIGHBOR .

WE PRETTY MUCH HAVE THE SAME CONCERN.

UM, THE ROAD IS AN ACCESS ROAD FOR OTHER NEIGHBORHOODS TO GET TO H HEB, AS YOU SAID.

UM, ALSO THE SAD PART IS NO ONE IS ADULT ENOUGH TO PAY ATTENTION TO THE SPEED LIMIT THAT'S POSTED THERE.

PEOPLE ARE FLYING PAST THAT ROAD AT 60 MILES AN HOUR.

UM, IN ADDITION, WE'VE GOT A LOT OF CONSTRUCTION TRUCKS GOING ON.

UM, LOT OF MOVEMENT.

UM, IT'S, IT'S REALLY DIFFICULT FOR US TO EVEN BACK OUT OF OUR DRIVEWAY SOMETIMES BECAUSE OF THE TRAFFIC THAT'S COMING IN.

NO ONE SEEMS TO WANT TO SLOW DOWN.

NO ONE WANTS TO STOP TO GIVE WAY.

UM, THIS MAKES IT EVEN MORE TROUBLESOME FOR KIDS TO GO TO EACH OTHER'S HOUSES UNLESS, UNTIL THEY WANT TO TRESPASS ONTO OUR NEIGHBORS, UH, FRONT YARDS AND GO, WE DON'T HAVE ANY SIDEWALKS, NO LAMPS, STREET LAMPS.

SO, UH, AGAIN, I'D LIKE TO ECHO HIS REQUEST TO SEE IF THERE IS SOME POLICE PRESENCE EVERY NOW AND THEN TO DISCOURAGE PEOPLE FROM, UH, SPEEDING.

UM, MAYBE ADD SOME STOP SIGNS TO INTERSECTIONS, WHICH WILL FORCE PEOPLE TO STOP AND SLOW DOWN.

UH, ALSO SOME SPEED BREAKERS WOULD BE REALLY AWESOME IF WE CAN'T GET SIDEWALKS BECAUSE I THINK THE ODDNESS TO, UH, WAVE THE SIDEWALK WAS DONE WAY BEFORE ALL THE DEVELOPMENT THAT TOOK PLACE THERE.

NOW WITH THE HEB RIGHT THERE WITH A LOT OF PEOPLE WANTING TO MOVE THROUGH THAT ROAD, MAYBE WE HAVE TO REASSESS THAT AND PROBABLY BRING THE SIDEWALKS BACK.

UM, WELL, THAT'S ALL.

UH, THANK YOU SO MUCH FOR HEARING ME OUT.

I APPRECIATE IT.

HOPEFULLY WE CAN SEE SOME RELIEF COME THROUGH.

UH, THANK YOU.

THANK YOU, SANTOSH MO, GOOD EVENING.

PLEASE GIVE YOUR NAME AND ADDRESS.

YOU'LL HAVE THREE MINUTES.

HI, MY NAME IS SANTOSH MO.

I LIVE ON 2036 EQUINE ROAD.

AGAIN, SAME AS SHAM AND, UH, KA I'M THE FIRST HOME, UH, I'M THE FIRST HOME ON EQUINE AND COUNTY ROAD 2 67.

IF YOU EVER DRIVE TOWARDS OR COME TO OUR NEIGHBORHOOD, YOU CAN SEE IT'S A 45 DEGREE ANGLE ON COUNTY ROAD 2 67.

AS SOON AS YOU JUMP ON IT.

SO EVEN THOUGH AS GOOD SHAM SAID, THE 30 SPEED LIMIT IS POSTED RIGHT THERE AND YOU'RE COMING ON THE ROAD, YOU CANNOT SEE THE OPPOSITE TRAFFIC AND THE COUNTY ROAD 2 67, UH, IT WAS A COUNTY ROAD, I'M SURE SINCE LONG TIME.

BUT, UH, I'M SURE EVEN THE TRAFFIC WAS NOT DESIGNED WHEN THE ROAD WAS DESIGNED.

NOBODY WOULD'VE IMAGINED HOW MUCH TRAFFIC IS ON THAT STREET.

IT'S A SMALL ROAD AND IT'S ON A HILL.

SO OBVIOUSLY WHEN IT RAINS, IT EROSION HAPPENS.

AND RIGHT NOW, IF YOU SEE, I SOMETIMES I DOUBT WHETHER WHICH

[00:15:01]

COUNTRY I AM IN.

I'M FROM INDIA, AND, UH, WE ARE STILL DEVELOPING COUNTRY.

THE ROADS ARE THE SAME WAY AS THE COUNTY ROAD 2 67.

AGAIN, NO OFFENSE, THERE IS RAIN, THERE IS EVERYTHING PLANNING AND EVERYTHING GOES, BUT PEOPLE TEND TO DRIVE TOWARDS LEFT TO AVOID THE POTHOLES.

AND THE ANGLE OF THE ROAD IS IN SUCH A WAY THAT THE GUY COMING FROM DOWN CANNOT SEE WHAT IS UP.

SO I'M SURE SOMEDAY SOMETHING HAPPENS.

AND TOUCH WOOD, I DON'T WANT IT TO BE VITAL, BUT THAT'S THE SHAPE OF THE COUNTY ROAD 2 67.

AND AS I SAID, IT'S A 45 DEGREE ANGLE.

EVEN IF YOU WANT TO DRIVE 30, UNLESS YOU APPLY BRAKES, THE CAR FLIES AT 45.

AND AS I KNOW THERE'S A LOT OF CONSTRUCTION VEHICLES, WHICH DAMAGES THE ROAD AND EVERYTHING.

BUT IF YOU GUYS CAN JUST TAKE A LOOK, I WOULD APPRECIATE, UH, AND YOU CAN UNDERSTAND WHY OUR CONCERNS ARE SO MUCH.

AND AGAIN, I WANT TO COME EVERY MEETING.

I HAVE TWO YOUNG KIDS AND I TRY TO, AND MY SON IS LIKE, SOMETIMES HE GOES INTO LIKE THINKING SOMETHING AND HE, THESE DAYS, SOCCER IS A BIG THING GOING ON IN THE COUNTRY.

SO HE KICKED THE BALL ON THE ROAD AND HE WAS STANDING IN THE MIDDLE OF THE ROAD AND HE WAS, HE WENT TO LIKE SOMETHING, HE WAS THINKING MAYBE WHY NEMAR IS MAKING SO MUCH MONEY OR SOMETHING.

HE'S A BIG FAN OF NAMAR.

SO LUCKILY COUPLE STOPPED AND HE PUSHED HIM, UH, ON THE ROAD.

SO AT THAT MOMENT, I WAS THINKING, WHAT, ON WHAT AGE COMMON SENSE COMES? SO I'M ASKING MYSELF DO, AT WHAT AGE DID I GET MY COMMON SENSE? I ASKED MY DAD AND HE SAID, DO YOU, DO YOU THINK YOU HAVE THE RIGHT COMMON SENSE RIGHT NOW? IS THAT'S WHAT MY DAD'S ANSWER WAS.

BUT I DON'T KNOW.

I CANNOT EXPLAIN THAT TO MY SEVEN YEAR OLD SON.

I'M TRYING TO EXPLAIN HIM NOT TO GO ON THE ROAD, BUT AGAIN, KIDS ARE KIDS, SO I'M LIKE, I'M ALWAYS WATCHING THEM WHEN THEY'RE GOING ONTO THE STREET.

AND AS CHM SAID, WHEN IT IS GETTING DARK, I'M LIKE PUSHING THEM INSIDE THE HOME.

I KNOW THESE ARE ACRE LOTS HOME.

AND, UH, I, I WISH, AGAIN, AS I SAID LAST TIME I DID MY RESEARCH WHEN I BOUGHT IT, SINGLE FAMILY ESTATE HOME IS MY HOME.

AND IDEALLY, SIDEWALK SHOULD HAVE BEEN THERE.

BUT THE BUILDER HAS TOOK AN EXCEPTION.

AND, UH, CITY HAS APPROVED, MAYBE CITY APPROVED BECAUSE THE POINT THE BUILDER HAS MENTIONED THAT HE HAD TO CUT DOWN A LOT OF TREES.

BUT ANYWAY, I DON'T WANT TO REPEAT MYSELF.

IF ANYTHING CAN BE DONE, PLEASE DO IT.

AND FROM YOUR END AND HAPPY HOLIDAYS AND GOD BLESS ALL.

THANK YOU.

THANK YOU.

I DO NOT HAVE ANYBODY ELSE SIGNED UP FOR NON AGENDA ITEM PUBLIC COMMENTS.

WAS THERE ANYBODY ELSE WHO WISH TO SPEAK ON SOMETHING NOT POSTED ON THE AGENDA?

[7. Recognitions/Proclamations/Visitors. Certificate of Recognition Judge Edna Staudt]

ALL RIGHT, MOVING ON TO ITEM NUMBER SEVEN, RECOGNITIONS, PROCLAMATIONS AND VISITORS.

TONIGHT WE HAVE SPECIAL GUEST JUDGE EDNA OUT AND, UH, COUNCIL MEMBER PEN PARKER WILL BE READING OFFICE CERTIFICATE FOR HER.

THANK YOU.

WELL, IF I HAD TO SAY SOMETHING MYSELF, WE WOULD BE HERE FOR A VERY LONG TIME AND I WOULD PROBABLY END UP IN TEARS.

AND SO WOULD THE REST OF YOU, YOU, BECAUSE THERE'S SO MUCH THAT COULD BE SAID ABOUT THIS LADY.

UM, BUT WITH THAT, WE HAVE SOMETHING SHORT AND SWEET AND I'LL JUST READ IT.

UM, LET IT BE KNOWN THAT JUDGE EDNA STOUT IS RECOGNIZED, IS RECOGNIZED BY THE MAYOR AND CITY COUNCIL OF LEANDER FOR YOUR LIFELONG COMMITMENT TO NUMEROUS CAUSES AND FOR, FOR SERVING WITH DISTINCTION AND HONOR FOR 28 YEARS AS JUSTICE OF THE PEACE IN PRECINCT TWO WILLIAMSON COUNTY.

YOUR RETIREMENT MARKS THE END OF A REMARKABLE ERA, AND WE ACKNOWLEDGE YOUR OUTSTANDING WORK THAT IMPROVED THE LIVES OF CHILDREN, YOUTH, AND FAMILIES.

THIS CERTIFICATE IS ISSUED IN RECOGNITION THEREOF ON THIS DAY, DECEMBER 15TH, 2022.

CHRISTINE DELLY, MAYOR, THANK YOU.

WOULD YOU LIKE TO SAY SOMETHING? I WANNA SAY THANK YOU TO THE COUNCIL VERY MUCH.

EACH ONE OF YOU, UH, I ADMIRE YOU FOR, FOR YOUR WORK ON THE COUNCILORS.

YOU, MY HUSBAND SERVED FOR SEVEN YEARS ON LAND COUNCIL.

I HOPE TO SOME DEGREE WHAT THE SACRIFICE IS LIKE, GET BLAME FOR EVERYTHING.

I KNOW THAT .

SO THANK YOU SO MUCH FOR YOUR SERVICE AND THANK YOU FOR THE RECOGNITION.

UM, I WAS ELECTED IN 1994, JUST PEACE.

AND THE REASON THAT I RAN, THE REASON THAT I CONTINUED TO BE THERE WAS BECAUSE I REALLY HAVE A HEART FOR THIS ISSUE, FOR THIS WHOLE AREA, BORN AND RAISED IN AUSTIN.

LEANDER HAS BEEN A PART OF MY LIFE TO SOME DEGREE, ALMOST MARRIED A MAN FROM LEANDER HIGH SCHOOL.

BUT INSTEAD I'M MARRIED A GOD FROM MC CALLUM.

BUT IT, IT'S, UM, THIS AREA HALLS ABOUT ALWAYS HELD A, A PLACE IN MY HEART, THIS WHOLE AREA.

MY, MY PRECINCT THAT WE SENT TWO FOR THOSE WHO DON'T KNOW STARK AT THE SPICEWOOD SPRINGS OF 180 3.

AND THOSE ARE ELECTED THROUGH THE COUNTY LINES.

SO IT TAKES IN LEANDER AND LIBERTY HILL, CEDAR PARK, A LITTLE BIT OF AUSTIN.

AND I'VE

[00:20:01]

ALWAYS WANTED THE PERSON THAT IS IN THIS JUST OF THE PEACE ROLE BECAUSE THIS, THIS ROLE AS JUST AS A PEACE IN THIS AREA, DEALS WITH PEOPLE WHERE THEY ARE.

WHETHER IT'S A FAMILY ISSUE WITH A HUSBAND OR CHILD, WHETHER IT'S A FINANCIAL ISSUE WITH IF IT'S A PERSONAL ISSUE, FAMILY ISSUE, WHETHER IT'S A FINANCIAL ISSUE.

CAUSE YOU CAN'T TAKE CARE OF YOUR FINANCES, WHETHER IT'S A LANDLORD TEMP ISSUE OR EVEN WHETHER YOU GET YOUR CAR TOW ILLEGALLY WANT FUSS ABOUT IT.

THAT ALL COMES TO THE JP COURT.

AND SO I DEAL WITH A LARGE RIGHT OF ALL KINDS OF ISSUES AND THEY HAVE TO DEAL WITH YOU.

AND I ALWAYS WANTED SOMEONE IN THAT POSITION THAT UNDERSTOOD THAT.

AND I FELT LIKE I DID, AND I KNEW I HAD A JOB THAT WAS GONNA HELP ME UNDERSTAND.

AND SO I'VE ALWAYS RELIED ON HIM TO SHOW ME, TO GUIDE ME, TO GIVE ME THE WISDOM AND THE DIRECTION ON THE THING.

SOMEBODY ASKED ME RECENTLY WHAT THE, THE BIGGEST CHALLENGE WAS.

AND I SAID, THE CHALLENGE IS TO MAKE THE RIGHT DECISION, THE RIGHT DECISION ON YOUR CASE, THE RIGHT DECISION WITH YOUR FAMILY, THE RIGHT DECISION WITH THE JUVENILE THAT I'M DEALING WITH, ALWAYS WANTED TO DO WHAT WAS BEST WITH THAT PERSON.

I BELIEVE THAT EVERY PERSON IS CREATED BY GOD AND THAT THEY'RE ONE OF GOD'S CHILDREN.

AND THAT MEANS THAT I NEED TO TREAT THEM WITH THAT KINDA RESPECT.

CAUSE THEY'RE A SPECIAL, UNIQUE INDIVIDUAL AND THEY HAVE A VALUE.

HE LOVES THEM AND I LOVE THEM.

AND SO IT'S BEEN A TREMENDOUS BLESSING.

GOD HASN'T USED ME IN GREAT WAYS, BUT HE'S USED THE PEOPLE THAT HAVE COME TO ME IN RESOURCES, WHETHER IT BE THE MENTORS OR THE PEOPLE PROGRAM OR THE, THE JAIL, THE JOBS PROGRAMS. THE JOE ELLIOT FROM THE CHAPLAINCY, EVERYTHING, JOE ALISON, I'M JOE ELLIOTT WITH CAT, YOU'RE WITH THE CHAPMAN, JOE.

I JUST CALL HIM JOE BOB.

IT'S EASIER.

BUT, UH, ALL OF THAT IS PART OF WHAT THE JUSTICE OF THE PEACE DOES, AND IT GIVES YOU THE OPPORTUNITY, DO A LOT OF DIFFERENT PLACES.

SO I THANK YOU FOR THE RECOGNITION.

IT HAS BEEN A JOY TO WORK WITH THIS COMMUNITY, ALLOWS YOU FOR WHATEVER REASON, MAY HAVE COME TO THE COURT.

THE REST OF YOU, I PRAY YOU NEVER HAVE TO COME TO THAT COURT.

UM, BUT IT'S ALWAYS BEEN A PLEASURE AND AN OPPORTUNITY FOR ME TO SERVE MY COMMUNITY, AND I'M VERY GLAD THE OPPORTUNITY.

SO THANK YOU FOR ALL THE MANY YEARS THAT I HAVE BEEN REELECTED.

ALL DIFFERENT TO BE THERE.

AND NOW IT'S TIME.

I SAID MOVE ON AND WE'LL DO SOMETHING ELSE.

I DON'T, THAT IS, BUT I'LL JUST FOLLOW.

THANK GOD BLESS YOU ALL.

TAKE A PICTURE HERE, IF YOU DON'T MIND.

OH, YOUR MOM WAS PROBABLY THE MOST, OH YEAH, IT WAS.

THANK YOU SO MUCH, JUDGE, FOR YOUR SERVICE.

MOVING

[8. Leander History]

ON TO ITEM NUMBER EIGHT, LEANDER HISTORY WITH CAT HOWELL.

GOOD EVENING.

OH, IS THIS ON? OKAY.

UM, TODAY I AM SPEAKING ABOUT A LITTLE BIT ABOUT CHRISTMAS, THE HISTORY OF CHRISTMAS AND HIS, UH, CHRISTMAS HERE, AND THEN HOW WE HERE IN OUR COMMUNITY, UM, SUPPORT IT.

UM, AS MANY OF YOU KNOW, WHEN THE UNITED STATES WAS FOUNDED, CHRISTMAS WAS ACTUALLY OUTLAWED IN MANY PLACES.

UM, WE HAVE A PURITAN FOUNDATION, AND, UM, CHRISTMAS WAS, UH, NOT CELEBRATED, UH, HARDLY AT ALL.

AND IN MANY COMMUNITIES IT WAS ABSOLUTELY OUTLAWED.

YOU WERE FINED, UM, IF YOU WERE CAUGHT PARTYING AT, AT, AT ALL.

UH, CHRISTMAS WAS SLOWLY

[00:25:01]

INTRODUCED IN THE UNITED STATES AND SLOWLY ACCEPTED.

AND IT WAS FINALLY MADE A HOLIDAY IN 1870.

UM, PART OF THAT WAS IN A PART OF THE BIG MOVEMENT WAS IN 1843, A CHRISTMAS CAROL WAS WRITTEN, AND A CHRISTMAS CAROL BROUGHT IN THE FACT THAT FAMILY AND CHARITY, IT SHOULD BE THE POINT OF CHRISTMAS, WHICH MATCHED WITH THE CHRISTIAN IDEALS OF THE UNITED STATES.

SO IT BROUGHT MORE OF THE CHRISTMAS, UH, SPIRIT INTO THE UNITED STATES AND ALLOWED US TO MOVE INTO, UH, ALLOWING IT AS A HOLIDAY.

SO, UM, HERE IN TEXAS, SINCE WE WERE A POORER COMMUNITY, CELEBRATING CHRISTMAS, WE, UM, IN THE 1850S WHEN OUR COMMUNITY WAS SETTLED, THERE WAS VERY LITTLE CELEBRATION OF CHRISTMAS.

UM, IT, THERE, THERE WOULD BE CHURCH SERVICES AND MAYBE A MEAL WITH THE FAMILY.

UM, FAST FORWARD, UH, UP TO ABOUT THE 1870S, 1880S, THAT'S WHEN MORE, UM, VICTORIAN IDEALS STARTED TO BE BROUGHT IN.

AND THAT'S WHEN CHRISTMAS TREES WERE INTRODUCED HERE IN CENTRAL TEXAS, IN OUR AREA, WE USED CEDAR TREES.

SOME PEOPLE USED, UM, CACTUS BECAUSE THEY WERE AVAILABLE.

WEST TEXAS.

THEY USED, UM, TUMBLEWEED, EAST TEXAS.

OF COURSE THEY HAD PINE TREES SO THEY COULD HAVE REAL CHRISTMAS TREES.

BUT HERE WE WERE STUCK WITH THE, THE CEDAR TREES.

AND, UM, FOR DECORATIONS, THEY WERE ALL HOMEMADE THINGS.

AND, UM, THERE WERE, UM, THE PAPER CHAINS THAT WERE ON THERE AND THEN LATER ON INTRODUCED POPCORN.

THAT WAS NOT EARLY ON BECAUSE THAT WAS A FOOD STUFF AND THAT WAS MEANT TO BE EATEN.

UH, YOU DID NOT WASTE FOOD BECAUSE IT WAS SO VALUABLE.

UM, AND SINCE THERE WAS NO ELECTRICITY, PEOPLE WOULD PUT CANDLES ON THEIR TREES.

AND AS WE ALL KNOW, CEDAR TREE MAKES A GOOD KINDLING.

SO, UM, THERE WERE LOTS OF FIRES FROM, UH, CHRISTMAS TREES, UNFORTUNATELY.

UM, FAST FORWARD A LITTLE BIT AND WE GET INTO THE, UM, MORE OF THE 20TH CENTURY.

IN THE 20TH CENTURY IS WHERE SANTA CLAUS WAS REALLY INTRODUCED.

AND IN 1930, THE COCA-COLA CAMPAIGN USING SANTA, THE CHARACTER OF SANTA CLAUS IS WHEN SANTA CLAUS ACTUALLY CAME TO OUR AREA IN A BIG WAY, AND IT CAME INTO THE UNITED STATES AND IT JUST GREW AND GREW AND GREW FROM THERE.

AND YOU NOTICE COCA-COLA STILL USES SANTA CLAUS IN THEIR CHRISTMAS CAMPAIGNS TODAY BECAUSE IT'S BEEN SO SUCCESSFUL FOR ALMOST A HUNDRED YEARS.

UM, SO, UM, THE, THE, GOING INTO THE TURN OF THE CENTURY, THE 1880S, 1890S TO CELEBRATE IN THIS AREA, WE HAD A LOT OF COWBOYS.

WE HAD A LOT OF LABORERS.

AND TO CELEBRATE, PEOPLE WOULD GET WITH THEIR FAMILY AND ENJOY FOOD TAMALES, PREK.

THAT'S WHERE, UM, THE TRADITION HERE, IT'S STILL TAMALES.

YES, IT'S NOT CHRISTMAS WITHOUT TAMALES.

IT REALLY, REALLY ISN'T.

AND, UM, THAT IS THE TRADITIONS THAT WE HAD HERE.

ANOTHER TRADITION THAT WE HAVE HERE IS THAT WE HAVE A VERY GIVING COMMUNITY.

AND OUR COMMUNITY HAS BEEN ONE OF THE LEADERS IN THE BLUE SANTA MOVEMENT IN THE HILL COUNTRY CHRISTMAS BUREAU, UM, BLUE SANTA.

I HAVE BEEN RESEARCHING BLUE SANTA.

THE VERY FIRST, UH, TOY DRIVE FOR CHRISTMAS WAS TOY FOR TOTS IN 1947 IN CALIFORNIA, THE US MARINE CORPS.

THE NEXT TIME THAT WE RECOGNIZE ANY, UH, UH, LARGE SCALE TOY DRIVE IS IN AUSTIN, TEXAS.

IN 1972, IT WAS STARTED BY TWO POLICE OFFICERS ON THEIR ROUTE IN EAST AUSTIN.

THEY RECOGNIZED THAT THERE WERE SEVERAL FAMILIES THAT WERE NOT GONNA HAVE CHRISTMAS.

SO THEY WENT TO, AT THE TIME, WE DIDN'T HAVE WALMART HERE.

SO THEY WENT TO, UH, WINS AND SKILL LEARNS, AND THEY WENT THE FIVE AND DIME STORES.

AND THEY WENT AND OUT OF THEIR OWN POCKETS, THEY PURCHASED GIFTS AND THEN FOOD AND GAVE IT TO THOSE FAMILIES.

THAT, UM, LATER ON, A LITTLE LATER, UH, OFFICERS IN SAN MARCOS DID THE SAME THING.

1973, THERE WERE, UH, COMMUNITIES SUCH AS WAXAHACHIE THAT THEY HAD TOY DRIVES FOR THEIR, UM, THEIR CHILDREN THAT WERE IN NEED.

AND THEN THAT MOVEMENT HAS GROWN AND GROWN AND GROWN.

SO WE MOVE ON TO THE HILL COUNTRY, UH, CHRISTMAS BUREAU, HILL COUNTRY CHRISTMAS BUREAU.

IT STARTED OUT IN AUSTIN.

THIS IS, ITS, UM, 40TH YEAR.

AND AT ONE POINT THEY HAD SOME, UM, FINANCIAL ISSUES AND THE POLL PROGRAM WAS DROPPED, AND LEANDER PD PICKED IT UP.

THE BLUE SANTA FROM HERE IN LEANDER PICKED IT UP AND TOOK CARE OF THAT PROGRAM.

I DON'T KNOW HOW THEY DID IT.

IT WAS AN OUTSTANDING ACCOMPLISHMENT.

THEY DID IT, UM, WITH VERY LITTLE RESOURCES, VERY LITTLE TIME.

AND THEY DID THAT.

AND THEN WE HAVE HILL COUNTRY COMMUNITY MINISTRIES, WHICH STARTED

[00:30:01]

IN 1983 HERE.

UM, IT WASN'T, IT ACTUALLY STARTED, UM, CLOSER DOWN TO THE SIX 20 AREA.

BUT AGAIN, IT WAS CITIZENS THAT WERE IN NEED AND WE HAD CITIZENS THAT STEPPED UP.

AND IT'S BEEN CONTINUING AND GROWING AND GROWING AND GROWING.

AND NOW WE, THESE PROGRAMS SERVE NOT JUST THE LEANDER COMMUNITY, BUT IT SERVES ALL OF THIS PART OF CENTRAL TEXAS.

AND YOU'RE GOOD.

I'M NOT GONNA CUT OFF CHRISTMAS.

YOU CAN KEEP GOING.

ALL RIGHT.

WELL, WELL, AND, AND THE POINT IS, IS THAT LEANDER IS A VERY GIVING COMMUNITY AND ITS FOUNDATIONS WERE IN VERY, UM, A VERY GIVING COMMUNITY AND FAMILY AND FRIENDS WERE THE, THE, THE FOUNDATION.

AND WE CONTINUE WITH THAT TODAY.

SO THANK YOU.

THANK YOU.

ALL RIGHT, MOVING

[ CONSENT AGENDA: ACTION]

ON TO OUR CONSENT AGENDA.

ITEM 22 HAS BEEN PULLED FROM CONSENT AND WILL BE CONSIDERED SEPARATELY.

COUNSEL, YOU'LL BE CONSIDERING CONSENT.

AGENDA ITEMS NINE THROUGH 21 AND 23,227.

THIS IS AN ACTION ITEM.

MOTION TO APPROVE.

YES, SECOND MOTION.

AND SECOND, IS THERE ANY DISCUSSION? ALL THOSE IN FAVOR PASSES UNANIMOUSLY.

THANK YOU.

[22. Approval of a third extension for waiver of Article 8.04, Noise, Section 8.04.001(a) (11) to Cadence McShane Construction in the hours of construction work to begin at 3:00 a.m. through March 31, 2023, for construction activities for the Blockhouse Creek Farms project site located on 14951 Ronald Reagan. The contractor will post notifications for nearby tenants a minimum of forty-eight (48) hours in advance of the activities.]

ITEM 22, APPROVAL OF A THIRD EXTENSION FOR WAIVER OF ARTICLE 8.04.

NOISE SECTION 8.0 4.001 A 11 TO CADENCE MC SHANE CONSTRUCTION IN THE HOURS OF CONSTRUCTION WORK TO BEGIN AT 3:00 AM THROUGH THROUGH MARCH 31ST, 2023 FOR CONSTRUCTION ACTIVITIES FOR THE BLOCKHOUSE CREEK FARMS PROJECT SITE LOCATED ON 14 90 51, RONALD REAGAN, THE CONTRACTOR WILL POST NOTIFICATIONS FOR NEARBY TENANTS A MINIMUM OF 48 HOURS IN ADVANCE OF THE ACTIVITIES.

IS THERE ANYBODY PRESENTING ON THIS? AH, THANK YOU.

GOOD EVENING, MR. GRIMS BOW, YOU EVENING MAYOR COUNCIL, DAN GRIMS WILL, EXECUTIVE DIRECTOR OF INFRASTRUCTURE.

SO, UH, WE BROUGHT THIS NOISE ORDINANCE A COUPLE TIMES AND, UM, UM, THE, THE, THE PROJECT, UM, IF YOU WANNA SAY SUPERINTENDENT HAS CHANGED A COUPLE TIMES AND THEY DIDN'T UNDERSTAND THAT, UM, WE TRY NOT TO BRING IT THREE TIMES, YOU KNOW, JUST ONE TIME FOR THE LENGTH OF THE PROJECT.

UM, I ACTUALLY WENT OUT AND TALKED WITH THE CURRENT, UM, CITY, MANUAL CITY OR UH, UH, SUPERINTENDENT OUT THERE, OR GENERAL MANAGER.

AND, UH, BUT DID A SITE VISIT, HUGE SITE.

UM, THERE'S STILL 13 MORE PADS TO PLACE.

THEY, THEY'VE HAD COMPLETED SEVERAL.

UM, THE LARGEST ONES ARE 700, UH, CUBIC YARDS, THAT'S 70 TRUCKS, EACH TRUCK CARRYING ABOUT 10 CUBIC YARDS OF TRUCKS.

SO, UM, ENSURING THAT THOSE TRUCKS GET DELIVERED, UM, TIMELY AND, UM, IN A FASHION THAT'S, UH, METHODICAL, MEANING CONTINUOUS CUZ YOU HAVE YOUR CRUISE AND YOUR PUMP TRUCK OUT THERE, WHICH THEY DID OUT, UM, THE OTHER DAY AND I WAS OUT LOOKING AT IT.

UM, THAT'S THE REASONS WHY MANY PROJECTS, UM, START AT, UM, MIDNIGHT, UM, 1, 2, 3 IN THE MORNING.

UM, SO I, SO I DID DO SOME, UM, A LITTLE, LITTLE RESEARCH AND, AND I, AND I WANT TO GIVE YOU, UM, I I, I KNOW THERE MIGHT BE SPEAKERS IN THE, IN THE, THE SUPERVISORS HERE AND, AND CAN ALSO SPEAK CUZ WHEN WE WERE OUT THERE TALKING, I SAID, WELL, WHEN WE'RE TALKING ABOUT THIS, WE NEED TO HAVE DATA.

AND SO HOW MANY TRUCKS CAN WE DO, YOU KNOW, IN THE MORNING, UH, AT THREE O'CLOCK IN THE MORNING VICE HOW MANY TRUCKS WE CAN DO AFTER EIGHT O'CLOCK WHEN THERE'S TRAFFIC AND SCHOOLS AND EVERYTHING ELSE.

AND THEN, UM, THEY ALSO GOT A, A LETTER FROM THE, UH, FROM THE ACTUAL, THE CONSTRUCTION OR THE CONCRETE COMPANY EXPLAINING KIND OF THEIR PHILOSOPHY ON THE REASON WHY WE START EARLY.

AND A LOT OF IT HAS TO DO WITH, UH, TRAFFIC AND TRUCK TURNAROUND TIME AND GETTING BACK TO THE PLANT TO GET THE NEXT LOADS TO KEEP THAT 70 TRUCK PROCESS MOVING.

UM, MOVING ALONG.

SO, SO A COUPLE THINGS ABOUT CONCRETE AND, AND WHY WE AS CONSTRUCTION PEOPLE DO WHAT WE DO AT THREE O'CLOCK IN THE MORNING.

UM, SO WHEN, WHEN CONCRETE CURVES OUTTA HIGH TEMPERATURE, IT HAS A HIGH RATE OF EVAPORATION CAUSING UNWANTED BLEMISHES AND CRACKS.

SO, SO WITH THAT SAID, FROM THE, UH, UM, CONCRETE SPECIFICATIONS FROM THE ASNS, UM, UM, MANUAL, WHICH IS THE, UH, 40 10 S CONCRETE STRUCTURE SPECIFICATION FOR TRANSPORT TIME BASED ON, BASED ON A TRANSPORT TIME.

CONCRETE IS A CHEMICAL REACTION THAT, THAT ONCE IT STARTS, YOU CAN'T STOP IT.

AND, AND IF YOU DON'T GET IT PLACED AND A CERTAIN AMOUNT OF TIME, UM, THEN IT BECOMES AN ISSUE.

UM, AND SO ME PERSONALLY, ON MY CONSTRUCTION PROJECTS, I HAD THREE CONCERNS THAT I ALWAYS WORRIED ABOUT.

ONE WAS THE PLACEMENT OF CONCRETE BECAUSE IT'S YOU, YOU BETTER BE READY.

YOU HAVE ALL YOUR GUYS, ALL YOUR TEAM, LITERALLY THIS, THIS ENGINEER BASICALLY SAID IN HIS MEMO, ALL HANDS ON DECK, THAT IS

[00:35:01]

NOT A LIE.

THE SECOND ONE WAS DEALING WITH CRANES.

UM, EVERY TIME I WAS ON A PROJECT SITE, THEY HAD TO, THE CRANES HAD TO BE METICULOUS, UM, BECAUSE THEY HAVE A TENDENCY TO FAIL CATASTROPHICALLY MEETING TIP OVER OR OR BREAK WHEN THEY HAVE A HEAVY LOAD.

AND THE LAST ONE WAS DEALING WITH THE LIVE ELECTRICITY.

UM, ANY OF MY, MY CREW MEMBERS WORKING ON LIVE LOADS, UM, THAT WAS A BIG DEAL THAT I MAKE SURE THEY HAD ALL THEIR, UM, ARC FLASH GEAR ON BECAUSE SUPER DANGEROUS AND IT ONLY TAKES A NANOSECOND FOR YOU TO GET HIT BY LIVE, LIVE VOLTAGE AND OR, OR AMPERAGE IN THIS CASE.

AND, UH, AND YOU'RE DEAD.

SO, SO WITH THAT SAID, WE DO HAVE TIMELINES AND, AND, AND IF IT'S OVER 90 DEGREES, WE ONLY HAVE 45 MINUTES TO GET IT THERE.

THE TEMPERATURE THAT MOST PEOPLE LIKE IS BETWEEN 75, YOU KNOW, IT'S 74, 75 AND YOU GOT ABOUT 60 MINUTES TO GET THE TRUCK THERE.

AND THAT MEANS GET IT LOADED, GET IT TO THE SITE, UM, GET IT PARKED, START GETTING IT TO THE PUMP TRUCK, AND THEN THE PUMP.

IF, IF IT'S A PUMPER OR WHEELBARROWS OR HOWEVER THEY'RE GETTING IT FROM THE TRUCK TO THE PAD, UM, THAT'S THE, THAT'S THE A LOT OF TIME, OTHERWISE YOU'LL TIME OUT.

AND THEN THE, THE PROBLEM IS, IS THE CONCRETE'S STILL HARDING AND IF IT HARDS IN A TRUCK, THAT'S BAD OR IF IT GETS TOO HARD, AND I'LL EXPLAIN THIS IN A MINUTE, IT'S SUPER HARD TO WORK WITH.

UM, AND I HAVE AN ANALOGY FOR THAT.

SO, SO, SO MANY OTHER THINGS.

UM, GETTING THE CONCRETE IN PLACE BEFORE SUNUP ALSO ALLOWS THE FOUNDATION WORKERS TO CONDUCT THE LABOR INTENSE SCREENING.

THAT'S THE PROCESS WHERE ONCE IT'S IN PLACE, YOU GO WITH YOUR, UM, TRIALS OR YOUR BULL FLOATS OR YOUR ELECTRIC, UH, UM, UM, I, I CALLED THEM, UH, UM, LIKE ROTATING DISC THAT, YOU KNOW, SMOOTHED OUT THE, THE CONCRETE.

AND UM, I LOVED RUNNING THOSE.

UM, MY STAFF ALWAYS SAYS, YOU CAN RUN ONE OF THOSE.

HECK YEAH, LET'S GET OUT THERE AND DO IT.

UM, SO, SO THAT'S VERY INTENSE.

SO ONCE YOU GET THE CONCRETE IN PLACE, YOU ACTUALLY DO A LOT MORE WORK.

SO THE TRUCKS MIGHT BE DONE AND YOU'RE STILL WORKING FOUR HOURS LATER TO MAKE SURE THE CONCRETE'S ACTUALLY IT'S GOING AWAY, THAT IT'S GONNA LOOK.

UM, THE NEXT ONE IS FOR OPTIMAL RESULTS.

CONCRETE SHOULD BE IN PLACE WITHIN 90 MINUTES OF THE LOADING OF THE TRUCK, DEPENDING ON THE PROXIMITY OF THE PLANT, UH, TO THE FINAL DESTINATION.

THIS CAN BE A BIG CHALLENGE, UM, ESPECIALLY IN CONGESTION OR IN GROWING CITIES.

UM, TEXAS HAS NUMEROUS TO INCLUDE US, AS YOU CAN SEE, IT IS A MAJOR EVENT, IS STARTING EARLY, NO TRAFFIC JAMS, UM, WHICH IS TRUE.

UM, THIS, THIS, THIS PERSON ALSO STATED THAT EARLY MORNING CONCRETE POURS ARE NOT UNCOMMON ON JOB SITES FOR, UH, FOR VARIOUS REASONS.

FIRST, REGARDLESS OF THE SEASON OF THE WEATHER, THERE IS LESS TRAFFIC AT FOUR OR THREE O'CLOCK IN THE MORNING TO HOLD UP READY, MIXED CONCRETE TRUCK DELIVERY.

IF THERE IS HEAVY TRUCK AND A POSSIBILITY EVEN OF A WRECK, THEN NO LIKELIHOOD OF HAVING TO DISCARD A TRUCK GOES UP.

UM, YOU DO NOT WANT TO SEND BACK A TRUCK THAT'S 10, 10 CUBIC GUARDS, UM, THAT YOU'RE SENDING BACK THAT YOU HAVE TO DISPOSE OF.

UM, AND THERE IS, THERE'S COST WITH THAT COUPLE TRUCKS.

YOU'RE TALKING 20, $30,000 ADDS UP PRETTY QUICK.

UM, SO, SO THOSE ARE, THOSE ARE SOME OF THE, THE, THE COMMON THINGS.

SO A LITTLE BIT ABOUT CONCRETE, AND I DON'T KNOW IF ANYBODY HERE HAS WORKED WITH IT, BUT I HAVE A LOT AND IT, AND IT REMINDS ME OF ANALOGY OF, OF BUTTER.

SO WHEN BUTTER IS HARD AND YOU'RE TRYING TO GET IT OUT THERE, YOU KNOW, COLD, IT'S HARD TO MOVE.

WELL, WHEN CONCRETE SITS FOR TOO LONG AND IT STARTS HARDENING, UM, HOW WE MEASURE IT IS A SLUMP.

YOU PUT IT LITERALLY IN A CONE AND YOU FILL IT UP WITH CONCRETE AND YOU LIFT THAT CONE AND DEPENDING ON HOW MUCH IT SLUMPS, IT TELLS YOU IF THE CONCRETE'S GOOD AND WE HAVE SPECS FOR THAT, THAT THEY HAVE TO FOLLOW.

UM, FIVE INCHES AND USUALLY KIND OF THE POINT WHERE YOU SEE SPECS, BUT IF IT'S SIX OR SEVEN, THAT MEANS IT'S ALREADY HARDENING.

AND WHEN YOU GET IT OUT THERE TRYING TO MOVE THAT AROUND, IT'S LIKE TRYING TO GET BUTTER THAT'S COLD ON A PIECE OF BREAD, RIBS, IT TEARS, YOU CAN'T MOVE IT.

YOU REALLY WANT IT AT ROOM TEMPERATURE OF THE BUTTER GOES ON NICE AND SMOOTH, SPREADS OUT, LOOKS PRETTY, AND YOU'RE READY TO GO TO TOWN ON YOUR BREAD.

THE OTHER THING IS IF IT'S TOO RUNNY, UM, TOO MUCH WATER IN IT, UM, WITH THE BATCH PLANT, THEN IT SLUMPS, FLATTENS OUT.

UM, AND THEN IT BECOMES LITERALLY LIKE MELTED BUTTER.

IT'S TERRIBLE.

YOU, YOU HAVE TO SEND IT BACK.

YOU CAN'T DO ANYTHING WITH IT.

SO CONCRETE'S VERY FINICKY.

IT, IT LIKES TO BE RIGHT IN THAT MIDDLE, UM, FOR MULTIPLE REASONS.

THE OTHER THING IN THE MORNING IS THAT YOU, SOME PEOPLE THINK WELL JUST SEND ALL THE TRUCKS THERE.

WELL, AGAIN, WE TALKED ABOUT THE TIMING.

SO YOU, YOU HAVE TO LIMIT THE NUMBER OF TRUCKS.

THEY, THEY CAN BE AT THE ACTUAL SITE BECAUSE OF THE TIME ASSOCIATED WITH THE CONCRETE IN A TRUCK.

THAT'S WHY CONCRETE, YOU HAVE TO KEEP MOVING.

YOU SEE 'EM SPINNING THE BARREL BECAUSE THEY'RE TRYING TO MAKE SURE THAT IT'S, YOU KNOW, UM, NOT GONNA HARDEN UP.

AND SO THE MOVEMENT HELPS THAT.

SO IN THE MORNING THEY CAN, THEY CAN GET THROUGH AN HOUR SAY SEVEN OR EIGHT TRUCKS, BUT WHEN TRAFFIC STARTS HITTING AT EIGHT OR NINE OR 10 OR

[00:40:01]

11, AND THEN THAT TRUCK MIGHT GO DOWN TO THREE OR FOUR AND THEN THE TURNAROUND TIME GETS QUICKER AND THE CONCRETE THAT'S IN PLACE STARTS HARDING MORE FASTER.

AND THEN YOU CAN GET COLD JOINTS, WHICH IS NOT WHAT YOU WANT.

IT'S CUZ IT'S HARD TO GET THE CONCRETE THAT'S IN PLACE, THE MIX WITH THE CONCRETE THAT YOU'RE ADDING TO IT AND YOU HAVE VIBRATORS AND EVERYTHING OUT THERE TO DO IT.

UM, BUT IF, IF YOU LET IT GO TOO LONG, THEN THE, THE THE LAYERS TRYING TO CONNECT DON'T DO VERY WELL.

SO WITH ALL THAT SAID, UM, I I, AND I KNOW, UM, WE WORK HARD TO FACILITATE NOTIFYING PEOPLE AND THE, THE EARLY MORNING IS, YOU KNOW, CAN BE TROUBLESOME.

UM, BUT THERE'S A LOT OF REASONS, UM, WHY CONSTRUCTION COMPANIES START AT THE ONE OR TWO IN THE MORNING.

YOU KNOW, IT'S NOT BECAUSE THEY WANT TO BE BAD NEIGHBORS, IT'S BECAUSE, UM, THERE'S A LOT OF RISK ASSOCIATED WITH PLACING CONCRETE AND A LOT OF THE RISK IS TAKEN OUT WHEN YOU'RE FOUR O'CLOCK IN THE MORNING OR THREE O'CLOCK IN THE MORNING.

THAT'S TRAFFIC-WISE, THAT'S WEATHER-WISE, THE WIND IS MUCH CALMER AT NIGHT IF YOU GET A LARGE WIND OR OTHER THINGS THAT CAN EVAPORATE THE CONCRETE AND CAUSE MORE ISSUES, UM, PEOPLE DON'T THINK ABOUT IT.

BUT, UM, IT'S ACTUALLY A REALLY FUNNY MATERIAL AND IT'S PRETTY FINICKY AND IT, IT DOESN'T GIVE YOU MUCH TIME TO SAY, GET YOUR JOB DONE.

AND SO, UH, SO I I WANTED TO GIVE YOU A LITTLE HISTORY ON, ON THE INNER WORKINGS OF, YOU KNOW, THEY'RE OUT THERE TRYING TO GET THAT DONE AND IF IT LOOKS LIKE THEY'RE IN A MAD DU IT'S BECAUSE THEY ARE, UM, ALL THE GUYS ARE WHERE THEY NEED TO BE.

THEY ALL HAVE, THEIR TOOLS ARE MOVING THAT CONCRETE AROUND TO GET IN PLACE.

CUZ YOU KNOW, IT'S NOT VERY FORGIVING ONCE THE HARDEST.

SO I KNOW THERE MIGHT BE SOME SPEAKERS AND IF WE NEED THE, UH, APPLICANT TO COME UP, UM, WE CERTAINLY CAN AND THEY CAN KIND OF GO THROUGH THE NUMBER OF PATHS THEY HAVE AND KIND OF WHAT THEIR PLAN IS AND TRY TO FACILITATE TO REDUCE THE NOISE AND, AND THE LIGHT AND SO FORTH ALONG WITH THAT.

BUT THAT'S, THERE'S A LOT OF CONCRETE TO PLACE OUT THERE.

SO, UM, JUST KIND OF GIVING YOU THAT.

ANY QUESTIONS FOR ME BEFORE I STEP OFF? THANK YOU MR. GRUBA.

I THINK WE'LL LISTEN TO THE SPEAKERS AND THEN WE'LL CIRCLE BACK.

ALRIGHTY.

THANK YOU.

OKAY.

ALL RIGHT.

FIRST UP IS, UH, MICHAEL KREIDER.

GOOD EVENING.

PLEASE GIVE YOUR NAME AND ADDRESS.

YOU'LL HAVE THREE MINUTES.

MY NAME IS MICHAEL KREIDER.

I LIVE ON BONE STREET 26 25 LEANDER.

I APPRECIATE THIS OPPORTUNITY, I APPRECIATE ALL YOUR EFFORTS YOU GUYS DO TOO.

I KNOW IT'S AN UNFORGIVING JOB.

UM, I UNDERSTAND THEIR, THEIR PROBLEMS THEY HAVE WHEN THEY DO CONSTRUCTION, UM, CONCRETE, I DON'T KNOW WHERE THEY'RE ACTUALLY PURCHASING OR BUYING THEIR CONCRETE FROM AND TRANSPORTING IT FROM.

WE DO HAVE CONCRETE PLANT THAT IS UP THE ROAD NOT TOO FAR.

SO, YOU KNOW, AN HOUR TIME I DON'T SEE AS A PROBLEM, ESPECIALLY ON RONALD REAGAN.

UM, THE, YOU'VE UNANIMOUS, MS. LEE APPROVED THIS SEVERAL TIMES.

THEY HAVE BROKEN, WE'VE NEVER RECEIVED A 48 HOUR NOTICE EVER FROM THEM.

UM, WE HAVE BEEN WATCHING THEM POUR FROM THE FAR SIDE IN THE BEGINNING UP TO OUR FENCE LINE, WHICH IS BONE STREET RIGHT ON THE EDGE OF IT.

UM, THEY HAVE A TENDENCY TO TURN THE LIGHTS ALL DIRECTLY AT OUR NEIGHBORHOOD.

UM, THEY'RE NOT TRYING TO DISPERSE THEM IN ANY SORT OF PATTERN, BUT THEY'RE DIRECTLY ALL INTO OUR NEIGHBORHOOD.

UH, THEY SAY THEY JUST USE LIGHTING, BUT THEY ARE USING GENERATORS.

THEY'RE TURNING 'EM ALL INTO THE DIRECTION THE WHERE THE MUFFLERS ARE FACING OUR HOUSING.

I HAVE A NEIGHBOR NEXT DOOR AND MYSELF WHO ON A FLOOR, WHICH WAS AT ONE IN THE MORNING AND THAT GENERATOR JUST WENT ALL NIGHT AND THERE WAS NO WAY IN THE WORLD, I MEAN, THEY COULD HAVE TURNED IT ANYWAY, BUT THEY WERE BEING INCONSIDERATE OF THE NEIGHBORHOOD.

THERE'S ABSOLUTELY NO WAY IN THE WORLD THAT THESE PEOPLE COULD ACTUALLY CONSIDER, YOU KNOW, THE PEOPLE LIVING HERE, CHILDREN, YOU KNOW, BEING WOKE UP, YOU KNOW, THAT EARLY IN THE MORNING SCHOOL IS GOING BACK IN AND THEY'RE ASKING FOR A HUGE, UNPRECEDENTED AMOUNT OF TIME TO DO THIS WHENEVER THEY WANT.

YOU KNOW, I THINK ABOUT MY, MY, YOU KNOW, THE CHILDREN IN THE NEIGHBORHOOD, YOU KNOW, THE PEOPLE THAT WORK THERE.

IF THEY COME IN AT ONE OR THREE IN THE MORNING, THEY'VE OBVIOUSLY BROKE THESE, THESE, YOU KNOW, AGREEMENTS THAT THEY'VE MADE WITH YOU.

AND I, I FIND IT QUITE AMAZING THAT COMING BACK IN SAYING, WELL, WE WOULD LIKE IT MORE AND WE WOULD LIKE EVEN MORE, YOU KNOW, SO I REALLY LEAVE IT UP TO YOU AS A COUNCIL TO SAY, YOU KNOW, YOUR NEIGHBORHOOD IS BEING IMPACTED AND NEIGHBORS, FAMILIES, YOU KNOW, ARE BEING IMPACTED BY A COMPANY IS GONNA MAKE MONEY.

WE LIVE HERE, YOU KNOW, THEY'RE GONNA LEAVE.

YOU KNOW, SO I WOULD APPRECIATE YOU TO TAKE THAT IN CONSIDERATION.

WE'RE ALL NEIGHBORS, YOU KNOW, SO YOU GOTTA TAKE CARE OF ALL OF LAND, YOU KNOW, AND NOT JUST

[00:45:01]

OUR NEIGHBORHOOD, BUT DON'T LET CONTRACTORS LIKE THIS WHO WILL JUST CONTINUALLY, YOU KNOW, BREAK THE LAW, YOU KNOW, AND, AND IN AGREEMENTS THAT YOU'VE MADE, YOU KNOW, AND ALLOW THEM TO CONTINUE THIS KIND OF PROCESS.

AND I, I APPRECIATE YOUR TIME.

THANK YOU VERY MUCH.

THANK YOU.

OUR NEXT SPEAKER IS RYAN COOPER.

GOOD EVENING.

PLEASE GIVE YOUR NAME AND ADDRESS.

YOU'LL HAVE THREE MINUTES.

HELLO, RYAN COOPER, 25 45 BOWEN STREET.

UM, MY WIFE AMY AND I'S HOUSE IS ONE OF THE 15 HOUSES ON BOEING STREET IN THE HAZELWOOD SUBDIVISION THAT IMMEDIATELY BACKS UP TO BLOCKHOUSE FARM APARTMENT COMPLEX CONSTRUCTION.

UH, THANK YOU FOR THE OPPORTUNITY FOR ME TO SPEAK TONIGHT.

I'D ALSO LIKE TO THANK TONY GIBBS AND LORI ELDRED FOR THEIR PROMPT CORRESPONDENCES REGARDING THE CONSTRUCTION CO CONSTRUCTION COMPANY'S CODE VIOLATION LAST WEEK WHEN THEY POURED AT 3:00 AM OUTSIDE OF THE PREVIOUSLY APPROVED VARIANCE, AS WELL AS FOLLOWING UP ON THE CONSTRUCTION VEHICLES THAT ARE MISTAKENLY BEING D DIRECTED THROUGH OUR NEIGHBORHOOD.

REGARDING THESE EARLY MORNING CONCRETE PORES, OUR BEDROOM IS IN THE BACK OF THE HOUSE AND WE HAVE BEEN WOKEN UP BY EACH AND EVERY OVERNIGHT PO THAT HAS OCCURRED SO FAR.

IDEALLY, WE WOULD REQUEST THAT THESE 3:00 AM PORES DO NOT HAPPEN IF WEATHER OR TRAFFIC CONDITIONS ALLOW FOR A POUR TO BE CONDUCTED DURING THE DAY WITH PROPER SETTING OF THE CONCRETE.

IT IS OUR OPINION THAT IT NEEDS TO BE DONE DURING THE DAY TO PREVENT UN UNNECESSARY DISTURBANCES, BUT IF THAT CANNOT HAPPEN, WE HAVE TO HAVE NOTICE TO PREPARE FOR ALTERNATE SLEEPING ACCOMMODATIONS.

THE 48 HOUR NOTICE STATED IN THE PREVIOUS APPROVED VARIANCES HAS NEVER BEEN PROVIDED TO THE HAZELWOOD COMMUNITY FOR A BLANK CHECK VARIANCE THROUGH MARCH.

LIKE THIS ONE.

NOTIFICATION AND ENFORCEMENT OF THAT NOTIFICATION SHOULD BE REQUIRED OF THE CONSTRUCTION COMPANY IF A POOR MUST BE DONE OVERNIGHT.

I THINK CLEAR SIGNAGE AT THE DEAD END OF REPUBLIC TRAILS AND NOTIFICATION PROVIDED TO OUR HO HOA BOARD IS A MINIMAL AND REASONABLE REQUEST.

I THINK IT'S ALSO WORTH NOTING THAT THE CLOSEST OF THESE PORES TO OUR HOMES IS YET TO COME FOR OUR COMMUNITY AND WOULD SURELY BE A PART OF THIS OR ANY OTHER FEATURE EXTENSIONS.

SEVERAL APARTMENT BUILDINGS WILL BACK UP TO OUR HOMES AT ALMOST THE CLOSEST DISTANCE ALLOWED BY CITY BUILDING CODE.

THERE ARE NO TREES FOR PRIVACY BECAUSE THEY WERE ALL CUT DOWN.

THIS IS REALLY ANOTHER CONVERSATION, BUT SEVERAL OF YOU HAVE HEARD ME DISCUSS THIS IN PRIOR COMMUNICATION.

UNFORTUNATELY, THE CLOSE PROXIMITY AND FREQUENCY OF THESE PORES IS A BYPRODUCT OF OUTDATED BUILDING CODE AND EASY TO OBTAIN INCREASED POPULATION DENSITY INCENTIVES FOR THE DEVELOPER THAT I BELIEVE NEED TO NEED TO BE RECONSIDERED FOR SINGLE FAMILY ZONING THAT IS ADJACENT TO MULTI-FAMILY ZONING.

WHILE THAT CANNOT BE FIXED, NOW, I URGE YOU TO REVISIT THIS PARTICULAR TOPIC FOR ANY FUTURES SIMILAR ZONING ARRANGEMENTS.

TO SUMMARIZE IT IS OBVIOUSLY IN OUR COMMUNI COMMUNITY'S BEST INTEREST FOR THESE POORS TO HAPPEN DURING THE DAY, BUT IF SOME MUST HAPPEN OVERNIGHT, COMMUNICATION NEEDS TO BE MADE REGARDING THE SPECIFIC TIMING.

THANK YOU AGAIN FOR YOUR TIME AND I HOPE YOU ALL HAVE A GOOD HOLIDAY SEASON.

THANK YOU.

THANKS.

I HAVE SEVERAL PEOPLE WHO WANT THEIR POSITION READ INTO THE RECORD, BUT I DON'T HAVE ANYBODY ELSE SIGNED UP TO SPEAK.

WAS THERE ANYBODY ELSE WHO WISHED TO SPEAK ON THIS ITEM? OKAY, THE FOLLOWING PEOPLE JUST WANTED, I DIDN'T SEE A CONTRACTOR.

OKAY.

WELL DID YOU WANNA MAKE A PUBLIC COMMENT OR DID YOU WANNA HAVE Q AND A WITH US AFTER PUBLIC COMMENT? Q AND A WOULD BE FINE.

OKAY, SO THE FOLLOWING PEOPLE WOULD LIKE TO HAVE THEIR POSITION READ INTO THE RECORD.

KIRIN CARUM IS AGAINST, JOSHUA HAWKINS IS AGAINST ADRIANA NORTHAM IS AGAINST ANGELA HI IS AGAINST KATIE HEIM IS AGAINST, I'M SO SORRY, SETH ARANIAN KRISHIN IS AGAINST TAYLOR HYDE CAMP IS AGAINST, ANGELA HILT IS AGAINST, AMY COOPER IS AGAINST, AND DINA KREIDER IS AGAINST.

UM, DID YOU WANNA GO AHEAD AND COME UP NOW? SURE.

OKAY.

COUNSEL, DID YOU HAVE QUESTIONS FOR THE APPLICANT? IF NOT, I WILL START.

WELL, I I DID HAVE A QUESTION.

UM, ACTUALLY IT'S SOME OF THE THINGS THAT, THAT WERE BROUGHT UP.

I WANTED TO KNOW IF, UM, THEY, IF Y'ALL HAVE BEEN COMPLIANT WITH, UM, THE, THE START TIMES SINCE IT WAS APPROVED SO THAT THOSE WERE SOME OF THE QUESTIONS THAT WERE BROUGHT UP.

SO THERE'S AN, I I DON'T KNOW IF IT'S IF THAT'S HAPPENING OR WHAT IF IT'S A PERCEPTION.

I'M, I'M ASKING, SO HAVE Y'ALL BEEN STARTING EARLIER AS I TOOK OVER THE JOB ON NOVEMBER 14TH, I BECAME THE SUP THREE ON THE SUPERINTENDENT, THREE ON THE JOB SITE.

THERE

[00:50:01]

WAS ONE INCIDENT AS OF LAST FRIDAY THAT I WAS OUTTA TOWN AND THEY DID START OUTSIDE OF THE NOISE VARIANCE ORDINATION OR APPROVAL THAT WE HAD.

OKAY.

SO THAT IS THE ONLY OCCURRENCE I WILL SAY THAT.

OKAY.

AND AS FAR AS THE UM, THE SIGNAGE OR NOTIFICATION, HOW IS THAT, HOW ARE YOU DOING THE NOTIFICATION TO I HAVE BEEN PERSONALLY NOTIFYING, UM, I'VE REACHED OUT, I CANNOT REMEMBER, UM, VERONICA'S LAST NAME.

SHE WAS WITH THE HOMEOWNER'S STATION FROM HAZELWOOD.

MM-HMM.

.

I DID REACH OUT TO HER.

UM, AND THEN I NOT NOTIFY THE APARTMENT COMPLEX, I KNOW THIS DOESN'T HAVE TO DO WITH THE SUBJECT BY THE APARTMENT COMPLEX AND ADJACENT TO THE OTHER SIDE OF OUR PROPERTY.

OKAY.

UM, WE ARE GONNA TAKE FURTHER MEASURES TO MAKE SURE THAT EVERYBODY IS NOTIFIED IF THIS IS APPROVED.

OKAY.

UM, WHILE YOU'RE ON THAT, MAYBE YOU CAN JUST ASK WHAT ARE THE MEASURES YOU'RE WILLING TO, TO TAKE? UM, WE ARE CONSIDERING PLACING, GETTING A SIGN MADE COR, UH, CORE CLASS SIGN THAT IF, UH, IF THE HOA ALLOWS US, THEN WE'LL PLACE IT THE ENTRANCES TO HAZELWOOD ALLOWING US TO PUT A DATE, CONCRETE FLOOR SCHEDULED FOR THIS DAY AND IT'LL BE VISIBLE AT BOTH ENTRANCES TO HAZELWOOD.

SO IT COVERS THE WHOLE, THE TIMEFRAME FOR EVERYTHING.

SO, UH, I'M NOT SURE WHO HAS THE ANSWER TO THIS, BUT IF WE, IF WE WERE NOT TO APPROVE THIS, WHAT IS THE TIME THAT, THAT YOU CAN START? SEVEN O'CLOCK.

SEVEN O'CLOCK.

OKAY.

SO, UM, SO WE'VE APPROVED THE THREE O'CLOCK TWICE.

YES MA'AM.

AND WITHOUT US APPROVING ANYTHING, YOU CAN START AT SEVEN.

WHAT ARE THOSE CIRCUMSTANCES? WHAT, WHAT WOULD THAT DO TO YOU IF, IF WE DID NOT APPROVE THIS? MOST OF MY PORES ARE ON AVERAGE OF ANYWHERE FROM FIVE TO 700 YARDS.

OKAY.

IF I START AT 7:00 AM I AIN'T GOING TO BE GOING ABOVE AND BEYOND THE NOISE ORDINANCE IN THE EVENING.

IT MAY BE 11, 12, 1 O'CLOCK, THEN I'LL STILL BE RUNNING MY GENERATOR OR NOT GENERATORS, MY LIGHT TOWERS AND STUFF.

OKAY.

SO I'M, I'M GOING PAST THE SEVEN O'CLOCK CUTOFF TIME GOTCHA.

FOR THE, AND I'M LOOKING AT WORST CASE SCENARIO.

I'M JUST YES MA'AM.

THAT'S WHY I'M ASKING THAT.

AND GO, GO AHEAD.

YOU FINISH HERE.

IT'S GONNA TAKE LONGER TO, TO DO MY FORCE.

OKAY.

MORE TIME.

UM, THE, THE GENERATORS ARE, ARE THERE GENERATORS THAT ARE RUNNING ALL NIGHT? THEY DO SOUND LIKE GENERATORS, BUT THEY ARE OUR LIGHT TOWERS.

OKAY.

UM, WE DO TRY TO TAKE EVERY EFFORT WE CAN NOT TO FACE THOSE LIGHT TOWERS.

MM-HMM.

, UM, THE WAY WE, THE, THE SLAB THAT HE, THE GENTLEMAN WAS TALKING ABOUT WAS SLAB NUMBER FIVE WHERE WE HAD TO FACE HIM.

IT WAS CLOSE PROXIMITY TO THE FENCE SO THERE WAS SOME SHINE BACK ON THE HOMES.

MM-HMM.

WHERE WE TRY TO MINIMIZE THAT AS MUCH AS WE CAN.

YEAH.

YEAH.

I CAN'T IMAGINE IT BEING DONE ON PURPOSE BUT I, YOU KNOW.

RIGHT.

NO MA'AM, I WOULDN'T HAVE IT.

IT'S STILL CAN BE DISRUPTIVE.

I UNDERSTAND.

SO THAT, THAT'S ALL I HAVE FOR NOW.

I MAY HAVE ANOTHER QUESTION BUT Y'ALL PLEASE GO AHEAD.

THANK YOU COUNSEL.

ANY MORE QUESTIONS FOR THE APPLICANT? SO YOU SAID CONSIDERING GET AN ASSIGN MADE, WHAT ARE SOME CONCRETE STEPS THAT WE CAN TELL THESE PEOPLE THAT YOU GUYS ARE GONNA TAKE TO ACTUALLY NOTIFY THEM? CUZ WE HEARD A LOT OF PEOPLE SAYING THAT THEY'RE AGAINST IT AND THEY'VE NOT RECEIVED ANY TYPE OF NOTIFICATION.

SO I'D LIKE TO HEAR SOMETHING CONCRETE NOT CONSIDERING.

I, WE WILL CREATE THE SIGN, WE WILL HAVE THE SIGN PRINTED.

WE WILL POST IT AT BOTH ENTRANCES.

I KNOW OF TWO ENTRANCES TO HAZELWOOD.

WE WILL POST THAT MYSELF PERSONALLY WILL GO AND PUT THE DATES OF EACH POUR 48 HOURS BEFORE THAT POURS IS TO BE MADE.

I'LL PERSONALLY DO THAT EVERY TIME.

UM, I WILL REACH BACK OUT TO VERONICA WITH THE HOA AND TO SEE IF SHE CAN SEND OUT AN EMAIL, A BLANKET EMAIL TO ALL OF THE HOMEOWNERS LETTING THEM KNOW THAT AS WELL.

JUST A QUESTION.

YES MA'AM.

I THINK SOMEBODY ASKS WHERE ARE YOU GETTING THE CONCRETE FROM? I MEAN, HOW FAR DISTANCE IS IT? WE HAVE THREE DIFFERENT PLANTS WE'RE GETTING FROM ALAMO, UH, CONCRETE.

WE'RE GETTING IT FROM FIVE STAR CONCRETE AND RANGER READY MIX.

ALL THOSE PLANTS ARE 20 TO 30 MINUTES AWAY FROM WHERE WE'RE AT.

SO I, I JUST HAVE ANOTHER QUESTION FOR STAFF.

DO YOU KNOW, OR DOES ANYONE KNOW IF WE'VE GOTTEN OTHER REPORTS OF, OF THEM STARTING EARLIER? NO.

OKAY.

YEAH, I I'M JUST ASKING IF, IF ANY, IF WE'VE RECEIVED ANY OTHER, UH, REPORTS OF THEM STARTING AT A DIFFERENT TIME.

JUST, JUST TRYING TO DETERMINE BASELINE AND UM, AND I, I COULD GO BACK TO PD CUZ I THINK THEY ACTUALLY TOOK IT AND I COULD FOLLOW UP ON IT, BUT IT WAS THE ONE THAT THE APPLICANT JUST MENTIONED WAS PAST FRIDAY.

UM, UNFORTUNATELY, UM, THE APPLICANT HERE, UM, DANIEL FIRST NAME, YES, I WAS SAYING IT BECAUSE I REMEMBERED .

UM, HE HAD A, UH, A SERIOUS, UM, FAMILY EMERGENCY THEY HAD TO TAKE CARE OF.

SO, UM, HIS STAFF WAS TRYING TO RUN THE JOB, WHICH AS YOU KNOW, SOMETIMES STAFF TRIED TO DO THE BEST THEY CAN AND SO, UM, THERE WAS SOME MISCOMMUNICATIONS ON THAT ONE.

SO I JUST WANTED TO BRING THAT FORWARD.

UM, THAT WAS PART OF A, OUR DUE DILIGENCE OF FINDING OUT KIND OF WHAT HAPPENED THERE.

SO, UM, UH, WE, WE CAN CERTAINLY MAKE SURE THAT THE, THE APPLICANTS ARE ABSOLUTELY NOTIFIED.

I THINK DANIEL IS IS DEFINITELY ON BOARD WITH THAT.

AGAIN, WE MET OUT AT THE PROJECT SITE, WALKED THE PROJECT SITE, TALKED ABOUT THE INS AND OUTS OF WHAT

[00:55:01]

WE COULD DO, WHAT WE CAN'T DO, UM, TO INCLUDE BEING ABLE TO ANSWER YOUR QUESTIONS TODAY.

UM, SO IF HE SEEMS PREPARED IS BECAUSE WE'RE TRYING TO BE PREPARED.

SO, AND THEN IF, IF THEY DO START OUTSIDE THE OF, OF THE APPROVED TIME, WHAT DOES, WHAT, WHAT IS THE RECOURSE ON THAT? UM, WELL I MEAN WE, I I GUESS I CAN STILL GET WITH PD ABOUT SOME KIND OF CITATION.

UM, WHEN I FIRST GET HIM A WARNING.

UM, IT, IT'S A PRIVATE ADVENTURE SO, YOU KNOW, WE CAN, WE CAN GO THROUGH THE, THROUGH THE PROCESS OF A CITATION AND A SECOND ONE AND IT GOES TO COURT.

FROM A LEGAL STANDPOINT, I DON'T, I'D HAVE TO TALK WITH PAIGE AND I'LL GO TO HER ABOUT SHUTTING THE PROJECT SITE DOWN.

BUT THAT HAS TO BE PRETTY, YOU KNOW, SIGNIFICANT.

YOU KNOW, CUZ ONCE YOU START SHUTTING DOWN PROJECT SITES AND THEN YOU'RE STARTING TO GET INTO REAL MONEY, REAL COST AND THEN THAT ESCALATES PRETTY QUICKLY.

SO IT'S NOT EVEN CONSIDERED A CODE VIOLATION? IT IS.

IT IS.

OKAY.

IT IS.

UM, AND IF, IF THEY, IF THEY EXCEED THE SEVEN O'CLOCK IN THE MORNING OR THE OTHER, THE OTHER SIDE, I THINK NINE, 9:00 PM I THINK IT IS.

ALTHOUGH WITH THE SUN GOING DOWN AS EARLY AS IT IS, YOU KNOW, IF YOU HAVE LIGHTS OUT THERE AND YOU'RE WORKING, UM, PAST MUCH PAST FIVE O'CLOCK, YOU'RE GONNA HAVE LIGHTS OUT THERE.

AND GRANTED IT'S NOT EARLY IN THE MORNING WHEN YOU'RE TRYING TO GET YOUR SLEEP.

IT'S, AND LATER IN THE EVENING.

BUT, UM, YOU HAVE TO HAVE THE LIGHTS FOR SAFETY.

UM, WHEN YOU'RE, YOU'RE WORKING AT NIGHT IN A CONSTRUCTION SITE.

IT'S TRICKY CUZ YOU HAVE SHADOWS AND EQUIPMENT AND AGAIN, WHEN YOU'RE PLACING CONCRETE, IT'S A, IT'S A SYMPHONY OUT THERE TO WATCH A GOOD CREW IN MOTION TRYING TO GET THIS CONCRETE PLACED, ESPECIALLY 700 CUBIC YARDS.

THAT'S A LOT OF CONCRETE.

I HAVE A QUESTION FOR YOU.

YES SIR.

SO WHAT IS THE NORMAL WAY OR THE CONSISTENT WAY THAT OTHER CONSTRUCTION COMPANIES NOTIFY RESIDENTS OF THAT 48 HOUR NOTICE OUTSIDE OF PLACING A SIGN, A BLANKET SIGN IN THE FRONT OF THE NEIGHBORHOOD THAT PEOPLE MAY OR MAY NOT SEE? ARE THEY NOT THEMSELVES, NOT DEPENDING ON THE HOA, BUT AS A COMPANY GOING TO THOSE ADDRESSES AND NOTIFYING THOSE RESIDENTS? THEY'RE REALLY USING, WE'VE, WE HAD FEW NOISE VARIANCES AND, AND THEY TAKE, UM, KIND OF DIFFERENT METHODS.

OKAY.

UM, DEPENDING ON WHERE, HOW MANY PEOPLE MIGHT BE AFFECTED.

UM, THE HOMEOWNER'S ASSOCIATION'S ALWAYS THE BEST WAY TO GET INTO BECAUSE THEY WANT TO BE INVOLVED AND THEY USUALLY HAVE THE BEST CONNECTIONS TO THE RESIDENTS AND, AND PLACES TO PUT SIGNS AND, AND FLYERS AND SO FORTH THAT SO PEOPLE KNOW.

UM, SO WORKING WITH THE HOMEOWNER STATION'S ALWAYS, UM, FOR ME PERSONALLY WOULD BE THE, THE BEST FIRST STEP.

HAS THAT BEEN DONE SINCE PEOPLE ARE SAYING THEY HAVEN'T BEEN NOTIFIED? SO I, I HAVE REACHED OUT PERSONALLY TO THE HOMEOWNERS ASSOCIATION OKAY.

AND MADE THEM AWARE I DID NOT GO PUT A BLANKET SIGN OUT MM-HMM.

, BUT ARE YOU AWARE IF THE HOA REACHED OUT TO THOSE RESIDENTS? OH, I'M SORRY.

I'M SORRY.

UH, I AM NOT AWARE IF THEY, IF THE HOA WAS SENT, IF THEY ACTUALLY FOLLOWED THIRD TIME DE DEPENDING ON WHO IT IS IN THE COMPANY, THAT'S, IF ANYTHING, IT WOULD BE AN EMAIL THAT'S LIKE A BLANKET EMAIL'S SENT OUT.

AND SOME REPS ARE, I WORK WITH REPS ALL THE TIME AND SOME REPS ARE MORE, UM, UH, INTENTIONAL, UH, WITH SOME OF THOSE THINGS.

AND NOW, NOW I CAN OFFER, I CAN, ON OUR LETTERHEAD, I CAN CREATE FLYERS IN THE HOUSES THAT ARE AFFECTED ON THE, ALONG THE FENCE LINE.

I CAN GO POST A 48 HOUR NOTICE AT THAT HOME BEFORE EACH OF OUR PORES.

IT HAS ONLY 15 HOUSES.

I MEAN, BACK UP TO YOU.

IT'S NOT A PROBLEM.

I CAN DO THAT.

UM, I WANNA KNOW MORE ABOUT THE CONSTRUCTION TRUCKS GOING THROUGH THE NEIGHBORHOOD.

UH, YES MA'AM.

THAT, THAT OCCURRED THE MONDAY THAT, THAT I, THAT I GOT MY PHONE CALL THAT I HAD TO LEAVE AND GO BACK TO HOUSTON.

UM, I HAVE INSTRUCTED ALL OF MY SUBS, I HAVE CALLED ALL OF THE PROJECT MANAGERS THAT I DEAL WITH FROM ALL MY SUBCONTRACTORS AND TOLD 'EM ABSOLUTELY FOR NO REASON ARE THEY SUPPOSED TO GO INTO THAT NEIGHBORHOOD.

OKAY.

UM, WE ARE POSTING A CONSTRUCTION ENTRANCE SIGN AT RONALD REAGAN AT THE END OF NILES DRIVE, WHICH IS OUR, WE'RE GONNA BE OUR MAIN ENTRANCE INTO BLOCKHOUSE WITH AN ADDRESS THAT'LL BE POSTED OUT THERE.

SO IT'S MORE VISIBLE, THE CONSTRUCTION VEHICLES NOTE NOTED.

THIS IS WHERE YOU GO.

OKAY.

AND IF THEY DON'T FOLLOW IT OR IS THERE ANY PENALTY THAT YOU'RE ASSESSING ON THEM? WE CAN.

OKAY.

UM, I'M SORRY, , I, I'M INCLINED TO BE A LITTLE BIT HARD ON, ON Y'ALL BECAUSE THERE ARE 15 HOMES ON, ON THE STREET AND ONE THIRD OF THEM HAVE WRITTEN INTO US AND SAID, ABSOLUTELY NOT.

I'M AGAINST THIS.

YES, MA'AM.

IN ALL OF MY YEARS ON COUNCIL, I CAN ONLY REMEMBER ONE OTHER INSTANCE WHERE A NOISE VARIANCE WAS REQUESTED THREE TIMES FOR THE SAME PROJECT.

AND IT WAS YOUR SAME COMPANY WHEN Y'ALL WERE WORKING ON HERMOSA VILLAGE? YES, MA'AM.

UM, I WANNA MAKE SURE THAT IF WE'RE GOING TO APPROVE THIS, BECAUSE IT DOESN'T BEHOOVE EITHER OF US NOT TO, RIGHT.

WE DON'T WANNA HAVE AN ABANDONED CONSTRUCTION SITE THAT'S NOT GOOD FOR THE NEIGHBORHOOD NEXT DOOR EITHER.

UM, BUT I DON'T WANT Y'ALL TO COME BACK TO US.

NO, NO OFFENSE.

AND THAT'S, AND, AND THAT IS WHY I APPLIED FOR THE MARCH 31ST DATE.

THAT'S WHY IT'S SO FAR OUT.

I UNDERSTAND THAT'S 90 DAYS AWAY.

[01:00:01]

I APPLIED FOR THAT.

THAT IS GIVEN ANY WEATHER, ANY, UM, CONCRETE SUPPLY ISSUES OR ANYTHING LIKE THAT OKAY.

THAT I CAN GET EVERYTHING DONE AND COMPLETED WITHIN THAT TIMEFRAME.

OKAY.

UM, I LIKE THE REACHING OUT TO THE HOA.

I LIKE THE KNOCKING ON ALL 15 OF THOSE DOORS, POSTING A NOTICE, UM, WHATEVER YOU CAN DO TO COMMUNICATE BECAUSE IT'S UNCOMFORTABLE AND IT'S GONE ON NOW AT THIS POINT FOR QUITE A WHILE.

AND, AND I WILL GO, I'LL, I'LL PERSONALLY GO OVER THERE TOMORROW AND POST MY CARD ON THEIR HOUSES.

THAT WAY IF THEY HAVE ANY ISSUES OR ANY QUESTIONS, MY PHONE'S ON TWENTY FOUR SEVEN.

THEY CAN CALL ME AT ANY TIME.

THANK YOU.

AND, AND YEAH, ABSOLUTELY.

GETTING THOSE TRUCKS NOT THROUGH THE NEIGHBORHOOD, I THINK WE'LL GO A LONG WAY.

UM, SO YOU'RE POSITIVE YOU CAN GET THIS DONE WITH THE MARCH DATE? YES, MA'AM.

OKAY.

MARCH 31ST.

AND ARE YOU WILLING TO START OUT YOUR EARLIER PORES AWAY FROM RESIDENTS? I WILL START MY IS, IT'S, I HAVE CERTAIN SLABS THAT I HAVE TO POUR IN A CERTAIN ORDER.

OKAY.

OR CERTAIN, CERTAIN FOUNDATIONS.

IF I CAN DO THOSE EARLIER MORNING PORES FURTHER AWAY, THEN I WILL DO THAT.

OKAY.

I REMEMBER THAT WAS ONE OF THE THINGS THAT WE ENDED UP DOING ON HERMOSA VILLAGE, UM, WAS WHEN POSSIBLE WE WERE STARTING CLOSER TO THE ROAD THAT WASN'T POPULATED.

YES, MA'AM.

UM, OKAY.

I WILL, I WILL SAY ONE THING ABOUT THAT, CUZ I, I, I DID A SITE VISIT AND, AND WALK THE SITE IS, A LOT OF THE PADS ARE, IF YOU WANNA SAY, PERPENDICULAR TO THE, SO ALMOST OTHER THAN RIGHT NEXT TO THE, SOME OF THEM REALLY CLOSE, WHETHER ONE PAD IS DONE OR ANOTHER FROM A CONSTRUCTION STANDPOINT, IT'S NOT GONNA MAKE THAT MUCH DIFFERENT BECAUSE OF THE CONFIGURATION OF THE SITE IN A NUMBER OF PADS AND KIND OF THE DIRECTION THAT THEY'RE GOING.

SO I, I THINK YOU CAN WORK THAT, BUT I'M JUST POINTING THAT OUT, UM, THAT, THAT THERE, THERE, THERE'S ONLY SO MUCH TO DO.

IT'S ALL GONNA, YOU CAN DO SO MUCH AND THEY'RE ALL GONNA HAVE TO BE PLACED AT SOME POINT OR ANOTHER.

AND THERE'S, LIKE I SAID, ABOUT 13, UM, PADS TO BE PLACED.

OKAY.

COUNSEL, DID YOU HAVE MORE QUESTIONS? SO, I, I JUST WANNA SAY I, YOU KNOW, YOU, YOU'VE KIND OF TOUCHED ON, ON PRETTY MUCH EVERYTHING, MAYOR.

UM, YOU KNOW, WE, WE, WE WANT, WE WANT COMMERCIAL DEVELOPMENT.

AND I MEAN, THIS IS, YOU HAVE TO DO THIS.

THERE'S CERTAIN THINGS YOU HAVE TO DO, AND YET WE'RE TRYING TO DO THE BEST THAT WE CAN FOR OUR CITIZENS AND NOT STOP YOU FROM DOING THE THINGS THAT YOU NEED TO, TO COMPLETE THE CONSTRUCTION.

THAT'S A, THAT'S A BALANCING ACT THAT, UH, WE CAN'T DO.

SO WE'RE TRYING TO WORK WITH ALL SIDES.

I, I THINK, I HOPE EVERYONE RECOGNIZES THAT.

UM, WITH THAT SAID, I, THERE IS NOT A, THERE'S NOT A FUN WAY TO ENDURE CONSTRUCTION IF YOU'RE CLOSE BY IT.

THERE'S NOT A FUN WAY TO ENDURE ANY SORT OF DEBILITATING NOISE OR LIGHTS.

UH, IT, IT'S JUST, IT'S, IT'S TEMPORARY, BUT IT IS NOT FUN.

SO WITH, WITH THAT, COMING FROM SOMEONE THAT HAS, HAS BEEN THROUGH A SITUATION WHERE, UM, SLEEPING WAS IMPOSSIBLE.

I, I, I, THIS MAY SOUND TRIVIAL, BUT I DISCOVERED THE MOST AMAZING EARPLUGS, AND I'M TELLING YOU, IT WAS LIFE ALTERING AND A, A, A SLEEP MASK AND AN EYE PILLOW WHEN THOSE TUBS COME AND THEY ARE AWARE THAT THAT'S HAPPENING, THAT THAT'S ALL THAT'S NEEDED.

I THINK IF THEY JUST KNOW WHEN IT'S GONNA HAPPEN, THEN YOU'RE SET FOR THE NIGHT AND, AND PEOPLE DON'T LOSE SLEEP.

AND I, I THINK THAT'S ALL THAT ANYBODY'S ASKING FOR.

SO IF, IF WE CAN COMPLY AND WORK, WORK TOGETHER, I THINK IT SOUNDS LIKE YOU'RE WILLING TO.

UM, YES, MA'AM.

I, I THINK WE CAN FIGURE THIS OUT.

SO THANK YOU.

I'M GONNA MAKE A MOTION THAT WE APPROVE WITH 48 HOUR POSTED NOTICE TO THE NEIGHBORHOOD, A NOTICE ON EACH OF THE 15 HOUSES ON BOWEN THAT BACKS UP 48 HOURS.

UM, AND I WOULD LIKE TO SEE OH, AND THE NOTICE TO THE HOA, AND I WOULD LIKE TO SEE, UH, COUNSEL NOTIFIED EVERY TIME CODE ENFORCEMENT GIVES A VIOLATION SO THAT WE HAVE THE OPPORTUNITY TO BRING THIS BACK FOR RECONSIDERATION.

AM I ABLE TO DO THAT? WELL, IF THEY GET A CODE ENFORCEMENT VIOLATION, WOULD WE BE ABLE TO THAT'S, SORRY.

OKAY.

WHILE THEY'RE DOING THAT, CAN I ASK A QUESTION? SO YOU'RE ASKING FOR THREE? YES, SIR.

I MEAN, THAT'S PRETTY MUCH IN THE MIDDLE OF THE NIGHT.

YES, SIR.

YOU KNOW, 5:00 AM THAT'S KIND OF CLOSER TO THE MORNING.

WHAT IS THE DIFFERENCE? DOES DOES AN HOUR OR TWO MAKE WHEN I'M ASKING FOR THREE, MY CONCRETE PUMP NEEDS TO GET IN AN HOUR BEFORE MY CONCRETE GETS THERE TO GET IN, SET UP, GET COMPLETELY UNFOLDED, IS OUTRIGGERS OUT, AND THEN MY CONCRETE STARTS SHOWING UP BETWEEN FOUR AND FOUR 50.

IF I GO BRING MY PUMP IN AT

[01:05:01]

FOUR, I'M PUSHING EVERYTHING BACK AN HOUR TO HOUR AND A HALF.

I GET INTO THAT TRAFFIC IN MY BATCH TIMES WHERE I'M HAVING ISSUES.

OKAY.

COUNSEL, WERE THERE MORE QUESTIONS? NO.

OKAY.

SORRY.

WE'RE JUST WAITING ON OUR ATTORNEY THEN TO LET US KNOW.

I MEAN, I WOULD SAY WHAT IF EVEN RATHER THAN OKAY, SHE SAYS WE CAN, SO IF THEY GET A CODE VIOLATION, WE CAN BRING THIS BACK AND WITHDRAW.

OKAY.

TO RECONSIDER.

OKAY.

SO WOULD, WOULD THAT REQUIRE, I'M SORRY.

WOULD THAT REQUIRE A RESUBMITTAL FOR A DIFFERENT TIME OR IT WOULD JUST DEFAULT TO SEVEN O'CLOCK AND THEN IF WE RESCINDED IT, IT WOULD JUST DEFAULT TO SEVEN MM-HMM.

RIGHT PAGE.

OKAY.

SO WHY DON'T BE SPECIFIC ON THAT.

UH, BECAUSE I'VE, I'VE WORKED CONSTRUCTION FOR 35 YEARS AND MM-HMM.

, THERE'S A LOT OF THINGS YOU CAN'T CONTROL MM-HMM.

.

AND SO THE CODE VIOLATION YOU'RE LOOKING FOR IS SPECIFIC TO THE 48 HOUR NOTICE.

IT'S BECAUSE THE TIME VIOLATIONS RELATED TO YOU'RE TALKING MAYBE 10 OR 15 MINUTES OR SOMETHING LIKE THAT, OR PEOPLE'S PERCEPTION OR, YOU KNOW, IF WE DON'T HAVE CODE ENFORCEMENT OUT THERE DEAD ON, THEN THAT GETS A LITTLE TRICKY.

WELL, LET ME SAY WHAT I'M NOT ASKING FOR AN AUTOMATIC RESIN.

IF THEY GET A CODE VIOLATION, I'M SAYING COUNSEL GETS NOTIFIED AND WE HAVE THE OPTION OF BRINGING IT UP HERE.

WHAT I DON'T WANNA DO IS APPROVE THIS AND THEN FIND OUT THAT THROUGH THIS TIMEFRAME THERE'S MORE 2:00 AM PORES, THERE'S MORE GOING THROUGH THE NEIGHBORHOOD.

YOU KNOW, ONE HERE, ONE THERE, THINGS HAPPEN AND I'M SURE ALL OF US UNDERSTAND THAT.

UM, I DON'T WANNA SEE A PATTERN.

OKAY.

I, I, I, I GET YEAH, WHERE YOU'RE GOING.

SO WE WILL, AND I FEEL LIKE THIS GIVES US THE LEVER WHERE IT MAKES IT EASIER FOR YOU TO SAY TO YOUR CONTRACTORS, YOUR SUBCONTRACTORS, YOU HAVE TO DO THIS BECAUSE THERE ARE REAL WORLD PENALTIES TO THIS JOB SITE FOR THIS.

AND I DON'T KNOW THAT WE NECESSARILY HAVE VERY MANY LEVERS OTHERWISE.

OKAY.

YEAH.

CUZ I JUST WANT TO, YOU KNOW, BE CAREFUL, KIND OF CAREFUL WITH THAT.

BECAUSE, YOU KNOW, IT'S, WITH, WITH CONTRACTING INSTRUCTION, WE, WE HAVE A PROCESS AND WHAT WE HAVE TO DO IS SECURE NOTICE.

SO FIRST THEY GET A VERBAL MM-HMM.

, AND THEN THEY GET A LETTER NORMALLY, WHICH IS CALLED A CURE NOTICE THAT SAYS YOU HAVE 30 DAYS TO FIX THE, AND THEN IF THEY DO IT AGAIN, THEN UM, USUALLY WE, WE DO SOMETHING HARDER.

UM, AND THAT COULD BE, UM, HOLDING POTENTIAL FUNDS OR, OR ALLOWING THEM DIFFERENT HOURS OF OPERATION.

AND, AND I CAN WORK WITH PAIGE SPECIFICALLY, BUT I DON'T WANT TO, I WANT, UH, UH, LIKE I SAID, CONSTRUCTION IS A LOT OF CONTRACTUAL AND STUFF, SO NORMALLY THERE'S A, A FEW STEPS BEFORE YOU GET TO THE, YOU KNOW, UM, KIND OF THING.

SO YEAH.

UM, THIS, THIS AS A REMINDER, UM, KIND OF THAT, THAT PROCESS.

THANK YOU.

NOW, I'M SORRY, MR. PLACE.

FIVE.

OKAY.

I REACH OUT TO THE HOA NOW IF THAT HOA REPRESENTATIVE DECIDES NOT TO REACH OUT TO THE RESIDENCE, NOT YOUR FAULT.

OKAY.

NO, ABSOLUTELY.

COUNSEL, DOES ANYBODY WANT A SECOND OR DO WE WANNA DROP IT AND START OVER ALL? ARE YOU, ARE YOU ALL RIGHT WITH THAT? YEAH, I HAVE NO PROBLEM.

I'LL MAKE SURE THAT THEN LET'S MOVE ON.

48 HOURS.

OKAY.

I'LL SECOND.

ONE SECOND.

YEAH.

MOTION TO SECOND.

IS THERE FURTHER DISCUSSION? ALL THOSE IN FAVOR? OPPOSED PASSES.

SIX TO ONE.

THANK YOU.

THANK YOU.

[28. Conduct a Public Hearing regarding Zoning Case Z-22-0025 to amend the current zoning of Interim SFR-1-B (Single-Family Rural) to SFS-2-B (Single-Family Suburban) on one (1) parcel of land approximately 21.599 acres ± in size, more particularly described by Williamson Central Appraisal District parcel R031560; and more commonly known as 800 CR 177, Leander, Williamson County, Texas. Discuss and consider action regarding Zoning Case Z-22-0025 as described above.]

ITEM 28, CONDUCT A PUBLIC HEARING REGARDING ZONING CASE Z 2,225 TO AMEND THE CURRENT ZONING OF INTERIM SFR ONE B, SINGLE FAMILY RURAL TO SFS TWO B, SINGLE FAMILY SUBURBAN ON ONE PARCEL OF LAND, APPROXIMATELY 21.599 ACRES, PLUS OR MINUS IN SIZE, AS STATED ON THE POSTED AGENDA.

EXECUTIVE DIRECTOR OF DEVELOPMENT SERVICES, GRIFFIN.

GOOD EVENING.

GOOD EVENING.

UM, THIS IS, UH, A PUBLIC HEARING FOR A ZONING CASE FOR THE PROPERTY LOCATED AT 800 CR 1 77.

UM, THE APPLICANT IS REQUESTING TO REZONE THE PROPERTY TO SFS TWO B.

THIS IS A SINGLE FAMILY SUBURBAN DISTRICT THAT ALLOWS FOR, UM, 70 FOOT WIDE LOTS.

THE APPLICANT DID START WITH A PROJECT THAT INCLUDED TOWNHOUSES AS WELL AS, UM, SINGLE FAMILY COMPACT LOTS.

UM, BASED ON THE COUNCIL'S RESOLUTION, THEY HAVE AMENDED THEIR REQUEST TO REDUCE, UH, THE SIZE OF THE LOTS.

UM, THIS WAS REVIEWED BY THE PLANNING AND ZONING COMMISSION DURING THEIR MEETING, UM, ON NOVEMBER 22ND.

AND THEY DID RECOMMEND APPROVAL OF THE REQUEST.

I'LL BE GLAD TO ANSWER ANY QUESTIONS AFTER THE PUBLIC HEARING.

AND THEN THE APPLICANTS ALSO HERE TO MAKE A PRESENTATION.

THANK YOU.

[01:10:05]

THAT'S THE ZOOM AND THAT'S AGAIN.

GOTCHA.

GOTCHA.

GOOD EVENING, COUNSEL.

MAYOR, UM, PRO 10.

THANK YOU FOR ALLOWING US TO BE HERE TONIGHT.

UH, THIS IS THE LONE STAR LANDING PROJECT, WHICH I KNOW YOU'VE ALL BEEN BRIEFED ON ON CR 1 77.

THE, UH, OUTLINED SECTION THERE.

THERE'S A TOTAL OF, UM, OF 33 ACRES, UH, 37 ACRES, I'M SORRY.

AND, UM, IT'S EAST OF THE LARO TACTICAL, UM, LOT, WHICH IS THE, THE PART THAT'S RIGHT THERE TO THE WEST OF THE PROPERTY.

UH, THE ZONING REQUEST IS JUST FOR THE PHASE ONE, WHICH IS ONLY 21.6 ACRES.

IT'S, UH, IT'S BASED ON THE COUNCIL'S RECENT RESOLUTION TO PRIORITIZE LOW DENSITY RESIDENTIAL.

UM, THE OWNER ACTUALLY WITHDREW THE APPLICATION FOR TOWN HOMES AND SINGLE, SINGLE FAMILY COMPACT TO INCLUDE LARGE LOT RESIDENTIAL ONLY.

NOW I UNDERSTAND THERE WAS SOME STAFF MEMBERS THAT WERE, UH, UM, UPSET THAT MY PRESENTATION WAS TOO SHORT, SO I CAN MAKE THIS LONGER IF I NEED TO.

JUST SO Y'ALL KNOW, , UM, THE EXTENSION TO CRYSTAL FALLS PARKWAY WILL ALSO BE ADDRESSED IN THE FUTURE PHASES OF DEVELOPMENT.

THIS IS A, A MAJOR CONCERN WITH EVERYBODY, THE DEVELOPER AS WELL.

1 77 IS A TWO-LANE RESTRICTED ACCESS ROAD THAT ALREADY IS GETTING CUT THROUGH TRAFFIC.

WE ARE AWARE OF THAT.

UH, THIS IS PART OF THE PROCESS, UH, TO BUILD, UH, THE CRYSTAL FALLS EXTENSION.

THE CITY, AS I BELIEVE IS PURCHASED THE, UH, PROPERTY AT THE FRONT AT, UH, WHERE, WHERE IT COMES IN AT CRYSTAL FALLS.

AND, UM, UH, ONE EIGHT, LET'S SEE RIGHT THERE, I GUESS, DOWN HERE IN THIS AREA.

AND, UH, AND THEN THERE'S MORE DEVELOPMENT DOWN BY TOLL BROTHERS TOWARD THE, UM, TOWARD THE CREEK.

SO WE'VE GOT THE BEGINNING AND THE END OF CRYSTAL FALLS EXTENSION.

THIS IS ONE OF THE FIRST SECTIONS IN THE MIDDLE THAT WILL BE ADDRESSED, UM, AT A LATER TIME AS WELL.

UH, DEVELOPER AGAIN CHANGED THE DESIGN TO MEET WITH THE NEW COUNCIL INITIATIVE.

IT IS LOW DENSITY.

THE PHASING IS ACTUALLY IN TWO SECTIONS.

IT COMPLIES WITH NOT ONLY THE FUTURE LAND USE, BUT ALSO THE FUTURE, UM, COUNCIL RESOLUTION AND THE COMPOSITE ZONING ORDINANCE.

UM, ONE OF THE OTHER THINGS THAT CAME UP THAT I WANTED TO TOUCH ON REAL QUICK IS THE WATER LINE.

SO THE OTHER BENEFIT FOR THE CITY IS THIS WAS GONNA BE DRAWING THE WATER LINE ALL THE WAY FROM THE CREEK AREA ALL THE WAY UP 1 77.

AND, UH, GIVES US TO THE LIMITS.

AND THIS IS THE PROPOSED PROPERTY HERE.

SO IT DOES, IT DOES INCREASE, UM, THAT WATER LINE AND WATER CAPACITY AS WELL.

AND I HAVE A QUICK, UM, EMAIL THAT, UH, UH, MS. CRABTREE HAS THAT SHE'LL PASS DOWN.

IT'S, UH, I'M GETTING OLD, SORRY.

UM, IT'S FROM, UH, IT'S TITLED LONE STAR LANDING, PROPOSED CRYSTAL FALLS EXTENSIONS FROM MARK LARUE ALL, UH, MY NAME IS MARK LARUE.

I OWN THE PROPERTY TO THE WEST OF THE PROPOSED LONE STAR LANDING SUBDIVISION.

I'VE MET WITH THE DEVELOPER IN PERSON ON THE PROPERTY, AS WELL AS THE MAYOR IN PROTE.

LET ME REFERENCE THE PROTE.

THEY'S SPEAKING OF IS, UM, WAS BECKY AT THE TIME, BECKY ROSS.

AND, UH, ALL MY PROPERTY DISCUSSED THE ALIGNMENT OF THE FUTURE CRYSTAL FALLS EXTENSION, AS WELL AS A LONE STAR LANDING PROJECT.

OVERALL, I'M IN FULL SUPPORT OF THE LONE STAR LANDING PROJECT.

LOOK FORWARD TO WORKING WITH THE DEVELOPER IN THE CITY OF LEANDER ON EXTENDING THE CRYSTAL FALLS PARKWAY AND SIGNED MARLAR LAUX TACTICAL.

UM, AND I'LL JUST MAKE THE COMMENT THAT, UH, THE MAYOR AND AND MS. ROSS WERE, UM, QUITE THE TROOPERS.

IT'S KIND OF MUDDY AND, UH, IT'S A FIELD OUT THERE BEHIND THE PROPERTY.

AND THEY HAD ON HEELS AND, UH, MARK DRUG 'EM OUT THERE IN THE BACK AND WALKED THEM AROUND AND, UH, SO IT WAS ALL KINDS OF, UH, UH, GOOD STUFF, BUT THEY'VE ACTUALLY BEEN OUT TO THE PROPERTY LINE AND SEEN IT AND KNOW WHERE WE'RE TALKING ABOUT.

UM, WE'LL BE HERE FOR QUESTIONS, UH, AFTER THE, UH, PUBLIC HEARING.

I THINK THE ONLY OTHER REQUEST THAT I HAD WAS THE NUMBER OF UNITS.

IT'S, UM, IT'S A LITTLE OVER THREE, RIGHT? AT THREE PER ACRE.

IT'S 67 TOTAL FOR THE 21 ACRES.

THANK YOU.

THANK YOU.

THE PUBLIC HEARING IS NOW OPEN.

I WILL CALL ON SPEAKERS WHO SUBMITTED CARTS.

FIRST UP IS JOSH FREEMAN.

GOOD EVENING.

PLEASE GIVE YOUR NAME AND ADDRESS.

YOU'LL HAVE THREE MINUTES.

THANK YOU.

MY NAME'S JOSH FREEMAN.

I LIVE AT 1 0 7 VALLEYVIEW DRIVE EAST.

UM, FIRST OF ALL, I'D LIKE TO THANK YOU FOR YOUR SERVICE.

UM, WE TALKED ABOUT DECISIONS A LITTLE BIT EARLIER IN THE NIGHT AND HOW YOU GUYS HAVE TO MAKE VERY HARD DECISIONS ABOUT THE, THE FABRIC OF THIS CITY.

UM, I THINK THIS IS GONNA CHANGE THE FABRIC OF THIS LANDSCAPE.

UM, I ALWAYS FIND THE, THE, THE, THE SYMBOL FOR, FOR THE LEANDER CITY.

INTERESTING.

IT'S A, A FEW GREEN HILLS, A CREEK REFERENCE TO WATER, AND ALSO TEXAS STAR.

I THINK.

UM, I'M VERY BLESSED BECAUSE I LIVE ON A CREEK.

I LIVE ON BRUSHY CREEK, ACTUALLY IN THIS AREA.

AND I THINK THIS IS GONNA BE A THREAT TO THIS AREA BECAUSE THE, THE LEVEL OF DENSITY WE'RE PUTTING IN HERE.

SO MY CONCERN AND MY FAMILY'S CONCERN IS WE ALREADY HAVE WATER RESTRICTIONS

[01:15:01]

AREA, SO WE'RE GONNA ADD 67 HOUSES IN AN AREA WHERE WE, WE CAN'T GET IT.

UM, WE ALSO HAVE WASTEWATER ISSUES WITH THE TOWN THAT AFFECT THIS AREA, THAT HAVE BEEN AFFECTING THIS AREA.

SO THE PEOPLE WHO CAN'T GET WATER USE THEIR WELLS, AND NOW THEY'RE NOT ABLE BELIEVE THEIR WELLS AT CERTAIN PERIODS BECAUSE WE HAVE ISSUES WITH WASTEWATER MANAGEMENT IN THE CITY.

SO I THINK, I THINK THERE'S A CONCERN HERE THAT GOES BEYOND A, A LOT OF, A LOT OF THINGS.

I COULD TALK ABOUT WILDLIFE, I COULD TALK ABOUT OTHER THINGS WHEN I'M CONCERNED ABOUT PRIMARILY IS SAFETY AND THE INFRASTRUCTURE TO SUPPORT IT.

I'M GLAD THAT YOU WENT OUT THROUGH THE SITE.

I'M SURE YOU ALSO SAW COUNTY ROAD 1 77.

I WALK MY DOG ON IT EVERY DAY, BUT YOU CAN'T ACTUALLY WALK IN THE ROAD BECAUSE THERE'S NO SHOULDERS.

UM, I ACTUALLY DO PICK UP THE LITTER ON THE ROAD TOO, UH, EVERY DAY AS WELL BECAUSE THE, THE ROAD TENDS TO BE A MESS BECAUSE OF ALL THE, THE PAST ROUTE TRAFFIC THAT WAS REFERRED TO EARLIER.

UM, I'D LIKE US TO GET TO THE SAFETY THERE FOR THAT ROAD FOR TRANSPORTATION, UH, FOR THE SCHOOL BUSES AFTER GO DOWN THE ROUTE.

IT'S GONNA BE VERY DIFFICULT FOR LARGE VEHICLES.

THE PASS ONE THERE.

UM, YOU'LL SEE WE'VE HAD SEVERAL ISSUES ON THAT STREET AND, AND SEVERAL ISSUES ALSO ON THE BRIDGE THAT'S DOWN THE ROAD.

UM, LAST BUT NOT LEAST, I'D JUST LIKE TO TO SAY, UM, I, I THINK WE JUST SEE THIS AS A, A, A THREAT TO, TO AN OPPORTUNITY TO MAINTAIN SOME LEVEL OF GREEN SPACE OR SOME LEVEL OF, OF WHAT THIS IS ORIGINALLY ZONED FOR.

UM, I FIND IT IRONIC THAT THE, IN THE NEXT DOOR, THAT THAT'S A FIRING RANGE.

SO I'M, I'M KIND OF INTERESTED IN WHY PEOPLE WOULD WANNA BUY HOUSES RIGHT NEXT TO A FIRING RANGE.

I HEAR THAT THAT RANGE IN THE DAY, AND I'M, I'M ABOUT A HALF A MILE FROM THAT SPACE.

SO I THINK PEOPLE WHEN THEY MOVE IN WILL BE SURPRISED ABOUT THAT SUPPORT.

CAUSE THAT'S A LITTLE ODD, ODD FOR ME.

AND, AND I, I WOULD SAY LAST THING WAS, I'D JUST LIKE YOU TO CONSIDER, YOU HAVE TO MAKE A HARD DECISION HERE.

I'D LIKE TO CONSIDER THAT ALL OF OUR TAXES HAVE GONE UP TREMENDOUSLY.

WE'RE NOT SEEING IMPROVEMENTS IN QUALITY OF LIFE.

AND THIS IS GONNA REPRESENT, I KNOW MORE TAX BASES FOR THE CITY, BUT IT'S A DETERIORATION OF QUALITY OF LIFE, THOSE PEOPLE THAT ACTUALLY LIVE THERE.

THANK YOU FOR THE TIME, I APPRECIATE IT.

THANK YOU.

ALEXANDRA LANGMAN.

GOOD EVENING LADIES AND GENTLEMEN.

THANK YOU FOR YOUR TIME TONIGHT.

PLEASE GIVE YOUR NAME AND ADDRESS HERE.

THREE MINUTES.

ALEXANDRA LOG, MANSON 1 0 1 VALLEY VIEW DRIVE, UM, LE UH, EAST LEANDER.

SO FOR THE RECORD, I AND MY NEIGHBOR WHO ARE LESS THAN 50 FEET FROM THE SUBJECT PROPERTY, HAVE YET TO BE CONTACTED BY THE DEVELOPERS.

WE BOTH VOICED OUR CONCERN ABOUT THIS MATTER AT THE PLANNING AND ZONING COMMISSION WITH NO RESPONSE.

SO STILL WE HAVE 50 FEET, WE ARE LESS THAN 50 FEET FROM THIS SUBJECT PROPERTY.

NO CONTACT WHATSOEVER.

OKAY, I THINK I CAN SPEAK FOR ALL OF MY NEIGHBORS WHEN I SAY THAT WE UNDERSTAND PROGRESS AND WELCOME THE GROWTH OF OUR COMMUNITY.

WE HAVE NO DESIRE TO STAND THE WAY OF THE INEVITABLE DEVELOPMENT OF THE SUBJECT PROPERTY AND WELCOME OUR SOON TO BE NEIGHBORS.

THAT BEING SAID, THE TIMING IS WHAT HAS US A BIT PERPLEXED.

IN ESSENCE, WE ARE ASKING FOR TWO THINGS.

ONE, THAT THE CITY TAKE INTO CONSIDERATION THAT THIS BEAUTIFUL LITTLE BIT OF LEANDER CONSISTS OF, USUALLY A MINIMUM OF THREE ACRES PER HOME.

WE BELIEVE THAT KEEPING WITH THE AREA'S LOT SIZE CONFORMS WITH OUR SMALL NEIGHBORHOOD.

AND SECONDLY, THAT IS TO CONSIDER THE CURRENT IMPACT OF SO MUCH CONSTRUCTION AND RESIDENTIAL TRAFFIC.

HITTING 1 77 IS PUTTING THE HORSE BEFORE THE CART.

COUNTY ROAD 1 77 IS THE ONLY ROAD A LARGE NUMBER OF US HAVE TO EXIT OUR HOMES WHERE 1 77 EXIT TO RONALD REAGAN.

IT IS NO LESS THAN 700 FEET FROM THE LIGHT AT CRYSTAL FALLS.

THE TRAFFIC IS OFTEN BACKED UP TREMENDOUSLY, ALL THE WAY DOWN TO JOURNEY PARKWAY DA.

IT IS A STRUGGLE TO NOT ONLY GET OUT OF OUR ONE STREET NEIGHBORHOOD, BUT TO GET ONTO RONALD REAGAN TO TAKE OUR CHILDREN TO SCHOOL AT THE CURRENT CAPACITY.

IT'S TIGHT PASSING THE NUMEROUS SCHOOL BUSES ON 1 77 ALREADY.

I COULD ONLY IMAGINE THE SCHOOL BUSE IS HAVING TO SQUEEZE BY WHILE THIS DEVELOPER IS LAYING THE WATER LINE SUPPOSED TO RUN.

THE LENGTH OF THE PROPERTY NOW FACTOR IN THE HUNDREDS OF HOMES CURRENTLY UNDER CONSTRUCTION.

TOLD BROTHERS, FOR EXAMPLE, THAT WILL FEED ONTO 1 77 DUE TO THE LACK OF LIGHTS ON 2243.

AND NO OTHER DIRECT ROUTE TO CRYSTAL FALLS.

TRAFFIC WILL BE TO STANDSTILL AS IT VERY OFTEN ALREADY IS.

WE HUMBLY ASK THE CITY TO RECONSIDER HOW QUICKLY THIS NEW ADDITION TO AN ALREADY BURDENED ROAD CAN PROGRESS.

THE CRYSTAL FALLS EXTENSION IS ON THE GO FOR THE NEAR FUTURE, AND FRANKLY, THIS AREA CANNOT HANDLE ANY MORE TRAFFIC THAT IS ALREADY PROPOSED TO OCCUR IN THE NEXT FEW YEARS.

THIS ROAD IS BELOVED BY MANY A MOTORCYCLISTS, MOTORCYCLISTS, WALKERS, WILDLIFE, AND NOT TO MENTION THE SWEET WILD TURKEY IN HER BABIES.

JUST THE OTHER DAY I WATCHED A LINE OF VERY CONSCIENTIOUS MOTORCYCLIST TAKING A LEISURELY RIDE DOWN THIS BEAUTIFUL TREE LINED WAY.

IT'S WHAT DRAWS PEOPLE TO THIS AREA, THIS LITTLE BIT OF COUNTRY ON THE OUTSKIRT TO THE BIG CITY OF AUSTIN.

THANK YOU FOR YOUR TIME, YOUR HARD WORK AND SERVICE TO OUR COMMUNITY.

UM, I ALSO, I HAVE EMAILED, I BELIEVE I EMAILED YOU ,

[01:20:01]

UM, A VIDEO THAT SHOWS JUST THE INSANE BACKUP THAT WE'RE DEALING WITH.

AND ONCE AGAIN, I, I MEAN WE, WE HAVE NO OTHER WAY TO GET OUT OF OUR NEIGHBORHOOD.

THANK YOU.

THANK YOU ABRAHAM GUPA.

GOOD EVENING.

PLEASE GIVE YOUR NAME AND ADDRESS.

YOU HAVE THREE MINUTES.

HI.

GOOD EVENING, COUNSEL.

MY NAME IS ABI ABRAHAM GUPA.

MY ADDRESS IS 51 COUNTY ROAD 2 64 LEANDER.

UH, I JUST WANTED TO MENTION, I I OWN THE CORNER PROPERTY ON THE CORNER, SO I SUPPORT THE WATER LINES AND THE SEWER LINES THAT YOU PLAN TO DO THERE.

AND I ALSO WANT TO REQUEST THE COUNCIL TO ADD MORE INFRASTRUCTURE FOR CITY OF LEANDER, ESPECIALLY ON RONALD REAGAN PARKWAY.

UM, WE, WE, WE NEED THE INFRASTRUCTURE TO BUILD THE PROJECTS THAT WE WANT AND TO MAKE OUR CITY A GREAT CITY.

SO THANK YOU.

THANK YOU CHANDRA RI PLEASE GIVE YOUR NAME AND ADDRESS.

YOU HAVE THREE MINUTES.

GOOD EVENING COUNCIL.

MY NAME IS CHANDRA ALURE.

UH, I WANT THE PROPERTY NEXT TO THE MR. ABK WHO SPOKE, UH, JUST EARLIER.

I DO SUPPORT THE WATERLINE AND AS WELL AS THE SEWER LINES.

UH, I STAND BY WHAT WE SAID.

UH, THAT'S PRETTY MUCH IT.

THANK YOU.

THANK YOU FOR ALL YOUR SERVICES.

THANK YOU.

I DO NOT HAVE ANYBODY ELSE SIGNED UP TO SPEAK.

WAS THERE ANYBODY WHO WISHED TO SPEAK? PLEASE COME UP, GIVE YOUR NAME AND ADDRESS.

YOU HAVE THREE MINUTES AND THEN YOU'LL NEED TO FILL OUT A COMMENT CARD WITH THE CITY SECRETARY.

HI.

YEAH.

HI, MY NAME'S MARCUS LOG MANSON AT, UH, 1 0 1 VALLEY VIEW DRIVE EAST, UM, ON, UH, THAT BUTS TO 1 77 ACROSS THE PROPERTY, ACROSS THE STREET FROM THIS PROPERTY.

THERE'S A COUPLE THINGS THAT I JUST, YOU KNOW, I'M A LITTLE BIT CONCERNED ABOUT.

I UNDERSTAND DEVELOP DEVELOPMENT THAT'S NECESSARY FOR THE COMMUNITY.

AND, AND THE IMPACT FOR ME THAT I THINK ABOUT IS THE BREWS GUN RANGE IS RIGHT THERE.

AND WE BOUGHT OUR PROPERTY KNOWING THAT FULL WELL.

SO THERE'S NOT AN ISSUE AT THAT, BUT THERE'S ALSO A LOT OF GREEN COVER RIGHT THERE.

2 1 77, THAT BUFFER, THAT SOUND, RIGHT? SO THAT'S ONE, ONE CONCERNS LIKE HAVING A LITTLE BUFFER ZONE 2, 1 77, NO MATTER WHAT HAPPENS BECAUSE THE SOUND, YOU KNOW, THEY TEST EVERY RIFLE THAT THEY MAKE THERE AND THEY MAKE THE BEST.

UM, SO THERE'S THREE ROUNDS FROM EVERY RIFLE.

SO WE ALL DAY LONG, MONDAY THROUGH FRIDAY STARTS AT LIKE 8:00 AM AND UM, I THINK THAT'S ONE THING.

THE OTHER THING IS THAT, UM, THAT ROAD, YOU GUYS MAY REMEMBER THE, UH, SCHOOL BUS THAT, UM, FELL OFF THAT ROAD RIGHT THERE.

SO THAT WAS, THAT FLOATED INTO OUR PROPERTY THERE.

WE OWN THE PROPERTY ALL THE WAY DOWN TO THE, THE CROSSING.

IT'S NOT THE FIRST VEHICLE.

THERE'S A LOT OF VEHICLES HAVE, HAVE MADE IT THROUGH THERE BECAUSE THEY JUST FRANKLY DRIVE TOO FAST, UH, FOR WHAT THAT LITTLE ROAD CAN HANDLE.

IT'S A BEAUTIFUL DRIVE, AS YOU ALL KNOW.

IT'S INCREDIBLE TO DRIVE DOWN THAT WAY.

UH, AND PEOPLE ENJOY IT, BUT THERE'S A LOT OF PEOPLE GOING WAY TOO FAST, INCLUDING A LOT OF BIG TRUCKS, HEAVY EQUIPMENT COMING THROUGH.

EVEN THOUGH IT'S RESTRICTED FROM TRUCKS COMPLETELY, YOU'RE NOT ALLOWED TO GO DOWN THAT WAY.

AND IT HAPPENS ALL THE TIME.

UM, COMING UP THERE SAYS WE OUR KITCHEN WINDOWS RIGHT TOO.

SO WE SEE EVERYBODY COMES BY, YOU KNOW, THAT POSE AN ISSUE WITH UM, UM, EMERGENCY VEHICLES COMING IN THERE BECAUSE OF THAT VERY NARROW ROAD.

YOU OFTEN, WHEN YOU, AT LEAST WHEN YOU GO DOWN THE HILL, YOU HAVE TO PULL OFF TO THE SIDE TO LET ANOTHER VEHICLE COME BY.

IT'S THAT TIGHT.

UH, AND THAT'S NOT THE BRIDGE I'M TALKING ABOUT.

THAT'S A SINGLE LANE WITHOUT ANY GUARDRAILS.

AND OF COURSE IF THERE'S CONSTRUCTION, THERE'S, THEY'RE GONNA TAKE, YOU KNOW, THEY'RE GONNA GO THROUGH THAT BRIDGE, THEY'RE GONNA TRY TO DO IT CUZ NOBODY WANTS TO GO AROUND JOURNEY, YOU KNOW, .

SO THOSE ARE THE TWO THINGS, UM, THAT THAT I'D LIKE YOU GUYS TO KEEP IN MIND AS, UH, THE BUFFER SPACE THERE, UM, FOR SOUND.

UM, WE KNOW IT'S THERE, BUT IT COULD BE A LOT LOUDER IF, IF IT'S CLEARED, YOU KNOW.

UM, AND ALSO OF COURSE, I, I SUPPORT A LITTLE BIT LARGER LOTS, UM, UM, IN THE VALUE OF STATES.

THEY'RE THERE THREE TO SIX ACRE LOCKS AND I THINK THAT WOULD BE APPROPRIATE.

THANK YOU FOR YOUR TIME.

YEP, THANK YOU.

WAS THERE ANYBODY ELSE WHO WISH TO SPEAK? OKAY, THE PUBLIC HEARING IS NOW CLOSED.

WE'LL NOW DISCUSS A CONSIDER ACTION REGARDING ZONING CASE Z 20 2025 AS DESCRIBED PREVIOUSLY.

COUNSEL, I KNOW IT ASKED, UH, YESTERDAY WHERE WE MET, DID WE EVER GET THE INFORMATION BACK ON A TRAFFIC IMPACT, UH,

[01:25:01]

ANALYSIS OVER THERE? HELLO, EMILY TRUMAN, CITY ENGINEER.

UM, YES WE DID.

UM, THE MASON TRACK, WHICH IS ALSO CALLED WILD SPRING, DID SUBMIT A TRAFFIC IMPACT ANALYSIS.

UM, THEY ARE, AS PART OF THEIR FIRST PHASE OF DEVELOPMENT, THEY'RE GONNA BE DOING IMPROVEMENTS ON COUNTY ROAD 1 75.

UM, FOR THEIR ENTRANCES.

THEY'RE NOT TAKING ACCESS OFF COUNTY ROAD 1 77.

UM, THEY DO HAVE, UH, SOME INTERSECTION IMPROVEMENT, UM, UH, I GUESS PROPOSED, BUT IT WOULDN'T BE UNTIL PHASE THREE OF THEIR DEVELOPMENT, WHICH WOULD BE MORE LIKE 20 25, 20 27, WHICH IS ALSO IN CONCURRENT WITH WHEN WE PLAN TO DO THE CRYSTAL FALLS, UM, ROAD AS WELL.

SO WE WOULD START DESIGN IN 2025 AND UM, START CONSTRUCTION IN 2027.

OKAY.

JUST A QUESTION I THINK FOR DAN OR ARE YOU, SO VALLEY VIEW DOESN'T HAVE ANY FIRE HYDRANTS AS IT STANDS RIGHT NOW WERE ALL THIS NEW DEVELOPMENT HAVE FIRE HYDRANTS CUZ RIGHT.

WITH THE WATERLINE EXTENSION.

SO THERE'S NONE IN THE VALLEY VIEW AREA.

THAT'S WHAT, YEAH.

OKAY, SO THIS MAY BE BRING MORE FIRE HYDRANTS.

YEAH, THERE'S, THERE'S, THERE'S, AS I SAY, THERE'S NOT A WATER LINE DOWN THAT, DOWN THAT ROAD.

SO, AND I WAS JUST, UH, TELLING EMILY THAT, UM, AND I CAN'T REMEMBER, UM, THE NAME OF THAT DEVELOPMENT THAT'S OFF OF, UH, YEAH, THEY, THEY PUT A WATER LINE GOING THE GOING NORTH AND THEN THEY PUT A SEWER LINE COMING, COMING SOUTH.

AND SO I'M SURE THEY'RE PROBABLY TAPPING IN MAYBE OFF OF THAT SEWER, UH, NEW SEWER LINE THAT'S BEING PUT ALONG THAT ROAD.

BUT THERE IS NOT A WATER LINE THERE CURRENTLY.

SO, AND ALSO VALLEY VIEWS OUT OF CITY LIMITS.

NO, REGARDING THAT.

IF, IF THEY WERE IN THE CITY LIMITS, WE WOULD BE REQUIRED TO ADD THAT WATER LINE FOR UH, FIRE HYDRANTS.

ISN'T THAT NOT CORRECT? WELL, AS AT WITH DEVELOPMENT, YES.

WITH DEVELOPMENT.

WITH WITH DEVELOPMENT.

RIGHT.

RIGHT.

I MEAN YOU COULD, YOU COULDN'T HAVE A NEIGHBORHOOD WITHIN THE CITY LIMITS.

IT DOES NOT HAVE THE FIRE HYDRANTS EVERY 200 FEET.

I THINK IT IS.

THAT, THAT WE COULD NOT DO THAT.

RIGHT.

A NEW NEIGHBORHOOD.

YES.

AND JUST AS A REMINDER, THE NEIGHBORHOOD THAT WE APPROVED BEFORE, IS THAT CORRECT? I, I WAS WAITING FOR WELL IT'S NOT, IT'S NOT, I THINK IT'S, I DON'T, I THINK IT'S CLOSER TO 500 FEET, BUT OKAY.

WHATEVER THE, WHATEVER THE DISTANCE IS, WE WOULD, BUT YEAH, IF YOU'RE BUILDING A NEW SUBDIVISION, YOU GET, YOU HAVE TO MEET ALL THE CURRENT CODES AND ORDINANCES AND, AND SO FORTH.

SO THANK YOU.

I JUST DIDN'T WANT THAT TO BE CONFUSING THAT, THAT WE HAVE A NEIGHBORHOOD OUT THERE THAT DOESN'T HAVE FIRE HYDRANTS, THAT IT'S NOT IN THE CITY LIMIT, SO IT'S NOT A REQUIREMENT.

RIGHT, RIGHT.

THANK YOU.

SO YEAH.

UM, IF, IF, IF THEY WERE WANTING WATER AT SOME POINT, I DON'T, I'M SURE THEY'RE IN OUR CCN, SO THAT'S A ANOTHER DIFFERENT SUBJECT.

YEAH.

THAT'S RELATED TO CUZ WATER IS, CROSSES MULTIPLE PATHS MM-HMM.

WHEN YOU TALK ABOUT WATER YEAH.

AND WHERE YOU'RE LOCATED.

SO, THANK YOU.

MY QUESTION WAS JUST THE OTHER NEIGHBORHOOD THAT WE APPROVED OVER THERE, THEY CHANGED THEIR ENTRANCES TO BE OFF OF 1 75 AND NOT OFF OF 1 77.

THAT'S CORRECT.

YEAH.

I DON'T, I I I'M GONNA LET ROBIN SPEAK TO THAT.

YEAH.

SO THEY, THE TRAFFIC WAS NOT NECESSARILY IMPACTING, UH, 1 77.

UM, I THINK WE LEFT THAT FOR EMERGENCY VEHICLES ONLY, WAS WHAT WE ENDED UP APPROVING.

UM, EMERGENCY ACCESS.

THEY, THEY, THEY, THEY MAY HAVE THE AXES ON AND OFF.

YEAH.

BUT IT DOESN'T STOP ANYBODY FROM DRIVING DOWN THAT ROAD.

I MEAN, I'VE DRIVEN DOWN THAT ROAD FOR VARIOUS OTHER REASONS.

RIGHT.

MULTIPLE TIMES.

BUT, UM, SO THANK YOU.

I'M, I'M GONNA LET THE YES, SUPER SMART PERSON HERE.

.

SO ON THE PRELIMINARY PLAT, THEY DON'T HAVE ANY ROADS GOING TO 1 77.

OKAY.

IT'S ALL 1 75.

THANK YOU.

OKAY.

SO I THINK THAT'S SOMETHING THAT SOMETIMES GETS LOST IN THESE IS, YOU KNOW, EVERYBODY WANTS TO HAVE THE UTILITIES, WE WANNA HAVE THE WIDEN ROADS, AND THIS IS HOW THOSE THINGS HAPPEN.

THIS IS HOW IMPROVEMENTS HAPPEN.

THE CITY DOESN'T HAVE THE COFFERS TO GO OUT AND WIDEN ROADS.

UM, IT HAPPENS WITH DEVELOPMENT.

ANYTHING ELSE? COUNSEL? ARE THERE ANY TYPE OF, UH, ROAD IMPROVEMENTS THAT ARE GONNA BE DONE AS PART OF THE PROJECT? WELL, THE, AS I MENTIONED, THE THE FIRST TWO LANES OF CRYSTAL FALLS

[01:30:01]

IN THE SECTION WHICH WOULD RELIEVE, UM, TRAFFIC WILL BE ADDRESSED IN PHASE TWO OF THE, OF THE PROJECT.

UM, ANY NORMAL ENTRANCE, UH, YOU KNOW, EGRESS AND THOSE KIND OF THINGS WILL HAVE TO BE ADDRESSED.

UH, FOR THE ENTRANCE.

THIS IS JUST A ZONING CASE.

THIS ISN'T THE, UM, PRELIMINARY PLAT OR ANYTHING.

SO IS THERE A TIMEFRAME IF THIS IS APPROVED TONIGHT, THE NEXT STEPS, UH, AN ANTICIPATED START TIME, ASSUMING EVERYTHING GOES TO IT IS NOT, YEAH, ACCORDING TO SCHEDULE, THEY'VE GOT BUILDERS LINED UP AND, UM, EVERYTHING ALREADY, ALREADY SET IN PLACE, UH, TO START WORKING, UH, SUBMIT FOR THE WATER LINE.

SO I MEAN, IT, IT WOULD BE JANUARY, NOT, NOT CONSTRUCTION MM-HMM.

, BUT SUBMITTING OF APPLICATIONS AND EVERYTHING AS SOON AS JANUARY.

BUT NOT EVERYTHING IS PLATTED.

NO.

SO THERE'S CONSTRUCTION IS NOT THIS, IS THE ZONING CASE GONNA HAPPEN IN THE NEXT SIX MONTHS? IT'S NOT GONNA HAPPEN.

NO.

IT'S PROBABLY SIX MONTHS TO A YEAR.

OKAY.

THANK YOU.

THE ZONING IS, UH, STATE.

YES.

AND MS. GRIFFIN, JUST TO CONFIRM WHAT WE HAD TALKED ABOUT EARLIER, HALF OF THIS, ABOUT 10 ACRES ALREADY IS SINGLE FAMILY.

IT'S ALL SUBURBAN.

IT'S ALL, YEAH.

SOMEONE'S RURAL.

WELL, I MEAN, BUT YEAH, SUBURBAN.

SO REALLY IT'S A MATTER OF JUST TAKING IN THAT OTHER HALF.

AT THIS POINT, THE, THE SOUTHERN HALF IS SINGLE FAMILY SUBURBAN ALREADY.

I WOULD JUST SAY.

AND FOR, FOR THE NEIGHBORS THAT SHOWED UP TOO.

Y'ALL KNOW THAT THEY'RE, THEY'RE TRYING TO DO A THREE UNITS PER ACRE, LIKE 70 FOOT WIDE LOT RATHER THAN THE TOWNHOME STUFF THAT WAS BEING PROPOSED EARLIER.

RIGHT.

I WAS VERY AWARE.

OKAY.

JUST, OKAY, THEY'RE TALKING ABOUT LIKE A 9,000 SQUARE, SORRY, WE CAN'T HAVE THE BACK AND FORTH.

SORRY, MY, THAT WAS MY FAULT FOR STARTING THAT.

YEAH, I THINK THE REQUIRED LOT SIZE ON 70 FEET'S, LIKE 3,400 SQUARE FEET.

IS THAT RIGHT? 33, 3400 ROUGHLY LOT.

SEVEN, 7,000.

YEAH.

YEAH.

7,000.

SORRY.

70 BY A HUNDRED, ISN'T IT? WELL, 70 BY HUNDRED.

SO 70, YEAH.

60 BY ONE 20 IS A, YEAH.

7,200.

SO EXACTLY.

BEEN MORE THAN THAT.

THAT'S, I MEAN, I DON'T THINK ANYBODY ELSE IS GONNA GO OUT AND JUST SAY SO ON, ON THE BASIS OF, UM, SOMEBODY BEING ABLE TO DEVELOP THEIR PROPERTY, UM, AND FOLLOWING EVERY RULE THAT WE HAVE IN THE BOOK RIGHT NOW FOR THESE THINGS, UM, FOR THOSE REASONS, I DON'T KNOW HOW IT WILL PLAY OUT UP HERE, BUT FOR THOSE REASONS, UM, I WOULD MAKE A MOTION TO APPROVE.

I'LL SECOND.

MOTION.

SECOND.

IS THERE ANY FURTHER DISCUSSION? ALL THOSE IN FAVOR? OPPOSED PASSES.

SIX TO ONE.

THANK YOU.

MOVING

[29. Council Member Future Agenda Items [Any deliberation of or decision about the subject of the inquiry shall be limited to a proposal to place the subject on the agenda for a subsequent meeting.]]

INTO OUR VERY SHORT, REGULAR AGENDA, ITEM 29, COUNCIL MEMBER, FUTURE AGENDA ITEMS, ANY DELIBERATION OF OR DISCUSSION ABOUT THE SUBJECT OF THE INQUIRY SHALL BE LIMITED TO A PROPOSAL TO PLACE THE SUBJECT ON THE AGENDA FOR A SUBSEQUENT MEETING.

COUNSEL, DOES ANYBODY HAVE ANYTHING? YES, I HAD ONE.

I WOULD LIKE FOR US TO LOOK AT ADDING A SCHOOL ZONE ON CRYSTAL FALLS BETWEEN 180 3 A, UM, AND TELL ME THE NAME OF THE STREET WHERE LIKE, IT'S ART.

THANK YOU.

I CANNOT ARTESIAN, I KEEP THAT IN MY HEAD.

ARTESIAN SPRINGS, RIGHT? OH, OKAY.

YEAH, ON THAT WAY BECAUSE, UH, CRYSTAL FALLS, BUTTS UP TO WILEY MIDDLE SCHOOL AND WE GOT QUITE A FEW KIDS CROSSING RIGHT THERE.

SO IF WE COULD DO SOME KIND OF TRAFFIC STUDY, UM, TO UNDERSTAND HOW MANY PEOPLE ARE BEING IMPACTED BY KIDS CROSSING AND THE, THE SPEEDING THAT'S GOING ON ON CRYSTAL FALLS RIGHT THERE, TRYING TO MAKE THAT LIGHT AND GET THROUGH IT.

I WOULD APPRECIATE THAT.

I THINK YOU CAN DO THE SCHOOL ZONE WITHOUT A TRAFFIC STUDY.

MR. BEVERLY.

OH, WE, WE'VE, WE'VE TALKED ABOUT IT INTERNALLY.

NOW I KIND OF USE SOME EXAMPLES.

KIND OF, IF YOU LOOK AT A LOT OF THE HOUSTON AREA SCHOOLS, DEPENDS ON THE SCHOOL, THE LOCATION.

BUT IF YOU'RE NEAR THE CITY MANAGER, I APOLOGIZE, THIS IS NOT ON THE AGENDA AND THIS IS CONSIDERED A DISCUSSION, SO WE CAN'T DO THAT.

OKAY.

I APOLOGIZE.

YES, THANK YOU.

OKAY.

ANYTHING ELSE THAT ANYONE WANTS TO PUT ON A FUTURE AGENDA ITEM? YES, I'D LIKE TO SEE US, UM, MAYBE LOOK AT HIRING SOMEONE TO FIX THE SIGNAL TIMING WITH ALL THE LIGHTS ON 180 3 WHEN THE TRAIN COMES BY BECAUSE WE GET SO MUCH OF A GRIDLOCK THERE AND, UM, VEHICLES THAT SHOULD BE ABLE TO KEEP GOING WHEN THE TRAIN GOES BY ARE STUCK.

SO I'D LIKE TO ASK TO LOOK AT THAT.

CHECK MANAGEMENT CONTROL.

ALL RIGHT, ANYTHING FURTHER?

[30. Council Member Closing Statements.]

ALL RIGHT, ITEM 30, COUNCIL MEMBER CLOSING COMMENTS.
