Open Meeting.] [00:00:08] GOOD EVENING. TODAY IS THURSDAY, MARCH 7TH, 2024, AND THE TIME IS 6:02 PM AND THIS IS THE BRIEFING WORKSHOP OF THE LEANER CITY COUNCIL, CITY SECRETARY CRABTREE. WILL [2. Roll Call.] YOU PLEASE CALL ROLE COUNCIL MEMBER CATHERINE BATTALION PARKER. HERE, MAYOR PRO. TIMM ES BEING MATT GI ANDRIA. HERE. COUNCIL MEMBER DAVID MCDONALD HERE. COUNCIL MEMBER NICOLE THOMPSON. PRESENT, COUNCIL MEMBER CHRIS CERNEY. HERE. COUNCIL MEMBER BECKY ROSS. HERE, MAYOR CHRISTINE DELAL HERE. WE'RE GONNA MOVE ON TO ITEM NUMBER THREE. DISCUSS [3. Discuss appropriate zoning district for vape shops and location criteria; Leander, Williamson and Travis Counties, Texas.] APPROPRIATE ZONING DISTRICT FOR VAPE SHOPS AND LOCATION CRITERIA. LEANDER WILLIAMSON AND TRAVIS COUNTY, TEXAS, EXECUTIVE DIRECTOR OF DEVELOPMENT SERVICES, GRIFFIN. GOOD EVENING. GOOD EVENING. UM, SO THE, THIS IS A WORKSHOP THAT WAS REQUESTED BY THE CITY COUNCIL TO TALK ABOUT VAPE SHOPS. UM, IT'S CURRENTLY A USE THAT'S NOT PART OF OUR ZONING ORDINANCE. UH, SO IT'S NOT DEFINED. WE DON'T HAVE A CATEGORY FOR IT. UM, AND IT'S PROBABLY APPROPRIATE FOR US TO COME UP WITH A DEFINITION AND PLACE IT IN THE ORDINANCE. UM, WE'VE DONE SOME RESEARCH AND WE FOUND THAT WE HAVE FIVE VAPE SHOPS IN, UM, LEANDER. AND WE PUT TOGETHER THIS MAP THAT WAS, UM, IN YOUR PACKET THAT SHOWS YOU THE LOCATION OF THE VAPE SHOPS. SO ON THE THE MAP YOU CAN SEE THESE YELLOW CIRCLES. SO THOSE ARE THE EXISTING VAPE SHOPS. AND I BELIEVE THEY WERE TREATED AS RETAIL SALES. SO IT IT FIT INTO THE LOCAL COMMERCIAL CATEGORY. UM, ON THIS MAP, WE ALSO SHOW LOCATIONS OF PRIVATE SCHOOLS, PUBLIC SCHOOLS, AND CITY PARKS. AND WE PUT A LITTLE BUFFER AROUND 'EM JUST FOR CONTEXT. SO IT'S A THOUSAND FEET, UM, TO THAT BLACK LINE. SO LIKE THIS, THIS HERE IS THE ELEMENTARY SCHOOL. IT'S UNDER CONSTRUCTION. SO THERE'S A THOUSAND FOOT, UM, LINE FROM THAT. UM, THE ONE THAT WE DO HAVE THAT IS WITHIN A THOUSAND FEET OF A SCHOOL IS DOWN HERE. AND THAT'S, UM, AT CRYSTAL FALLS AND, UH, LAKELINE. UM, SO THAT'S THE INFORMATION WE COLLECTED. WE CAME UP WITH A DEFINITION, UM, TO DESCRIBE WHAT IS A VAPE SHOP, HOW IT'S A RETAIL OUTLET, AND WHAT THEY SELL. AND, UM, I GUESS I'M AVAILABLE FOR QUESTIONS OR DISCUSSION AND RESEARCH. SORRY, SORRY. I HAD, I STRUGGLE WITH THE MAP. IT'S, THERE'S A LOT GOING ON. . IT'S, IT'S A LOT OF COLORS TOO. WE, WE KEPT TAKING THINGS OFF AND PUTTING THEM ON. UM, WE CAN PROVIDE A DIFFERENT UPDATE THAT DOESN'T SERVE ZONING, BUT WE THOUGHT THE ZONING WAS KIND OF IMPORTANT. SO, YOU KNOW, WHAT USES GO WHERE. MM-HMM. . UM, IS THERE SOMETHING I CAN HELP TO ORIENT YOU? MAYBE? UM, SO CURRENTLY IT WOULD GO IN WHERE THERE'S LOCAL COMMERCIAL ZONING? UM, YES. OKAY. 'CAUSE IT'S KIND OF LIKE A RETAIL BUSINESS. SO ON THE MAP THAT WOULD BE AREAS THAT ARE THE CORAL COLOR, PINK OR PURPLE OR RED. SO NOT THE GREEN GELS AND BLUES. OKAY. THAT'S RESIDENTIAL. OKAY. AND THEN THERE'S NO RESTRICTIONS ON BEING NEAR A PARKER SCHOOL. CORRECT. FOR ALCOHOL SALES THOUGH? THERE IS, RIGHT. UH, CORRECT. FROM TABC. FROM TABC. DO YOU KNOW OFFHAND WHAT DARA DOES? SHE'S A PROFESSIONAL, SORRY, , BUT, UH, ALCOHOL SALES FROM SCHOOLS. UM, SO WE'RE ONLY ONE IS 300 FEET FROM T ABCS IS A . OKAY. 300 FEET FOR US AND A THOUSAND FROM TABC SCHOOLS ARE MEASURED PROPERTY LINE TO PROPERTY LINE. AND UH, CHURCHES ARE FROM DOOR TO DOOR THE WAY YOU WOULD NORMALLY WALK. OKAY. AND IT'S SCHOOLS AND CHURCHES, BUT NOT PARKS? NO. OKAY. THANK YOU. UM, COUNCIL MEMBER THOMPSON, DID YOU, I SEE YOU UP WITH THE QUESTION. I WAS JUST GONNA ASK, UM, OUR SURROUNDING CITIES, ARE THERE ANY RULES OR REGULATIONS THAT HAVE BEEN PUT IN PLACE IN OUR SURROUNDING CITIES FOR VAPE? I, I BELIEVE THERE ARE. WE HAVEN'T DONE A LOT OF RESEARCH. OKAY. BUT WE CAN GET THAT KIND OF INFORMATION AND SHARE IT. THAT WOULD BE INTERESTING TO SEE WHAT OTHER CITIES ARE DOING RIGHT AROUND US AS FAR AS VAPE SHOPS AND WHAT THEY, UM, PUT IN PLACE FOR REGULATIONS. SO, THANK YOU. ARE THERE ANY REGULATIONS ON STANDARD SMOKE SHOPS OR ARE THEY KIND OF THE SAME? NOT IN LEANDER. OKAY. THERE MIGHT BE THROUGH OTHER ENTITIES LIKE TABC AND SUCH, BUT NOT THE CITY. AND THAT IS SOMETHING WE COULD ALSO ADD TO OUR DEFINITIONS. IT'S KIND OF PART OF THE EVOLUTION OF YOUR ORDINANCE WHEN NEW THINGS HAPPEN, YOU HAVE TO DEFINE THEM. DO WE KNOW WHAT WE CAN LEGALLY DO? LIKE WHAT OTHER CITIES HAVE DONE? QUESTION. WE CAN DO RESEARCH AND TRY TO FIND OUT. UM, SHE'S PROVIDED SOME INFORMATION ON, UM, CASES WHERE PEOPLE HAVE GOTTEN IN TROUBLE. I THINK IT WAS ABOUT A MOBILE VAPE SHOP. UM, BUT WE CAN PULL THAT INFORMATION AND PROVIDE IT TO YOU. MOBILE. A MOBILE VAPE. YEAH. I THINK THEY WERE TRYING TO NOT ALLOW IT, UM, LIKE A BOOK MOBILE BUT VAPE LIKE, SO IT, THAT'S EVEN WORSE. I KNOW. BUT THAT WAS HOW IT FELT TO ME WHEN I WAS READING ABOUT IT, BUT YEAH. OKAY. BUT WE CAN, WE CAN DEFINITELY GET THAT INFORMATION TOGETHER. THANK YOU. UM, COUNSEL, DID ANYBODY HAVE ANY THOUGHTS? YEAH, I JUST THINK WE SHOULD REALLY CONCENTRATE AROUND THE SCHOOLS JUST SO IT'S NOT EASILY ACCESSIBLE. I MEAN, PEOPLE ARE GONNA DO WHAT THEY'RE GONNA DO, BUT IF WE CAN [00:05:01] JUST KINDA LIMIT THE ACCESS, UM, JUST 'CAUSE IT'S SO ADDICTIVE. BUT I'M GOOD WITH WHAT TABC ALREADY USES WITH A THOUSAND FEET WITHIN A SCHOOL. MM-HMM. FOR ALCOHOL. MM-HMM. . SO HAVE THE . SO JUST KIND OF MARRYING THAT IF, IF IT'S WITHIN OUR RIGHTS TO DO SO. AND IS, IS THIS SOMETHING THAT, UM, THE COUNCIL WOULD SEE AS MORE OF A GENERAL COMMERCIAL TYPE USE OR LOCAL COMMERCIAL? WHEN WE THINK ABOUT LOCAL COMMERCIAL, IT'S MORE OF A NEIGHBORHOOD SERVING USE IN A SMALLER SCALE AND IN GENERAL, COMMERCIALS A REGIONAL USER. UM, SO JUST SOMETHING WE'D PROBABLY WANNA THINK ABOUT. UM, I THINK I WOULD BE OKAY WITH PUTTING IT INTO GENERAL JUST TO MAKE IT A LITTLE BIT TIGHTER. UM, BECAUSE I KNOW WE HAVE A LOT OF LOCAL ALL OVER THE PLACE NEAR NEIGHBORHOODS. RIGHT? RIGHT. UM, SO, AND WE DO HAVE HOOKAH LOUNGES IN OUR ORDINANCE TODAY. UM, AND HOOKAH IS IN HC RIGHT NOW. OKAY. NOT THAT I'M SAYING WE NEED TO DO THAT WITH VAPE, BUT JUST FOR CONTEXT, WE HAVE THOSE THERE. IT SEEMS LIKE WHATEVER WE END UP DECIDING ON THAT WE NEED. 'CAUSE TO ME THAT'S, THEY'RE ALL SIMILAR. IT'S JUST DIFFERENT. MM-HMM. . RIGHT. UM, IS THAT WE JUST NEED TO BE CONSISTENT. YEAH. SO IF IT'S GONNA BE CIGARETTES, VAPING, HOOK, IT ALL JUST NEEDS TO MATCH, BE TOGETHER. SO IT'S EASY TO UNDERSTAND. AND ALSO LESS LIKELY TO CREATE A LOOPHOLE. AN UNINTENDED LOOPHOLE. THAT MAKES SENSE. YEAH. SO FOR THE PUBLIC THAT'S WATCHING, I WANT TO JUST SORT OF BRING UP HOW WE GOT HERE. UM, A RESIDENT WROTE INTO US SEVERAL MONTHS AGO CONCERNED ABOUT A VAPE SHOP THAT WAS SUPPOSED TO OPEN BY A SCHOOL AND ASKING IF WE COULD STOP IT, BUT BECAUSE THERE'S NOTHING IN OUR ORDINANCES, WE COULDN'T. UM, AND THEN JUST GIVEN THE RISE IN VAPING FROM TEENAGERS, HOW THEY'RE USING THEIR VAPE PENS TO PUT OTHER SUBSTANCES IN, LIKE THINGS THAT CONTAIN FENTANYL, UM, AND JUST HOW MUCH MARKETING HAS BEEN DONE TO KIDS. I THINK, UM, I THINK THIS IS SOMETHING WHERE I, I, I DO WANT US TO CRACK DOWN A LITTLE BIT. UM, SO YEAH, I THINK MATCHING THE TABC REQUIREMENTS AND KEEPING THEM AWAY FROM SCHOOLS, I'M FINE WITH KEEPING 'EM AWAY FROM CHURCHES AS WELL. I'M NOT SAYING THEY CAN'T OPEN, BUT I DON'T WANT THEM OPEN WHERE IT'S REALLY EASY TO MARKET TO KIDS. UM, WHEN HIGH SCHOOLERS ARE, ARE ON PUBLIC AND PRIVATE SCHOOLS, IS THAT YES. IF THAT'S ALLOWABLE. OH, PAIGE IS GETTING UP. WE MIGHT HAVE VENTURED INTO SOMETHING. YEAH. AND IN GENERAL, I'M IN AGREEMENT. I DON'T WANT THEM A THOUSAND FEET WITHIN SCHOOLS. OH, OKAY. SHE'S NOT COMING UP FOR US. OKAY. WE'RE GOOD. THAT'S A MIC, RIGHT? ME? OH, OKAY. WE'RE GOOD NOW. SORRY. UM, OH, AND I'M LOUD NOW TOO. UH, YEAH, I THINK, UM, I FORGET WHERE WE WERE GOING. YOU SAID SOMETHING THAT WAS AS MAY SCHOOLS. OH, THANK YOU. SCHOOLS. YEAH. I WAS JUST AGREEING WITH DAVID SAYING I THINK THEY'RE EASILY MARKETED TO CHILDREN. YEAH. AND SO A THOUSAND FEET FROM PUBLIC OR PRIVATE SCHOOLS, IF WE'RE ABLE TO DO THAT, I WOULD BE OKAY. ALSO KEEPING THEM AWAY FROM PARKS. THAT'S WHAT I WAS GONNA ASK. YEAH. IF WE CAN DO THAT. WHAT ABOUT DAYCARES? ARE WE JUST FOCUSED ON PUBLIC PRIVATE SCHOOLS, PARKS? I DON'T KNOW THAT THE DAYCARE KIDS ARE GONNA GO ACROSS THE STREET AND GET ONE, BUT IF Y'ALL WANNA GO THERE, I HAVE NO PREFERENCE. . OKAY. NAH, I JUST HAVE MY, MY COMMENT IS ONLY TO THE ZONING PORTION OF THAT. ROBIN, HOW IMPORTANT IS IT TO BE ABLE TO DISTINGUISH BETWEEN GENERAL COMMERCIAL AND LOCAL COMMERCIAL? LIKE, IS THAT, IS IT IMPORTANT THAT WE DO THAT? OR IF THE ORDINANCE JUST SAYS THIS FAR AWAY FROM THESE TYPES OF PLACES, IS THAT GOOD ENOUGH FOR US? SO WE, WE NEED TO ADD A DEFINITION AND WE NEED TO ADD THE USE TO A LAND USE CATEGORY. SO IF WE PUT IT IN LC, THAT MEANS LC GC. IT'S JUST A DECISION WE HAVE TO MAKE WHERE WE WANNA SEE IT. RIGHT. I DON'T KNOW THAT I'M A HUNDRED PERCENT ON BOARD WITH WHAT YOU GUYS ARE SAYING, BUT, UM, I DON'T KNOW IF WE WANT TO GO INTO THE EXACT, LIKE IT'S NOT ALLOWED IN LC, BUT IT'S ALLOWED IN GC. I SEE THAT GETTING PRETTY MESSY. SO THAT'S MY ONLY COMMENT HERE. IS IT WHY WE'RE DOING THAT? UM, WATCH, WATCH OUT FOR THAT PORTION OF IT THAT COULD GET MESSY, BUT I THINK THE DISTANCE AWAY FROM, UM, WHERE WE'RE AT HERE IS, IS, IS, IS FINE. AS LONG AS WE'RE KEEPING 'EM AWAY FROM WHERE KIDS ARE CONGREGATING, I'M FINE WITH WHATEVER. EVERYBODY ELSE. GOOD. SO IS THIS SOMETHING, UM, WHERE YOU WANT STAFF TO DO THE RESEARCH AND THEN INITIATE A ZONING CASE TO PRESENT TO P AND Z AND GET IT STARTED? OR DO YOU WANT ANOTHER PRESENTATION? CAN WE GET A QUICK UPDATE BEFORE, IS THAT, WOULD THAT BE HELPFUL? THAT WAY WE'RE NOT SPINNING THAT WAY, WE'RE NOT SPINNING YOUR WHEELS AND GOING THROUGH ALL THOSE THINGS FOR, BUT WE'LL UPDATE YOU BEFORE WE DO THE PUBLIC NOTICE. I THINK SO, YEAH. OKAY. I MEAN, THAT COULD EVEN BE THROUGH IF IT HAD TO BE EVEN THROUGH AN EMAIL OR SOMETHING LIKE THAT. YEAH, THAT'D BE FINE. I DON'T REALLY CARE. OKAY. YEAH. WHATEVER IS THE PATH OF LEAST RESISTANCE THAT MAKES IT EASIEST FOR [00:10:01] YOU AND DOESN'T OVERBURDEN YOU, THAT'D BE FINE. OKAY. ALL RIGHT. THANK YOU SO MUCH. ALL RIGHT. ITEM NUMBER FOUR, DISCUSS [4. Discuss local amendment to the Building Code regarding building material requirements associated with structures over three (3) stories in height; Leander, Williamson and Travis Counties, Texas.] LOCAL AMENDMENT TO THE BUILDING CODE REGARDING BUILDING MATERIAL REQUIREMENTS ASSOCIATED WITH STRUCTURES OVER THREE STORIES IN HEIGHT. LEANDER WILLIAMSON AND TRAVIS COUNTY'S TEXAS EXECUTIVE DIRECTOR OF DEVELOPMENT SERVICES. GRIFFIN, YOU ARE STILL HERE. HELLO. GOOD EVENING. UM, SO THIS IS, UH, A DISCUSSION ABOUT A LOCAL AMENDMENT THAT WE'VE MADE TO THE BUILDING CODE. UM, THIS HAPPENED IN 2019 AND A PROVISION WAS ADDED, UM, THAT, THAT STATES THAT WOOD FRAME CONSTRUCTION FOR RESIDENTIAL OR MULTIFAMILY CANNOT EXCEED THREE STORIES. SO THAT MEANS IF YOU HAVE A, UM, A HOTEL OR AN APARTMENT COMPLEX, IT'S OVER THREE STORIES IN HEIGHT. UM, YOU HAVE TO USE STEEL FRAME. SO IT'S JUST AN ADDED EXPENSE. UM, STAFF HAS RECEIVED A LOT OF, UM, QUESTIONS FROM DEVELOPERS AND WE'VE SPENT A LOT OF TIME TRYING TO FIND WAYS TO WORK AROUND THE ORDINANCE AND WE THOUGHT IT WOULD PROBABLY BE A GOOD IDEA TO BRING IT BEFORE THE COUNCIL, SINCE MOST OF YOU WERE NOT HERE WHEN IT WAS ADOPTED, TO KIND OF REVISIT IT WITH YOU GUYS TO SEE IF YOU WANNA KEEP THIS REGULATION. UM, IN OUR LOCAL AMENDMENTS, UM, WE CAME UP WITH, UH, THREE OPTIONS TO LOOK AT. SO WE CAN EITHER JUST LEAVE THE AMENDMENT IN PLACE AND THAT WOULD GIVE STAFF THE MESSAGE THAT WE SHOULDN'T BE TRYING TO DO PUDS TO GET RID OF IT. IT MEANS YOU WANNA KEEP IT. UM, OR WE MODIFY THE AMENDMENT TO ALLOW WOOD FRAME CONSTRUCTION IF THEY MEET CERTAIN STANDARDS FROM THE FIRE DEPARTMENT OR WE REMOVE THE AMENDMENT COMPLETELY. UM, WE HAVE DONE RESEARCH, UM, WITH LOCAL OR SURROUNDING CITIES AND THEY DON'T HAVE THIS AMENDMENT IN THEIR ORDINANCE. THEY ALL COMPLY WITH THE BUILDING CODES, WHICH DOESN'T INCLUDE THAT. SO IT MIGHT BE BETTER FOR US TO BE CONSISTENT WITH THE SURROUNDING COMMUNITIES. HOW DID WE END UP WITH IT? WELL, I THINK, AND IT WASN'T ME WHO, UM, CAME UP WITH THIS, SO I'M SPECULATING A LITTLE BIT, BUT I THINK IT WAS A, AN ATTEMPT TO, UM, REDUCE MULTIFAMILY. 'CAUSE IT MAKES IT MORE CHALLENGING TO GO TALLER, WHICH ALLOWS MORE DENSITY, BUT THAT'S JUST OPINION. GOTCHA. THANK YOU. THAT MAKES SENSE. UM, HAVE WE BEEN GETTING A LOT OF REQUESTS FOR THREE STORY AND ABOVE? UM, WE HAVE ONE THAT, UM, IN REVIEW RIGHT NOW. UM, NORTHLINE ACTUALLY WOULD'VE FALLEN UNDER THIS, BUT WE HAD AN AMENDMENT IN THEIR PUD THAT ALLOWED IT. SO IT KIND OF MAKES IT CONFUSING FOR OTHER DEVELOPERS, LIKE, WELL, WHY WOULD WE APPROVE IT AS PART OF THEIR ZONING, BUT WE'RE GONNA KEEP IT ON THE CAN. CAN YOU MENTION THE HOLIDAY INN SITUATION? OH YEAH. THE HOLIDAY INN EXPRESS, UM, WOULD'VE BEEN TALLER IF WE DIDN'T HAVE THIS RESTRICTION IN PLACE, BUT THEY HAD TO REDESIGN THEIR SITE 'CAUSE THEY, IT WAS COST PROHIBITIVE FOR THEM TO DO IT. OH. WHICH IS KIND OF INTERESTING. YEAH. OKAY. THANKS COUNSEL. THOUGHTS? SO THE, UM, AS LONG AS THIS IS NOT A SAFETY ISSUE AND THE FIRE DEPARTMENT'S COMFORTABLE WITH IT, I I'M OKAY WITH REMOVING IT'S GONNA BE A TWO OR A THREE ON THIS, RIGHT? LIKE OPTION TWO OR THREE? YES. LIKE REMOVING THE AMENDMENT. I THINK THAT'S THE THING IS LIKE, DO WE WANT TO GO ALL THE WAY TO THREE AND JUST SAY, HEY, WE SHOULD NOT EVEN BE DEALING WITH THIS. IS THAT THE EASIEST THING? OR IT WOULD PROBABLY BE THE MOST CONSISTENT WITH SURROUNDING COMMUNITIES CONSISTENT AND KIND OF HELP, IT HELPS STAFF AND THE DEVELOPER WITH REGULATION. YEAH. I WOULD BE INCLINED TO GO THAT ROUTE AND A STAFF COMFORTABLE WITH THAT. UM, PLANNING DEPARTMENT AND BUILDING DEPARTMENT ARE, AND I THINK FIRE IS AS WELL. OKAY. YES. THAT'S SPEAKS VOLUMES RIGHT THERE. YEAH. THANK YOU. YEAH, I'M IN AGREEMENT WITH THAT. SAME. OKAY. ALL RIGHT. SO WE'LL BRING BACK, UH, AN AMENDMENT AT THE NEXT MEETING. ALL RIGHT. OKAY. THANK YOU ALL SO MUCH. THANK YOU. WELL, THAT IS EVERYTHING WE HAD. SO WITH THAT, WE WILL ADJOURN THE BRIEFING WORKSHOP AT 6:16 PM PLEASE BE BACK AT SEVEN O'CLOCK FOR OUR MEETING. ALL RIGHT. GOOD [5. Public comments on items listed in the agenda will be heard at the time each item is discussed. [All comments are limited to no more than 3 minutes (6 minutes if translation is needed) per individual.]] I AM NUMBER SEVEN IS NON AGENDA ITEM. PUBLIC COMMENTS. WE ARE GONNA ACTUALLY SLIP A RECOGNITION IN HERE WITH SOME PUBLIC COMMENTS. SO OUR POLICE DEPARTMENT RECENTLY GOT REACCREDITED BY KALIA, WHICH MEANS THAT THEY ARE FANTASTIC AND DO ALL SORTS OF EXTRA THINGS. AND CHIEF MITTEN IS A WONDERFUL EXPERT ON IT AND IS GOING TO TELL US ALL ABOUT WHAT THE DEPARTMENT HAS DONE AND THE RE-ACCREDITATION. I DON'T GOT THE EXPERT BEHIND ME. SO , THANK YOU SO MUCH AND I APPRECIATE THAT. I'M GONNA TURN THE MIC OVER TO RANDY HERE BECAUSE I THINK, UH, UH, HE'LL DEFINITELY TELL YOU A LITTLE BIT MORE ABOUT THE PROGRAM AND, AND, UH, HE CAME ALL THE WAY FROM OKLAHOMA TO DO THIS, SO I APPRECIATE HIM, UH, TAKING CARE OF THIS FOR US. SO, RANDY, CHIEF COUNCIL, I MAYOR, I, I APPRECIATE THE OPPORTUNITY TO COME DOWN AND TALK A LITTLE BIT ABOUT CLEA. I'M PRETTY PROUD OF THE ORGANIZATION AND I'M EXTREMELY PROUD OF THIS ORGANIZATION, THIS CHIEF. HE'S DONE A GREAT JOB. I'VE BEEN ACQUAINTED WITH HIM FOR A LONG TIME. I KNOW WHAT QUALITY YOU HAVE BEHIND ME OVER HERE, SO THAT'S VERY IMPORTANT. I KIND OF WANT TO TELL YOU JUST A LITTLE BIT ABOUT KALIA. I WON'T BORE YOU A WHOLE LOT WITH IT BECAUSE I THINK THIS AWARD IS NOT, IS A LOT MORE THAN JUST A CERTIFICATE THAT YOU'RE GOING PUT UP ON THE WALL. I THINK THE INSTILLMENT OF WHAT IT IS WITHIN THIS POLICE DEPARTMENT AND THIS AGENCY IS SO IMPORTANT. AND IT'S ONLY BECAUSE OF THE LEADERSHIP AND THE SUPPORT THAT YOU ALL GIVE THAT LEADERSHIP. AND I THINK THAT'S WHAT YOU SHOULD KNOW. UH, K CLIFF STARTED IN 1979. BACK IN THE DAY, IF YOU REMEMBER, THERE WAS A LOT OF THINGS GOING ON IN THE EARLY SEVENTIES OF RIOTING AND THIS AND THAT AND TURMOIL. WELL, IACP, WHICH IS THE INTERNATIONAL ASSOCIATION'S CHIEF POLICE, THE NATIONAL ORGANIZATION OF BLACK LAW ENFORCEMENT EXECUTIVES, NOBLE, THE NATIONAL SHERIFF'S ASSOCIATION, NSA AND PERF, THE POLICE EXECUTIVE RESEARCH FORM WERE GIVEN A GRANT TO LEARN TO WRITE SOME STANDARDS FOR LAW ENFORCEMENT. 'CAUSE THEY THOUGHT THERE NEEDED TO BE A STANDARD IN THIS COUNTRY FOR POLICE DEPARTMENTS. WE CAN CARRY THAT FORWARD TO THE, AS THE YEARS GO BY, THOSE FOUNDING AGENCIES APPOINT 21 COMMISSIONERS AS THE COMMISSION FOR CALIA. THEY'RE ALL VOLUNTEERS. SO THOSE 21 COMMISSIONERS ARE CITY MANAGERS, MAYORS, SUPREME COURT JUSTICES, THE MURDOCH TRIAL THAT'S GOING ON. THE, THE RETRIAL THING. THAT LADY THAT'S UP THERE, THE LITTLE, SHE'S A REAL CARD. SHE'S A SOUTH CAROLINA RETIRED CHIEF JUSTICE OF THE SUPREME COURT THERE. THAT'S A FORMER COMMISSIONER. SHE JUST WENT OFF THE COMMISSION LAST YEAR. THOSE ARE THE COMMISSIONERS THAT WRITE THE STANDARDS. SO THEY STILL APPOINT ALL THE, THE FOUNDING ORGANIZATIONS APPOINT THOSE COMMISSIONERS TO OVERSEE ME. SO THEY KEEP ME IN ORDER. THAT'S HARD TO DO. SO WITH THAT SAID, EACH YEAR WE ISSUE NEW STANDARDS AND WE CONTINUALLY REWRITE AND KEEP UP IN LAW ENFORCEMENT. IF YOU REMEMBER THE 21ST CENTURY POLICING CAME OUT AS ALL THE, THE THINGS THAT COME OUT SAY YOU GOTTA DO THIS AND YOU SHOULD DO THAT. WE DIDN'T WORRY ABOUT IT BECAUSE THESE AGENCIES WERE ALREADY DOING IT. 'CAUSE WE ALREADY HAD STANDARDS OF ADDRESSING IT. WE DIDN'T HAVE TO SAY, HEY, NOW YOU GOTTA JUMP IN HERE AND YOU GOTTA DO THIS, YOU GOTTA DO THAT. NAH. WE HAD THE STANDARDS ALREADY IN PLACE WELL BEFORE THAT AND THEY WERE ALREADY DOING IT. SO THIS AGENCY THAT I'M GETTING READY TO PRESENT THIS WARD TO, THIS IS GONNA BE THEIR FIFTH AWARD. THEY STARTED IN WHAT'S CALLED A RECOGNITION PROGRAM FOR THREE YEARS. SO THAT MEANS THEY STARTED THREE YEARS BEFORE THAT. AND I THINK THAT WAS IN 2006. AND SO THEY'VE BEEN DOING IT A WHILE AND WE'VE TALKED BEFORE. WHEN THEY FIRST STARTED, I DON'T THINK HE AGREED WITH IT 'CAUSE IT WAS SOMETHING NEW. THAT'S WHAT COPS THINK. SOME NEW THING. YOU CAN'T BE DOING THAT. BUT AS IT STARTS AND HE SEES WHAT'S GOING ON AND THE FORMER CHIEF SEES WHAT'S GOING ON, AND THEY START PUTTING THE NEW POLICIES IN AND THINGS START ROLLING ALONG. NOW THIS IS THEIR FIFTH ONE. THE NEW PEOPLE THAT COME IN HERE DON'T KNOW ANYTHING DIFFERENT. THIS IS, THIS IS THEIR LIFE. THEY KNOW WHAT CLEA IS. THEY KNOW WHAT IT'S FOR. THEY KNOW WHAT THE VALUE IS FOR IT. SO THEY INSTILL THAT WITHIN THE AGENCY AND THAT'S WHAT MAKES THIS POLICE DEPARTMENT SO GOOD. LIKE I SAID, IT'S THEIR FIFTH ONE. IF I CAN, I'D LIKE TO READ THIS, UH, PLAQUE AND THEN WILL PRESENT [00:20:01] TO THE CHIEF. I'LL PUT MY EYES ON . IT SAYS MICROPHONE. WE WANT THE WHOLE WORLD TO HEAR THIS. THERE YOU GO. I DO TOO. BE IT. HEREBY KNOWN THAT THE LEANER TEXAS POLICE DEPARTMENT HAVING FULLY DEMONSTRATED ITS VOLUNTARY COMMITMENT TO LAW ENFORCEMENT EXCELLENCE BY GIVING UP TO A BODY OF STANDARDS DEEMED ESSENTIAL TO THE PROTECTION OF THE LIFE, HEALTH, SAFETY, AND RIGHTS OF THE CITIZENS IT SERVES. AND HAVING EXEMPLIFIED THE BEST PROFESSIONAL PRACTICES IN THE CONDUCT OF ITS RESPONSIBILITIES IS HEREBY UPON THE RECOMMENDATION THAT THE MEMBERS OF THE COMMISSION AWARDED THE CERTIFICATE OF ACCREDITATION EFFECTIVE ON THE 21ST DAY OF NOVEMBER, 2023, AND IS RECOGNIZED AS AN ACCREDITED LAW ENFORCEMENT AGENCY FOR THE NEXT PERIOD OF FOUR YEARS. THIS IS THEIR FIFTH AWARD. CONGRATULATIONS CHIEF. EVERYBODY READY? THANK YOU. SO SAY SOMETHING REAL QUICK. I'LL WAIT UNTIL THEY GET BACK UP. GOOD MORNING. WELCOME. THANK YOU. THANK YOU. APPRECIATE IT. I'M GONNA, YOU WANNA RECOGNIZE HER REAL QUICK? HEY, STEPHANIE. STEPHANIE. STEPHANIE, YOU AIN'T LEAVING YET. , HUH? I KNOW HOW YOU WANNA TALK, HUH? NO, I'LL MENTION ONE THING. OKAY. WE'RE DONE. OKAY. YES, THERE WAS A WHOLE LOT OF WORK THAT WENT INTO THIS. YES. CHIEF, YOU WANNA TELL US A LITTLE? YEAH. SO I'D LIKE TO INTRODUCE YOU TO STEPHANIE HAYES. SHE'S THE BRAINS OF THE OPERATION. RIGHT BEHIND THAT AND, AND ACCREDITATION MANAGER ARE SPECIAL PEOPLE BECAUSE THEY HAVE TO TRY TO, UH, WORK BETWEEN THE CHIEF'S OFFICE AND ALL THE OTHER OFFICES AND, AND OFFICERS THROUGH, UH, THROUGH THIS WHOLE ENTIRE PROCESS. BUT SHE COMES, SHE, SHE KNOWS SHE'S GONNA HATE THAT I'M EVEN DOING THIS, BUT I, I, YOU GOTTA KNOW WHO SHE IS BECAUSE SHE HAS PUT IN SO MUCH TIME WORK AND EFFORT, UH, TO MAKE THIS HAPPEN. BECAUSE, YOU KNOW, IT, IT, IT IS A LOT OF WORK. IT'S A LOT OF THE DIFFERENT POLICIES THAT WE HAVE, THE STANDARDS THAT HAVE TO BE FOLLOWED, THE PROOFS THAT GO BEHIND THAT, AND JUST THE FACT THAT SHE CAN COMMUNICATE WITH OFFICE STAFF AND, AND OFFICERS THAT TO, TO HELP REITERATE THE IMPORTANCE OF WHAT THEY DO. NOT ONLY THAT, BUT WITH THE, WITH THE STANDARDS AND WHEN THE PROOFS THAT WE GET FOR THE WORK THAT THEY ACTUALLY DO TO SHOW THAT, THAT, UH, YOU KNOW, THAT WE'RE DOING WHAT WE'RE SEEING WE'RE DOING. AND I JUST WANNA THANK YOU, UH, FOR MEETING YOU FOR ALL THE WORK YOU DO. I KNOW YOU'RE THE, THE SILENT HERO IN THERE, BUT I, I COULDN'T THINK OF A BETTER PERSON TO DO THIS JOB. AND, AND YOU CAME IN KIND OF AT A, AT A, AT A POINT WHERE IT WAS JUST HAVING TO PICK IT UP AND RUN AND GO AND YOU ABSORBED IT IN LIKE A SPONGE. SO THANK YOU SO FOR DOING THAT. YES. AND RANDY, YOU HAD, I HAVE TO, UH, GO ON HIS SIDE AND SAY, THERE'S A GENTLEMAN IN THIS ROOM THAT WROTE A, AN ARTICLE ABOUT KALIA THAT DID A LONG RESEARCH PAPER. HE'S WITH THE UNIVERSITY OF TEXAS AT, UH, IN AUSTIN HERE. AND IN THAT ARTICLE AND ALL THE RESEARCH HE DID FROM TALKING TO AGENCIES ACROSS THE COUNTRY, HE ACKNOWLEDGES THAT THIS IS THE BACK BACKBONE OF THE POLICE DEPARTMENTS THAT DO THIS VOLUNTARILY. IT'S A VOLUNTARY PROCESS FOR POLICE DEPARTMENTS TO DO IT. WE DON'T FORCE 'EM TO DO IT. IT'S A VOLUNTARY PROCESS. SO THIS IS THE BACKBONE, IS THE ACCREDITATION MANAGERS, WHICH I DEAL WITH ON A DAILY BASIS, SO I KNOW WHAT THEIR VALUE IS. THANK YOU SO MUCH FOR WHAT YOU DO. THANK YOU. APPRECIATE IT. THE ARTICLE WAS WRITTEN BY PROFESSOR GORDON ABNER. HE'S SIT STANDING IN THE BACK OF THE ROOM. I INVITED YOU TO BE HERE. YEAH, EXCELLENT. EXCELLENT ARTICLE. YOU GET A CHANCE TO READ IT. THANK YOU ALL SO MUCH. IT'S JUST ONE MORE REASON WHY WE HAVE THE [00:25:01] VERY BEST POLICE DEPARTMENT AROUND. ALL RIGHT. MORE FOR ITEM NUMBER SEVEN, NON AGENDA ITEM, PUBLIC COMMENTS. FOR ITEMS ON THE AGENDA, I WILL CALL ON SPEAKERS PRIOR TO THE DISCUSSION OF THE AGENDA ITEM AND DURING THE PUBLIC HEARING, INDIVIDUALS THAT SUBMITTED COMMENTS VIA THE WEBSITE WILL ONLY HAVE POSITIONS READ INTO THE RECORD. ANY WRITTEN COMMENTS HAVE BEEN SHARED WITH COUNSEL AND WILL BE MADE A PART OF THE OFFICIAL RECORD. IT'S IMPORTANT TO NOTE THAT PUBLIC COMMENTS IS A TIME FOR YOU TO TALK TO US, BUT WE CANNOT HAVE CONVERSATIONS BACK WITH YOU. THAT WOULD BE DELIBERATION. AND SO THE STATE OF TEXAS PROHIBITS IT. WITH THAT, I HAVE TWO PEOPLE SIGNED UP TO SPEAK. FIRST IS JAMES DEAN. GOOD EVENING, MR. DEAN. PLEASE GIVE YOUR NAME AND ADDRESS. YOU'LL HAVE THREE MINUTES. THANK YOU. MY NAME IS JAMES DEAN. I LIVE AT 25 13 COSTA DEL SOUL, LEANER, TEXAS. UH, 7 8 6 4 1. UH, I WANT TO ECHO THE COMMENTS ABOUT OUR POLICE FORCE. UM, WE RECENTLY HAD A COUPLE OF FAMILY MEDICAL EMERGENCIES AT OUR HOUSEHOLD. AND, UM, THE EMTS, THE FIRE DEPARTMENT, THE POLICE, UH, POLICE PEOPLE, UM, WERE EXTRAORDINARILY FRIENDLY. UH, VERY KIND, VERY GENEROUS, UM, WONDERFUL YOUNG PEOPLE. ALL OF US IN LEANDER SHOULD BE VERY, VERY PROUD OF THEM. UM, AND, AND I, I WAS, MY FAMILY AND I, WE WERE VERY THANKFUL, UH, FOR THEIR PROFESSIONALISM AND THEIR GENEROSITY WHEN THEY CAME TO OUR HOME. UM, I DO WANT TO MENTION HAPPY WOMEN'S HER STORY MONTH. UM, AND I'M HAPPY THAT WE HAVE SO MANY WOMEN ON THE DIOCESE. UM, WE'RE HAPPY THAT WE HAVE SO MANY WOMEN IN LEADERSHIP AND SERVICE POSITIONS IN LEANDER, AND THAT YOU'RE DOING SUCH INCREDIBLE WORK. UM, LEANDER IS GROWING BY LEAPS AND BOUNDS AND CONTINUES TO, UH, SET RECORDS AND, AND ALL THAT'S GOING ON IN CENTRAL TEXAS. UM, AND WE ARE VERY HAPPY AND VERY PROUD AND VERY PLEASED WITH WHAT YOU'RE DOING. AND YOU'RE DOING ALL OF THAT AND KEEPING OUR TAXES LOW, WHICH EVERYONE LOVES. SO WE APPRECIATE YOUR SERVICE. WE DO WANT TO, UH, RECOGNIZE YOU AS, AGAIN, PART OF WOMEN HER STORY MONTH. AND AGAIN, SALUTE YOUR SERVICE. AND THANK YOU FOR, UM, RUNNING FOR REELECTION. WE LOOK FORWARD TO THE UPCOMING CAMPAIGN SEASON AND WISH EVERYONE BEST. THANK YOU. THANK YOU, MR. DEAN. UP NEXT IS SCOTT HOYT. GOOD EVENING. MR. HOYT. PLEASE GIVE YOUR NAME AND ADDRESS. YOU HAVE THREE MINUTES. MY NAME IS SCOTT HOYT, UH, 42 0 8 OAK CREEK ROAD, LANDER, TEXAS 7 8 6 4 1. UH, I WANT TO THANK, UH, THE PASTOR FOR HIS PRAYER. THAT WAS JUST FANTASTIC AND FOR BRINGING GOD INTO THIS. THANK YOU, UH, FOR THOSE OF YOU THAT ARE BELIEVERS, UM, THAT WAS AMAZING TO WATCH. SO, UH, QUICK, QUICK POINTS. UM, IF YOU DON'T MIND, I'LL JUST READ WHAT I BROUGHT. OKAY. UM, LEANDER LAWN SERVICE HAS BEEN ESTABLISHED IN A BUSINESS OPERATION SINCE 2021. LEANDER LAWN SERVICE PRESIDES, UH, GENERALLY RUNS A NINE MONTH COURSE FOR SERVICES DURING THE GROWING SEASONS OF MARCH AND SEPTEMBER. UH, DURING THIS TIME PERIOD, IT IS CRUCIAL TO SERVICE ALL BUSINESS ACCOUNTS TO MEET OPERATIONAL COST REQUIREMENTS AND SAVE ACCORDING FOR BUSINESSES COSTS THAT WILL STILL BE OCCURRING DURING THE NON-GROWING OFF SEASON. UH, WE ARE NOT ONLY SPEAKING ON OUR BEHALF, BUT FOR THE OTHER LOCAL BUSINESS OWNERS AND OUR CUSTOMERS. WATER RESTRICTIONS HAVE PRE PREVIOUSLY INTERFERED AND ARE PRESENTLY INTERFERING WITH BUSINESS OPERATIONS. UH, LAWN CARE BUSINESS OWNERS IN THIS COMMUNITY NEED YOUR SUPPORT. UM, OUR STATEMENTS, UH, TRY TO ORGANIZE THESE AS BEST I COULD. NO WATER RESTRICTIONS FOR RE UH, RESIDENTIAL OR COMMERCIAL CUSTOMERS THAT ARE CHOOSING TO HAVE A PROFESSIONAL LAWN CARE SERVICE PROVIDER, UH, TO MAINTAIN THEIR PRIVATE RESIDENCE. UH, THIS SHOULD BE FOR WEEKLY AND BIWEEKLY CUSTOMERS ONLY. UH, MONTHLY SERVICE IS NOT CONSIDERED A PRO PROLONGED SERVICE. SO, PROFESSIONAL LAWN CARE SERVICES ARE COMPANIES, UH, THAT ARE IN CURRENT AND LEGAL BUYING CONTRACTS WITH THEIR RESIDENTIAL AND COMMERCIAL ACCOUNTS. A WATER REDUCTION RATE OF 30% IS RECOMMENDED FOR THESE CUSTOMERS. UM, AN UPDATE IN YOUR NOTIFICATIONS, UH, RESIDENTIAL CUSTOMER, RESIDENTIAL, COMMERCIAL AND BUSINESS COMPANIES THAT ARE IN LEGAL BINDING CONTRACTS MUST BE AN EXCEPTION. THIS SHOULD BE MADE CLEAR AND THE REASON SHOULD BE STATED. UH, SOME OF THOSE REASONS ARE LEGAL IMPLICATIONS. THAT'S JUST ONE OF THEM. OUR SERVICE CONTRACTS, TERMS AND CONDITIONS OF PAYMENT DO NOT COVER PHASE THREE OR PHASE FOUR WATERING RESTRICTIONS. NOR CAN THEY, WE ARE UNABLE TO COLLECT PAYMENTS FOR SERVICES BECAUSE WE CANNOT RENDER SERVICE WHEN PHASE THREE OR FOUR WATER RESTRICTIONS ARE BEING IMPLEMENTED. BREACH OF CONTRACTS AND MING BILLING CYCLES [00:30:01] ARE AN ISSUE. HIRING INTERFERENCE AND EMPLOYEE COMPENSATION START DATES, ADVERTISING MAILERS AND MARKETING AND FINANCIAL LOSSES, P AND L SHEETS, MONTHLY EARNINGS, LOSS OF SALES FROM EXISTING AND POTENTIAL NEW CLIENTS ARE CLOSING QUESTIONS. WHAT IS THE LEGAL DEFINITION OR CAN IT BE DEFINED IN LEGAL TERMINOLOGY? WHAT WE ARE CONTINUING, CONTINUING TO EXPERIENCE IN OUR BUSINESS COMMERCE, CUSTOMER FINANCIAL RESTITUTION. WE ARE SEEING HUNDREDS OF TREES AND LAWS THAT ARE BEING DAMAGED AND HAVE SUFFERED COMPLETE DEVASTATION COSTING HUNDREDS AND IN SOME CASES THOUSANDS OF DOLLARS IN REAL ESTATE LOSSES. WHAT IS THE CITY'S RECOURSE, IF ANY, FOR THIS FINANCIAL RESTITUTION? WHAT IS THE CITY'S RECOURSE, IF ANY, FOR FINANCIAL RESTITUTION FOR COMPANIES THAT HAVE SUFFERED FINANCIALLY OVER THE LAST 36 MONTHS OF CONTINUED WATER RESTRICTIONS? IS THE CITY KNOWINGLY RESTRICTING OR BUSINESS CON? I GUESS I LOST IT. THAT'S THE THREE MINUTES. THANK YOU MR. HOY, WE APPRECIATE YOU. UM, THERE'S NOBODY ELSE SIGNED UP TO SPEAK AT THIS TIME. WAS THERE ANYBODY ELSE WHO WISHED TO SPEAK? ALL RIGHT, WE'RE GONNA MOVE ON TO ITEM NUMBER [8. Staff ReportWater Update] EIGHT, STAFF REPORT. WE HAVE A WATER UPDATE WITH EXECUTIVE DIRECTOR OF INFRASTRUCTURE G GRIMS, BO AND PUBLIC WORKS DIRECTOR ELLISON. GOOD EVENING. GOOD EVENING, MAYOR COUNCIL. DAN VILLE, EXECUTIVE DIRECTOR OF INFRASTRUCTURE FOR THE CITY OF LEAN. AND YES, WE'LL, WE'RE GONNA BE TALKING ABOUT THE, UH, BCRA PIPELINE, UH, PHASE FOUR UPDATES AND THE EMERGENCY BARGE THAT, UH, IS BEING ASSEMBLED RIGHT NOW, UM, IN PREPARATIONS OF, UH, OF A DRY HOT SUMMER THAT WE DON'T NEED OR WANT. SO LET ME, UH, GO AHEAD AND PROCEED. ALRIGHT. UM, THERE IT IS. I WAS GONNA SAY, UH, THAT'S NOT THE FIRST SLIDE. SO THIS IS A REMINDER. WHAT WE'RE TRYING TO DO IS THAT THE PIPELINE REPLACEMENT IS, UH, IS IN THE, IS THE BLUE LINE THAT YOU SEE ABOUT 1400 LINEAR FEET THAT'S BEING PLACED IN THE MIDDLE OF THE, UH, OF THE LAKE. IT'S ABOUT 40 OR 50 FEET DEEP, AND IT'S A 36 INCH, UH, DUCTILE IRON THAT'S BEING REPLACED WHILE WE'RE REPLACING IT IS BECAUSE THE, UH, INITIAL, UM, STRUCTURES TO HOLD THE PIPE IN PLACE, UM, WERE INADEQUATE. AND, AND THE PIPE LITERALLY, UH, UM, CAME APART IN ONE SECTION AS WE KNOW A COUPLE TIMES. AND OTHER SECTIONS WERE, UM, PROBABLY NOT MUCH BETTER. SO, UM, AS YOU ALL KNOW, WE TOOK ACTIONS TO LOWER THE AMOUNT OF PRESSURE AND SO FORTH, AND A LINE TO TILL WE COULD GET A PERMANENT, UM, REPAIR DONE. SO, UM, THIS IS THE CONDITION THAT WE'RE IN RIGHT NOW. NORMALLY WE HAVE 24 TO 25 MILLION GUNS A DAY. WE'RE LIMITED TO SANDY CREEK. 'CAUSE THE BCRS, THAT WALL WATER LINE IS DOWN FOR THE 30 DAYS. UM, YOU CAN SEE THE, THE, THE DUCTILE IRON THAT'S BEING REPLACED ON IN THAT, UH, THE LAKE BOTTOM RIGHT THERE. UM, EACH STICK PROBABLY WEIGHS ABOUT 25 TO 3000 POUNDS THAT THEY'RE, THEY'RE TRYING TO, TO, UH, MANHANDLE IN PLACE. SAY AGAIN? YEAH, THIS IS NOT THE CORRECT ONE BECAUSE I WAS GONNA SAY, YOU THREW ME OFF. SO, SO IT'S OKAY. WE EDIT IT. I WAS GONNA SAY THE, THE NEXT SLIDE IS SUPER IMPORTANT AND THEY'RE ALL IMPORTANT ON YEAH, THAT'S ALL. THAT'S ALL RIGHT. SO RIGHT NOW I CAN'T KEEP TALKING, IS THAT THEY, UH, THEY'RE ON TRACK. UM, THEY'VE ACTUALLY MADE, UH, ONE CONNECTION BY THE MANIFOLD, WHICH I'LL SHOW A DRAWING OF THAT. AND, UM, THEY'RE IN THE PROCESS OF, UH, WORKING ON THE OTHER END OF THE CONNECTION. AND IF THINGS GO THE WAY THEY'RE SUPPOSED TO BE GOING, UM, WE'LL BE FINISHED ON TIME, WHICH IS GREAT. UM, THE LAND, THE LAND VALVES ARE PRETTY MUCH BEEN ALL REPLACED EXCEPT FOR ONE AS THE AIR RELIEF VALVES, UM, WHICH WERE, UM, IN PARTICULARLY BAD SHAPE. SO IT TOOK FULL ADVANTAGE OF THE SHUTDOWN AND REPLACE ALL 24 VALVES, UM, UM, WHICH WAS GREAT. UH, THANK YOU. YOU'RE NOW I'M, I'M, I'M BETTER NOW. YES, SIR. ALL RIGHT. SO THE FIRST SLIDE, THAT'S WHAT THREW ME OFF. SEE, IS THIS, THIS THE SAME, THIS IS WHAT I WAS LOOKING FOR. SO THIS IS THE BARGE THAT WAS PUTTING IN, UM, THE, UH, THE STRUCTURES, UM, THAT WE HAVE NOW. THEY'RE ACTUALLY PUTTING 'EM DOWN LIKE 30 FEET IN A ROCK BED. AND THEN WITH CONCRETE, YOU'LL SEE A DRAWING OF THAT HERE IN A MINUTE. UM, MUCH MORE, UH, IMPRESSIVE STRUCTURES TO HOLD THE PIPE IN PLACE. SO THIS, THIS IS, UH, THE RENDERING OF WHAT'S, WHAT'S BEING DONE. THIS IS THE PIPE THAT'S BEING REPLACED, UM, 1400 LINEAR FEET. AND THIS IS THE MANIFOLD THAT'S BEING CONNECTED DOWN HERE. YOU CAN SEE THAT THE ONE GRAY AREA BEHIND IT IS THE PIPE THAT WAS ACTUALLY REMOVED. HERE'S THE OLD PIPE. AND WE REMOVED THIS SECTION OF IT. SO WE COULD ADD THIS SECTION OF IT. THIS IS THE TOP VIEW OF THE PIPE. AND THEN YOU CAN SEE, UH, THE, THE SUPPORT MECHANISMS THAT [00:35:01] ARE HOLDING THE PIPE IN. UM, THIS IS THE OTHER SIDE. NOW, SAME THING. HERE'S THE ORIGINAL PIPE AND HERE'S THE REPLACEMENT, UM, PIPE COMING IN AND THEN CONNECTING, UM, AT THE, UH, TRAILS IN ROAD IN THAT SECTION. AND THEN YOU CAN SEE THE GRAY AREA WAS TAKEN OUT. NOW JUST THE GRAY AREA SECTIONS WERE ACTUALLY PHYSICALLY REMOVED FROM THE LAKE BOTTOM, BUT THE REST OF THE PIPE WILL REMAIN THERE. THIS IS, UM, THE STRUCTURES THAT ARE ACTUALLY, WERE, WERE PUT IN AND SHOULD HAVE BEEN PROBABLY THE FIRST ONE. BUT THESE ARE H PILES THAT WERE DRIVEN PROBABLY ABOUT 30 FEET WITH A CONCRETE STRUCTURE, UM, BUILT ON THE TOP TO HOLD 'EM IN PLACE. THAT IS NOT WHAT WAS THERE BEFORE. UM, SO, UM, MUCH, MUCH BETTER, UM, UH, DESIGN AND STRUCTURE TO HOLD IT ALL IN PLACE. THIS IS THE, THE TIMELINE, UM, FOR MAKING THE REPAIRS. UM, THE YELLOW SECTION IS WHAT WE'RE CURRENTLY DOING, UH, TODAY. THE BEFORE IS WHEN WE STARTED. UM, YOU CAN SEE WE STARTED EVEN BEFORE. UM, WHEN IT SAYS THERE NINE, UM, 23, WE, WE ACTUALLY PRE-ORDERED ALL THE PIPING BACK IN APRIL. UM, IT JUST TOOK THAT LONG TO FACILITATE, UM, GETTING HERE. AND THEN THEY'LL FINISH UP THE, UH, UM, PUNCH LIST ITEMS, UM, UM, BEFORE, UH, SUMMER STARTS. BUT THE YELLOW SECTION IS ON TRACK. AND NOW I WILL TURN IT OVER TO CHIEF STAFF. THANK YOU, DAN. GOOD EVENING, MAYOR AND COUNCIL OVER HERE. UH, MIKE, NEW CHIEF OF STAFF. UM, MY UPDATE IS REALLY ABOUT WHAT WE'RE DOING TO, UM, INFORM AND ENFORCE, UH, ON CURRENT PHASE FOUR CONDITIONS. WE CAME TO YOU LAST TIME IN OUR LAST MEETING AND PRESENTED, UM, SOME OF THE METHODS AND ACTIONS THAT WE'D BE TAKING DURING PHASE FOUR. UM, THINGS THAT WE HAD INITIATED, THINGS WE WERE PLANNING, THINGS THAT AT THIS POINT ARE UNDERWAY. ONE OF THESE IS, IS SORT OF OUR OTHER COMMUNICATIONS. ASIDE FROM USING OUR STANDARD CHANNELS AND, AND METHODS, WE'VE, UH, ATTENDED A NUMBER OF MEETINGS. IN FACT, OUR COMMUNITY ENGAGEMENT MANAGER WAS PARTICIPATING IN A VIRTUAL MEETING TONIGHT, UM, TO TALK TO MASON HILLS, HOA ABOUT PHASE FOUR AND QUESTIONS THAT THEY HAD. AND WE'LL RECAP SOME OF THAT TOMORROW AND IDENTIFY SOME THINGS WE MAY BE ABLE TO ADD TO OUR WEBSITE. AS FAR AS FREQUENTLY ASKED QUESTIONS, UM, WE ARE WORKING WITH, UM, OUR CHAMBER. WE'RE WORKING WITH THE HOME BUILDERS ASSOCIATION TO KEEP THEM INFORMED AND ANSWER THEIR QUESTIONS. AND OF COURSE, LANDER, IST, AGAIN, BEEN VERY STRONG AND ENGAGED, PARTNER ON ALL THINGS RELATED TO, UH, WATER CONSERVATION. WE CONTINUE TO HAVE THESE SIGNS POSTED HERE ON ALL OF OUR FACILITIES. WE WILL LEAVE THOSE UP AS LONG AS PHASE FOUR IS IN EFFECT. SO FOLKS COMING INTO OUR BUILDING TO CONDUCT BUSINESS SHOULD SEE THOSE AS SOON AS THEY OPEN THE DOORS. UM, REAL QUICKLY, I'LL RECAP. WE'VE COVERED THIS IN THE LAST PRESENTATION ABOUT HAZARDS AND THREATS. WHAT ARE SOME OF THE WORST CASE SCENARIOS? THOSE THREE BULLETS, UM, KIND OF COVER THAT WE'RE STILL MAINTAINING THAT CONTINGENCY PLANNING AND OUR, UH, EMERGENCY MANAGEMENT TEAM IS, IS HERE TO ASSIST IF YOU HAVE ANY QUESTIONS ON THAT. BUT, UM, SOME OF THE THINGS THAT WE SAID WOULD BE HAPPENING HAVE HAPPENED. WE'VE, UH, INFORMED OUR, OUR STATE RESOURCES AND THOSE OFFICIALS THAT ARE IN CHARGE ABOUT OUR CONDITION AND THINGS THAT MIGHT BE ACTIVATED SHOULD WE, UH, ENCOUNTER ONE OF THOSE HAZARDS. UM, WE'RE, I, WE'VE ALREADY IDENTIFIED SOME DISTRIBUTION SITES, WHAT THE EQUIPMENT NEEDS WOULD BE FOR THOSE SITES AND HOW WE MIGHT NAVIGATE, UH, FOLKS IN AND OUT OF THOSE LOCATIONS. AND THEN OF COURSE, OUR, OUR CITY DEPARTMENTS ARE, ARE MEETING, UH, VERY FREQUENTLY TO, TO MONITOR THE CONDITIONS AND THEN IDENTIFY ANY ADDITIONAL ACTIONS THAT WE MAY NEED TO TAKE. WE DID SEND OUT AN EMERGENCY ALERT ON MONDAY, FEBRUARY 26TH, NOTIFYING THE PUBLIC THAT, UM, THIS IS A POINT OF NO RETURN, ESSENTIALLY, THAT SOME OF THE INTENSIVE WORK WOULD START THE PLANT. THE BCRA PLANT, UH, IS SHUT DOWN AND IT WAS SHUT DOWN ON MONDAY, MEANING THAT, UH, WE REALLY WANTED PEOPLE TO TAKE NOTICE THAT, UM, THE THINGS THAT THEY HAD BEEN DOING LEADING UP TO THAT POINT, UH, WERE REALLY, AND, AND THEY'VE MATTERED EVER SINCE, BUT THEY WOULD REALLY MATTER AT THIS POINT BECAUSE WE REALLY CAN'T GO BACK UNTIL THIS IS FULLY REPAIRED. SO, UM, IT GAVE US CAUSE TO ISSUE ANOTHER MASS NOTIFICATION. YOU SEE THE NUMBER OF CONTACTS POTENTIALLY WE WOULD BE REACHING WITH THAT NOTIFICATION. AGAIN, THAT'S OVER 50,000 CONFIRMED, BUT A LOT OF, A LOT OF THOSE FOLKS HAVE MULTIPLE ACCOUNTS, INCLUDING MYSELF. SO, UM, COUNCIL MEMBERS, YOU PROBABLY RECEIVED SEVERAL DIFFERENT VERSIONS OF OUR MESSAGE AS WELL. UH, WE DO LIMIT THESE TYPES OF NOTIFICATIONS TO CRITICAL POINTS, UH, IN OUR TIMELINE, LIKE THE SHUTDOWN OF THE BCRA PLANT. IF WE WERE TO ENCOUNTER ANY NEGATIVE SETBACKS, I DON'T THINK WE WILL. BUT IF WE DID, UH, THAT WOULD BE CAUSED TO UTILIZE THIS MASS NOTIFICATION SYSTEM, AGAIN, OUR ENFORCEMENT. NOW WHAT I'M SHOWING HERE IS WHAT WE, UM, HAD TALLIED BY THE END OF LAST WEEK. UM, TODAY YOU RECEIVED, UH, AN EMAIL [00:40:01] UPDATE OF LAST WEEK'S DATA. WHAT YOU'RE SHOWING, WHAT YOU'RE SEEING HERE ARE TWO WEEKS PRIOR DATA COLLECTED BY CODE ENFORCEMENT AND PUBLIC WORKS TEAMS, UH, WORKING TOGETHER IN THE WEE HOURS OF THE MORNING TO IDENTIFY POTENTIAL VIOLATIONS. UM, I WILL SAY, AND I CAN GIVE THESE NUMBERS TO YOU, THEY ARE IN YOUR, YOUR EMAIL. UH, AND WE WILL REFLECT THIS AGAIN IN IN A SUBSEQUENT REPORT IN OUR NEXT COUNCIL MEETING. UH, LAST WEEK'S NUMBERS, WE HAD 149 VIOLATIONS, 149, UH, FIRST VIOLATIONS, AND THEN ABOUT SIX ADDITIONAL SECOND VIOLATIONS. WE'RE STILL IN SINGLE DIGITS WITH SECOND VIOLATIONS. UM, BASED ON, UM, WHAT CHIEF DAVIS HAS HAS TOLD ME AS OF TODAY, WE'VE GOT PROBABLY ANOTHER A HUNDRED FIRST VIOLATIONS THAT WE'LL BE ADDING TO THIS REPORT NEXT WEEK. SO WE ARE COVERING AS MUCH GROUND AS WE CAN, UM, IN YOUR REPORT THIS WEEK, WHICH WILL REFLECT AGAIN, CUMULATIVELY IN OUR NEXT UPDATE TO COUNSEL. THESE VIOLATIONS ARE OCCURRING KIND OF ALL OVER. SO OUR EFFORTS TO TRY AND, UH, SPAN THE ENTIRE COMMUNITY TO MAKE SURE THAT WE'RE ENFORCING, UH, ON EQUAL, UH, FOOTING FOR ALL OF OUR CUSTOMERS IS, IS CONTINUING. AND IT'S, IT'S, IT'S SOAKING UP A LOT OF HOURS, NO PUN INTENDED, BUT, UM, IT IS HAVING AN IMPACT AND WE ARE ABLE TO GET THAT MESSAGE IN A DIFFERENT WAY. JUST ON THE ENFORCEMENT SIDE. UM, ONE, I WILL SAY THAT ONE THING OUR ENFORCEMENT TEAM CONTINUES TO DO WITH THOSE FIRST VIOLATIONS IS, YES, WE'RE ISSUING COURTESY NOTIFICATIONS, BUT WHEN WE'RE ABLE TO ENGAGE CUSTOMERS ON A ONE-ON-ONE BASIS, WE'RE PROVIDING THAT EDUCATION AND INFORMATION. WE DON'T THINK THAT THERE'S AS MUCH OF A, WE DIDN'T KNOW THERE WAS A PHASE FOUR CONDITION WE THINK A LOT OF CUSTOMERS KNOW. UM, WE'RE JUST HAVING THOSE ADDITIONAL FOLLOW UP CONVERSATIONS WITH THEM NOW, WEBSITE AND SOCIAL MEDIA. UH, SOME UNIQUE THINGS I WANTED TO POINT OUT HERE. UM, WE DO HAVE, UH, PARTNERSHIP WITH GEORGETOWN AT THIS POINT WHERE WE ARE, UH, UTILIZING, UH, GEORGETOWN WATER INFRASTRUCTURE TO SUPPORT RANCHO SIENNA AND LIVELY RANCH CUSTOMERS RIGHT NOW. IT IS TEMPORARY AND WE DID PROVIDE NOTICE TO THOSE RESIDENTS ABOUT THAT CONDITION. OUR STATEMENT TO THOSE RESIDENTS, AND WE'LL CONTINUE TO SHARE THIS WITH THEM, IS, UM, THEY STILL NEED TO BE SUBJECT TO OUR WATER EMERGENCY CONDITIONS. THAT IS A CONDITION OF GEORGETOWN'S PARTNERSHIP. SO WE ARE EXPECTING THAT, UM, THAT COMPLIANCE WITH OUR PHASE FOUR ORDINANCES, BUT IT IS PROVIDING SOME RELIEF, UH, THAT, AND GINA CAN COME SPEAK AND ELABORATE ON THAT A LITTLE BIT, BUT IT IS PROVIDING SOME RELIEF WHERE WE THINK IT WILL JUST GIVE US MORE FLEXIBILITY TO MANAGE OUR SYSTEM DURING THIS TIME. UM, WE ARE CONTINUING TO UPDATE AS WELL OUR, UH, PIPELINE REPAIR PROJECT, AND WE'LL INCLUDE THIS PRESENTATION, UH, ON THAT PAGE AS WELL AS OUR PHASE FOUR PAGE TOMORROW WHEN WE CAN BOOKMARK SOME OF THE VIDEO, UM, MATERIALS, UH, ONLINE, WHAT YOU SEE ON THE RIGHT HAND SIDE, JUST A DOCUMENT, DAILY DOCUMENTATION OF THE WATER USE. AND, AND THESE ARE GREAT, GREAT NUMBERS TO SEE. RIGHT NOW WE'VE BEEN AVERAGING BETWEEN FIVE AND SIX. THIS IS ABOUT A WEEK BEHIND. WE'RE SEEING SOME REALLY, REALLY STRONG NUMBERS. WHAT I WANTED TO POINT OUT TOO, AND THIS IS SOMETHING GINA WILL HIGHLIGHT, IS, UM, SOME OF THE THINGS WE'RE DOING ON THE SYSTEM SIDE THAT WE WANT TO BE TRUE TO OUR CUSTOMERS AND HOW WE'RE REFLECTING THEIR USAGE. SO WE ARE DOING SOME THINGS ON OUR SIDE TO MAKE SURE WE'RE MAINTAINING OUR SYSTEM BECAUSE IF WE DO GET CONSISTENTLY LOW USAGE, UM, WE DO HAVE TO DO SOME OTHER, TAKE SOME OTHER ACTIONS TO MANAGE OUR SYSTEM. AND GINA WILL TALK ABOUT THAT IN A MINUTE. BUT, UM, WE ARE GETTING, CONTINUING TO GET A GOOD RESPONSE. WE'RE GETTING COMPLIANCE, CUSTOMERS ARE AWARE, WE JUST WANNA MAINTAIN THAT AND WE'LL CONTINUE TO TRY TO, UH, ENGAGE CUSTOMERS AS, UH, AND, AND VARY THAT MESSAGING A LITTLE BIT SO THAT THEY STAY INFORMED AND STAY ENGAGED WITH, WITH WHAT WE'RE DOING. THANK YOU. UH, GINA ELLISON, PUBLIC WORKS DIRECTOR. UM, AS MIKE MENTIONED, UM, OBVIOUSLY WE'RE MONITORING OUR USAGE DAILY, HOURLY MOSTLY. UM, BUT, BUT EVERY DAY WE UM, SEND OUT THE NUMBERS AND AS MIKE MENTIONED, WE'VE BEEN CONSISTENTLY UNDER THAT 9 MILLION MARK HERE. UM, ON THE SLIDE PREVIOUS, UH, HE POINTED OUT THE STATE, UM, IN PARTICULAR, SO YOU'LL SEE HERE, WE ACTUALLY, UM, BETWEEN THE TWO PLANTS PUMPED 9.1, UH, MILLION GALLONS. SO THERE'S A COUPLE, COUPLE DIFFERENT REASONS AND A COUPLE THINGS WE DO WHEN WE SEE A NUMBER LIKE THAT. SO FIRST WE CHECK THE PLANT STATUS, RIGHT? MAKE SURE FILTER BACK WASHES WERE DOING GOOD AND EVERYTHING WAS FINE. AND THEN WE CHECK, UM, THE TRENDS, WHICH I'LL SHOW ON THE NEXT SLIDE. SO, UM, THIS IS A, A CHART OF OUR, UM, ELEVATED TANK LEVELS. SO THE LIGHT PINK OR THE, THE MAGENTA LINEUP TOP IS OUR, UM, ELEVATED TANK AT CRYSTAL FALLS. AND THE TEAL COLOR IS, UM, RIGHT HERE IS OUR, UH, COFFMAN TANK. AND THEN THIS RED LINE BACK HERE IS OUR COUNTY ROAD TWO 80 TANK. SO, UM, [00:45:01] THE, THE TEAL LINE YOU CAN SEE NICE, CONSISTENT, UP AND DOWN, VERY PREDICTABLE. UM, YOU KNOW, TANK DRAINS OUT, WE REFILL IT. UM, IN PARTICULAR THIS RED LINE IN COUNTY ROAD TWO 80, SO THERE'S NOT AS MANY CONNECTIONS ON THAT SIDE OF TOWN, SO IT TAKES LONGER FOR THAT TANK BECAUSE WE ARE IN RESTRICTIONS, RIGHT? THEY'RE, THEY'RE ABIDING BY, UM, OUR REQUEST. AND SO IT, THAT THIS RED LINE BACK HERE, UM, TOOK 44 HOURS, WHICH IS ALMOST TWO WHOLE DAYS, UM, TO DRAIN THAT TANK. UM, I APOLOGIZE, THIS ACTUALLY SHOULD BE FEBRUARY 25TH, RIGHT HERE. SO ON FEBRUARY 23RD, ABOUT MIDNIGHT IT STARTED AND ABOUT FEBRUARY 25TH AT EIGHT, ALMOST NINE O'CLOCK AT NIGHT, UM, THE TANK WAS EMPTY AND WE BEGAN TO REFILL. SO THAT 9.1 REALLY REFLECTS AND IT TOOK 33 HOURS TO REFILL ALL THE WAY UP INTO THE 26TH. SO THAT 9.1 REALLY REFLECTS THAT REFILL OF THAT TANK. AND SO WE FELT, AGAIN, WE DON'T, YOU KNOW, WE WANNA BE MINDFUL OF OUR MESSAGING AND RAISE THE RED FLAG WHEN THERE'S A RED FLAG TO BE RAISED. SO WE FELT THAT THAT DAILY USAGE ON THE 25TH WAS REALLY MORE REFLECTIVE OF THE THREE DAY AVERAGE, RIGHT? BECAUSE IT TOOK SO LONG FOR THAT TANK TO DRAW DOWN AND THEN AND, UH, FILL BACK UP. SO, AND GOING INTO SYSTEM OPERATIONS, UM, WE HAVE TO DO THAT BECAUSE IF WE KEPT IT IN THAT TOP, YOU KNOW, 10 OR SO FEET, THE CHLORINE RESIDUAL WOULD DIE. SO WE WOULD NEED TO FLUSH THAT WATER, WHICH WE DON'T WANT TO DO. SO WE, YOU KNOW, IT HELPS US CYCLE THAT TANK AND KEEP THAT WATER, UH, FRESH. SO I'M GONNA PAUSE RIGHT THERE 'CAUSE THAT'S A LOT. IF WE HAVE ANY QUESTIONS BEFORE I GO ON TO THE NEXT COUNCIL. SO I DO HAVE A QUESTION. SO I, I WAS WAITING TO, TO GET THE UNDERSTANDING OF ALL THAT. 'CAUSE I DON'T THINK ANY OF US CAN COMPREHEND EVERYTH AND THAT IT'S A LOT TO PUT OUT TO THE PUBLIC TOO. IT IS. I MEAN, WE, WE'VE GOT THE, THE TWO WATER TREATMENT PLANTS MM-HMM. , THAT'S, WE GOT THAT DOWN. BUT WHEN IT COMES TO ALL THESE OTHER TANKS, I DIDN'T REALIZE THAT YOU HAD TO, YOU ACTUALLY HAVE TO EMPTY THE TANK BEFORE IT'S FILLED IN SO THAT IN SOME LOCATION. SO YOU'LL SEE, UM, I'M SORRY, IN EACH, IN DIFFERENT LOCATIONS OR, WELL, SO YOU'LL SEE CRYSTAL FALLS KIND OF STAYS GENERALLY FULL. OKAY. BUT THAT'S A, THAT'S GROUND STORAGE TANKS THERE. AND SO IT'S, IT'S A LITTLE BIT DIFFERENT. BUT THESE INDIVIDUAL, UM, ELEVATED TANKS, KAUFMAN TANK, UH, COUNTY ROAD TWO 80 TANK, YES. YOU CYCLE THOSE TANKS IN ORDER TO KEEP THE WATER FRESH. OKAY. SO THAT'S WHY WE WOULD SEE THE HEAVIER USE DAYS. MM-HMM. BECAUSE YOU'RE ACTUALLY FILLING THOSE TANKS, IT'S NOT HEAVIER USE BY THE GENERAL PUBLIC. RIGHT. OKAY. OTHERWISE, YEAH, THE WATER KIND OF SEPARATES IN THE TANK. YEAH. AND IT, IT GOES, IT GOES BAD AT ANYWAYS. YES. OKAY. THANK YOU FOR THAT. SURE. ANY OTHER QUESTIONS BEFORE I MOVE ON? NO, YOU'RE DOING GREAT. UM, BECAUSE, YOU KNOW, WE CAN'T HAVE JUST ONE PROBLEM. UM, WE'RE ALSO STILL FACING, UH, THE DROUGHT AND WHILE THESE MAPS LOOK BETTER, UM, SO THAT'S FEBRUARY OF 23, A LOT MORE, UM, RED AND ORANGE AND 77% OF THE STATE WAS, WAS IN A DROUGHT OR DRY. UM, BUT FEBRUARY OF THIS YEAR, YOU'LL SEE IT'S CONSIDERABLY LESS. IT'S ONLY 38%. AND I WANNA MENTION A LOT OF THESE SLIDES ARE FROM, UM, AN LCRA PRESENTATION THAT DAN AND I ATTENDED A COUPLE WEEKS AGO. SO WHILE THE OVERALL SOIL MOISTURE IS BETTER, WE ARE DEFINITELY STILL IN A HYDROLOGIC DROUGHT. SO, UM, HERE'S A ZOOMED UP PICTURE OF OUR PARTICULAR BASIN. SO, UM, 90% PROBABLY OF OUR BASIN IS STILL IN THAT DRY OR DROUGHT. YOU WON'T SEE THAT DARK RED EXTREME DROUGHT. MIKE MIGHT CALL IT MAROON, BUT , UH, WE DON'T HAVE ANY EXTREME DROUGHT IN OUR, IN OUR BASIN ANYMORE. UM, BUT REALLY THIS IS AN INDICATION OF AGRICULTURAL AND SOIL MOISTURE. SO IT DOESN'T TAKE INTO EFFECT YOUR STREAMS, YOUR GROUNDWATER, YOUR RESERVOIRS OR ANYTHING LIKE THAT. SO, UM, WE'RE STILL VERY MUCH, UH, IN A HYDROLOGIC DROUGHT. UM, BUT WHAT IT DOES SAY IS THAT IF WE GET THE RAIN IN THE RIGHT PLACE, THE, THE SOIL'S KIND OF PRIMED FOR IT, RIGHT? AND WE SHOULD GET THAT WATERSHED REACTION AND HOPEFULLY GET SOME WATER INTO THE LAKES. AND THIS IS JUST, UM, THE INFLOWS. SO, UM, THIS SHOWS THE INFLOWS FOR BASICALLY AS LONG AS THEY'VE BEEN COLLECTING THEM, 1942 TO 2023, AND THEN AN AVERAGE OF THE INFLOWS JUST KIND OF OF THE MORE RECENT YEARS. SO, UM, THE JANUARY NUMBERS WERE AT ABOUT 20% OF HISTORICAL AVERAGE AND THEY JUST RELEASED FEBRUARY AND THEY'RE AT ABOUT 17%. SO IT'S NOT SHOWN ON THIS GRAPH, BUT IT CAME OUT THIS WEEK. SO YES, VERY MUCH, UM, STILL NOT A LOT OF WATER RUNNING IN THERE. UM, THIS IS AN INTERESTING GRAPH THAT LCRA HAS BEEN, UM, MANAGING AND TRACKING. SO THIS IS TRACKING THE CURRENT DROUGHT SHOWN IN THE GREEN LINE HERE, UM, WITH THE DROUGHT OF RECORD, WHICH IS SHOWN IN THAT BLUE LINE. SO IF YOU LOOK AT THE POINT HERE, WE'RE ALMOST AT THE [00:50:01] EXACT SAME SPOT, UM, THAT WE WERE IN THE DROUGHT OF RECORD. MM-HMM. . AND SO BECAUSE OF THAT, UM, LCRA ALSO, UM, PROJECTS OUT 18 MONTHS OF WHAT THEY THINK THE LAKE LEVELS WILL DO. IN PARTICULAR, WE OBVIOUSLY TRACK WORST CASE SCENARIO BECAUSE WE HAVE TO, UH, PLAN FOR THAT. SO, UM, USING THEIR PROJECTIONS, UH, THE B-C-R-U-A BARGE WOULD COME BE OFFLINE AT 623 FEET, WHICH IS ABOUT MID-JUNE. AND, UM, AS DAN MENTIONED, OR SORRY, I'M GONNA MENTION HERE IN A MINUTE, UM, WE'RE PLANNING FOR THE DROUGHT BARGE, SO THAT WOULD NEED TO BE ONLINE BY LEVEL SIX 20, WHICH THEY'RE ANTICIPATING ABOUT MID-JULY. AND AT ABOUT, UM, SIX 18, THE SANDY CREEK BARGE WOULD BE OFFLINE. SO AGAIN, WE HAVE TO PLAN, PLAN FOR THE WORST. UM, AND, AND THE BARGE IS ON TRACK TO MEET THOSE DEADLINES, WHICH I'LL TALK ABOUT RIGHT HERE. SO THEY HAD A, UM, KICKOFF MOBILIZATION, UH, ABOUT MIDDLE OF FEBRUARY AND THEY'VE SINCE MOVED THE BARGES. I'LL SHOW SOME PICTURES HERE IN A MINUTE. UM, OUT THEY WERE STORED AT OUR SANDY CREEK PLANT. SO THOSE HAVE SINCE BEEN MOVED OUT. UM, AND THEY ARE ON TRACK, YOU'LL SEE, UH, FOR COMMISSIONING AND STARTUP ABOUT ALMOST THE END OF JUNE. SO, YOU KNOW, IF IT DOES FOLLOW THIS TREND AND WE'RE LOOKING AT, YOU KNOW, THE B AREA WAY BARGE OFFLINE, UM, THAT WOULD BE ABOUT THE TIME THAT THIS BARGE WOULD BE STARTING UP. UM, AGAIN, AS A REMINDER, WHEN B-C-R-U-A GOES OFFLINE AND OR THE BARGE, THE DROUGHT BARGE IS ON, WE ARE LIMITED TO THAT 9 MILLION GALLONS AGAIN. SO WE'LL BE BACK IN PHASE FOUR AT THAT POINT. IF, IF WE GET NO RING. UM, THIS IS JUST A REMINDER OF THE KIND OF THE ALLOCATION. CEDAR PARK IS MANAGING THIS CONTRACT, BUT WE, UM, ARE VERY MUCH A PARTNER IN IT. AND, UM, THE BARGE CAN PUMP UP TO 30 MILLION GALLONS A DAY. 21 GOES TO CEDAR PARK AND NINE COMES TO US AT SANDY CREEK. UH, THIS IS A DRAWING, UM, THE CURRENT BARGES ARE UP HERE. THERE'S ALREADY A PIPELINE IN PLACE FROM THE LAST, UM, DROUGHT WHEN THEY ALMOST HAD TO LAUNCH THIS. UH, IT'S ABOUT A LITTLE OVER 4,000 FEET, UM, TO ITS NEW LOCATION OUT HERE. I BELIEVE THIS IS RIGHT NEXT TO MAYBE JONESTOWN. THERE'S ANOTHER INTAKE RIGHT THERE. UH, HERE'S SOME PICTURES OF THEM MOVING THE BARGES FROM SANDY CREEK. SO, UM, TOOK A PRETTY BIG CRANE AND LOTS OF TRUCKS TO, TO GET 'EM OUT. SO THEY'RE CURRENTLY, UM, AT THE MARINA BEING ASSEMBLED. UM, THEY'RE, THEY'VE ALREADY GOT 'EM IN THE WATER. UM, NO, THIS IS, SORRY, SORRY, THIS IS A 2015 PICTURE. THIS IS A 2015, THIS IS WHAT IT'S GONNA LOOK LIKE. GOOD POINT. YES, WE DO HAVE SOME PICTURES OF THEM NOW, BUT UM, THEY'RE NOT, YEAH, IT'S DEFINITELY NOT PUT TOGETHER, BUT THEY ARE IN THE COMING WEEKS GONNA START, UM, PUTTING IT TOGETHER. SO IT WILL EVENTUALLY LOOK LIKE THIS. AND I THINK THAT'S ALL I HAVE. OH YEAH, THAT'S THE END. DO YOU HAVE ANY QUESTIONS? QUICK QUESTION ON THE EMERGENCY BARGE. UM, WHEN YOU SAY WE'RE LIMITED TO THAT 9 MILLION, THAT'S WHAT WE CAN TAKE OFF OF THE BARGE. THAT'S WHAT WE CAN TAKE. AND THEN CEDAR PARK IS 8 21. OKAY. CORRECT. THAT'S A LOT FOR THAT LITTLE BARGE. YEAH, SO CEDAR PARK'S, UH, PLANT CAPACITY IS 26, SO THEY WOULD BE LIMITED A LITTLE BIT. UM, BUT AS YOU KNOW, SANDY CREEK CAN ONLY DO ABOUT NINE ANYWAY, SO YEAH. THANK YOU. SO THE EMERGENCY BARGE WOULDN'T BE TURNED ON UNLESS WE ABSOLUTELY NEED THAT. CORRECT. AND WE'RE IN THAT DROUGHT CONDITION. CORRECT. SO THE EXTREME DROUGHT MM-HMM, . YEAH. SO, BUT WE STILL HAVE TO GET IT ASSEMBLED DUE TO THE TIMELINE BECAUSE OF THE TIME. IT TAKES ABOUT SIX MONTHS TO ASSEMBLE. SO, UM, AND AT ANY POINT IF ALL OF A SUDDEN, YOU KNOW, WE GET THIS GUY RIGHT HERE AND IT JUST, THE LAKE JUMPS UP, WE CAN STOP THE PROJECT. UM, AND, AND KIND OF PUT A PAUSE ON IT. UM, I THINK LAST OCTOBER WE GOT ABOUT FIVE FEET OF RAIN THAT CAUSED US TO KIND OF, YOU KNOW, MAYBE IT'S COMING AND THAT'S ABOUT ALL WE GOT. SO, UM, BUT YES, IT WOULD NEED TO BE IN OPERATION BY LEVEL SIX 20. IT'LL BE NICE WHEN THE DEEP WATER INTAKE IS ONLINE. YES, THAT IS EXACTLY RIGHT. ANY OTHER QUESTIONS? I THOUGHT YOU WERE COMING UP THE STOP. NO, , WAS THAT EVERYTHING? THAT'S IT. ALL RIGHT. THANK YOU ALL SO VERY MUCH. THAT WAS, I WANNA SAY WONDERFUL, BUT WONDERFUL FEELS WRONG BECAUSE IT WAS ALSO VERY SCARY. BUT, UM, BUT THAT WAS VERY COMPREHENSIVE. THANK YOU. OKAY, WE'RE GONNA MOVE ON TO CONSENT [ CONSENT AGENDA: ACTION] AGENDA COUNSEL. WE'LL BE CONSIDERING ITEMS NINE THROUGH 22. THIS IS AN ACTION ITEM, MOTION TO APPROVE SECOND MOTION. AND SECOND, IS THERE ANY DISCUSSION? ALL THOSE IN FAVOR PASSES UNANIMOUSLY INTO OUR PUBLIC HEARINGS. ITEM NUMBER 23, [23. Conduct a Public Hearing regarding Zoning Case Z-23-0095 to amend the current zoning of TOD/PUD-CD  (Transit Oriented Development/ Planning Unit Development – Conventional Development Sector) to adopt the Spillars Project Minor PUD (Planned Unit Development) with the base zoning district of GC-2-A (General Commercial) on one (1) parcel of land approximately 1.574 acres ± in size, more particularly described by Williamson Central Appraisal District Parcel R086306; and located to the east of the intersection of Tulum Terrace and US 183, Leander, Williamson County, Texas. Discuss and consider action regarding Zoning Case Z-23-0095 as described above.] [00:55:01] CONDUCT A PUBLIC HEARING REGARDING ZONING CASE Z DASH 23 DASH 0 0 9 5 TO AMEND THE CURRENT ZONING OF T-O-D-P-U-D DASH CD, TRANSIT ORIENTED DEVELOPMENT PLANNING UNIT DEVELOPMENT, CONVENTIONAL DEVELOPMENT SECTOR TO ADOPT THE SPILLERS PROJECT, MINOR PUD PLANNED UNIT DEVELOPMENT WITH THE BASE ZONING DISTRICT OF GC TWO, A GENERAL COMMERCIAL ON ONE PARCEL OF LAND, APPROXIMATELY 1.574 ACRES, PLUS OR MINUS IN SIZE AS STATED ON THE POSTED AGENDA. EXECUTIVE DIRECTOR OF DEVELOPMENT SERVICES, GRIFFIN. GOOD EVENING. GOOD EVENING. THIS IS A, A PUBLIC HEARING FOR THE SPILLERS PROJECT MINOR PUD. UM, THIS PROPERTY IS LOCATED IN THE CONVENTIONAL DEVELOPMENT SECTOR OF THE TOD OFF OF 180 3. UM, THIS REQUEST INCLUDES CREATING A P WITH THE GC TWO, A DISTRICT, WHICH WOULD TAKE IT OUT OF THE TOD AND THEY WOULD BE ABLE TO DEVELOP UNDER THE GENERAL COMMERCIAL STANDARDS. UM, THIS WAS REVIEWED BY THE PLANNING AND ZONING COMMISSION DURING THEIR FEBRUARY 8TH MEETING, AND THEY DID MOTION TO APPROVE WITH THE CONDITION THAT BARS AND NIGHTCLUBS AS WELL AS VAPE SHOPS WERE ADDED AS PROHIBITED USES, UM, WITH A FIVE TO ONE VOTE. UM, THIS IS A PUBLIC HEARING, SO I CAN ANSWER QUESTIONS AFTER. THANK YOU. THANK YOU. IS THERE A PRESENTATION? OKAY. THE PUBLIC HEARING IS NOW OPEN. THERE'S NOBODY SIGNED UP TO SPEAK ON THIS ITEM. WAS THERE ANYBODY WHO WISHED TO SPEAK? ALL RIGHT. PUBLIC PUBLIC HEARING IS NOW CLOSED. WE'LL NOW DISCUSS AND CONSIDER ACTION REGARDING ZONING CASE Z DASH 23 DASH 0 0 9 5 AS DESCRIBED PREVIOUSLY. COUNSEL, SO I'LL MOTION TO APPROVE WITH THE CONDITIONS. NO SUGGESTED, WELL, I DON'T WANNA TALK ABOUT THAT FIRST? THAT'S OKAY. WE CAN TALK ABOUT IT. I JUST, WE'VE GOT A MOTION. DO WE WANT TO GET A SECOND AND THEN GO INTO DISCUSSION? IT DOESN'T MATTER TO ME. I MEAN, I'M FINE. DO YOU WANNA WITHDRAW YOUR MOTION? UH, SURE. OKAY. IT'D BE EASIER IF THE APPLICANT WAS HERE? YES. UM, IN, IN MY, IN MY CASE BECAUSE, UM, I DIDN'T REALLY, UM, I, AND I'M ASSUMING THAT THE ONE COMMISSIONER THAT, UH, DID NOT VOTE FOR THIS WAS IF I, IF I KNOW HIM CORRECTLY TOO, WAS PROBABLY BECAUSE THERE WAS CONDITIONS PUT ON THIS. MM-HMM. . CORRECT. THERE WAS EXTRA CONDITIONS PUT ON THIS. SO I DON'T SEE, UM, WHERE, ESPECIALLY WITH THE VAPE SHOP CON CONVERSATION, I THINK THAT MAY HAVE WAS JUST A HOT TOPIC 'CAUSE OF WHAT WE'RE TALKING ABOUT. UM, BUT OTHER THAN THAT, UM, I DON'T SEE WHY WE'RE PUTTING THE LIMITED USES HERE. SO THAT'S JUST MY PERSPECTIVE FOR AS A, AS A COUNCIL MEMBER. SO JUST TO COMMENT ON THAT, I KNOW THE, THE APPLICANT DID NOT HAVE ANY ISSUES WITH THOSE RESTRICTIONS. YES. JUST WATCHING IT. SO THAT'S WHY I WOULD, I WATCHED IT BECAUSE I WAS CONCERNED ABOUT THE SAME THINGS. OKAY. MM-HMM. AND, UM, A, A FEW ON THE COMMISSION WERE CONCERNED ABOUT THE RESIDENTIAL RIGHT ACROSS THE STREET ON THE SOUTHERN PORTION. THEY DIDN'T WANT BARS AND NIGHTCLUBS THAT CLOSE TO HOMES. MM-HMM. BECAUSE IT WAS WITHIN A HUNDRED FEET. AND THEN, UM, I DON'T KNOW HOW VAPE SHOPS GOT INCLUDED IN THERE, BUT, UM, BUT YEAH, I WAS CONCERNED ABOUT IT TOO. THE APPLICANT SEEMED CONCERNED AT FIRST AND THEN THEY WERE LIKE, NO, ASHLEY, WE'RE GOOD WITH THAT BY THE END. SO, AND THEN THEY'RE NOT HERE CONCESSION. YEAH. WELL, I'M JUST LIKE THAT, THAT'S A, THAT'S ONE OF THOSE LOCATIONS THAT I, THAT, UH, THAT WAS SHOULD HAVE BEEN ALL, I THINK EVEN THE REASON THAT WE PUT, WHOEVER PUT, WE WEREN'T PART OF PUTTING RESIDENTIAL THERE ON THAT SPOT TOO, WHICH WAS A BAD IDEA IN THE FIRST PLACE. UM, 'CAUSE THAT'S, NOW WE'RE TALKING ABOUT SOMETHING THAT CAN'T GO IN AN AREA AND LIMITING SOMEBODY'S USE TO SOMETHING THAT COULD POTENTIALLY BE GOOD THERE ONE WAY OR ANOTHER. MM-HMM. MY ONLY CONCERN THERE WAS IF ANYBODY ON STAFF HAD ANY CONCERNS ABOUT THE SAFETY IN THAT AREA. THAT WOULD'VE BEEN SOMETHING. YEAH. THAT I WOULD SAY ABSOLUTELY 100%. BUT IF IT'S JUST A COMMISSIONER OR JUST COUNCIL MEMBER SAYING, WE THINK MAYBE THIS IS NOT GOOD. UM, I, I, I, I HAVE A HARD TIME PUTTING THE CONDITIONS ON THAT, SO THAT WAS JUST MY ONLY THING THERE. UM, I'M ALL FOR IT. ONE WAY TO MOVE FORWARD, BUT I JUST WANTED TO, TO SAY THAT I HAD A YEAH, IT WAS VERY RANDOM. YEAH, IT WAS, IT WAS VERY RANDOM, SO, YEAH. YEAH. AND SO SINCE THEY WERE FINE WITH IT, I HAVE, I HAVE NO ISSUE WITH IT. THERE WAS MORE QUESTION ABOUT THE, THE TREE REMOVAL . AND SO, UH, ROBIN IS, YOU, YOU WERE SAYING THAT THE APPLICANT REALLY HAS NO ISSUE HERE. I THINK HE, HE DIDN'T HAVE A, A USE YET FOR THE PROPERTY, AND I DIDN'T, HE SEEMED LIKE HE DIDN'T THINK IT WOULD LIMIT HIM. OKAY. IN THE FUTURE. SOUNDS GOOD. THEN I'LL SECOND. OKAY. SO I'LL MAKE THE MOTION AGAIN. MOTION TO APPROVE. AND YOU SECOND? NO, I'LL SECOND. . ALL RIGHT. SO THERE'S A MOTION TO APPROVE WITH, WITH THE RECOMMENDATIONS. THESE RECOMMENDATIONS. YES. AND THE SECOND, IS THERE ANY FURTHER DISCUSSION? ALL THOSE IN FAVOR, OPPOSED PASSES. SIX TO ONE. ALL RIGHT. ITEM NUMBER [24. Conduct a Public Hearing regarding Zoning Case Z-23-0099 to amend the current zoning of Hill Country Bible PUD (Planning Unit Development) with the base zoning district of SFS-3-A (Single-Family Rural) to change the base zoning district to LC-2-A (Local Commercial) on two (2) parcels of land approximately 19 acres ± in size, more particularly described by Williamson Central Appraisal District Parcels R647584 and R647585; and more commonly known as 589 W. San Gabriel Parkway, Leander, Williamson County, Texas.  Discuss and consider action regarding Zoning Case Z-23-0099 as described above.] 24, CONDUCT A PUBLIC HEARING REGARDING ZONING CASE Z DASH 23 DASH 0 0 9 9 TO AMEND THE CURRENT ZONING OF HILL COUNTRY BIBLE, PUD, PLANNED UNIT DEVELOPMENT WITH THE BASE ZONING DISTRICT OF SFS DASH THREE DASH A SINGLE FAMILY RURAL. TO CHANGE THE BASE ZONING DISTRICT TO LC DASH TWO, A LOCAL COMMERCIAL ON TWO PARCELS OF LAND, APPROXIMATELY 19 ACRES, PLUS OR MINUS IN SIZE, AS STATED ON THE POSTED AGENDA. EXECUTIVE DIRECTOR OF DEVELOPMENT SERVICES. GRIFFIN, WELCOME BACK. GOOD EVENING. SO THIS IS AN AMENDMENT TO THE HILL COUNTRY BIBLE, UM, PLANNED UNIT DEVELOPMENT. UM, THE CHURCH IS CURRENTLY DEVELOPED [01:00:01] ON THIS PIECE OF THE PROPERTY, AND THEY HAVE REPLANTED IT TO ADD THIS LOT. AND, UM, THEY'RE TRYING TO SELL THAT LOT TO AN END USER. AND IT'S CURRENTLY LIMITED TO JUST SINGLE FAMILY. SO THIS CHANGE WOULD ALLOW FOR LOCAL COMMERCIAL USES. UM, THIS WAS REVIEWED BY THE COMMISSION DURING THE FEBRUARY 8TH MEETING, AND THEY DID RECOMMEND APPROVAL OF THE REQUEST. AND I'LL BE GLAD TO ANSWER QUESTIONS AFTER THE PUBLIC HEARING. AND THE APPLICANT IS HERE TO ANSWER QUESTIONS. TO ANSWER QUESTIONS. THANK YOU. WITH THAT, THE PUBLIC HEARING IS NOW OPEN. THERE'S NOBODY SIGNED UP TO SPEAK ON THIS ITEM. WAS THERE ANYBODY WHO WISHED TO SPEAK? ALL RIGHT. PUBLIC HEARING IS NOW CLOSED. WE'LL NOW DISCUSS AND CONSIDER ACTION REGARDING ZONING CASE Z DASH 23 DASH 0 99 AS DESCRIBED PREVIOUSLY. COUNSEL, MOTION TO APPROVE A SECOND. MOTION A SECOND. IS THERE ANY DISCUSSION? ALL THOSE IN FAVOR PASSES UNANIMOUSLY. THANK YOU. I'M NUMBER 25. [25. Conduct a Public Hearing regarding Comprehensive Plan Case CPA-24-0011 to update the Water Masterplan; Leander, Williamson and Travis Counties, Texas.  Discuss and consider action regarding Comprehensive Plan Case CPA-24-0011 as described above.  ] CONDUCT A PUBLIC HEARING REGARDING COMPREHENSIVE PLAN CASE CPA A DASH 24 DASH 0 0 1 TO UPDATE THE WATER MASTER PLAN. LEANDER WILLIAMSON AND TRAVIS COUNTY, TEXAS ASSISTANT CITY ENGINEER, DUCAL, WELCOME. OH, SORRY, MR. GRIMS. GOOD EVENING, . YEAH, I'M, I'M, THAT WAS A TEST. I'M COVERING . UM, SO SARVE WOULD'VE, WOULD'VE BEEN ALL OVER THIS, UH, DAN VILLE, EXECUTIVE DIRECTOR OF INFRASTRUCTURE, UH, FE, THE CITY OF LEANDER. SO WE'VE ALREADY UPDATED THE, UH, WATER MASTER PLAN. UM, IT DIDN'T REALLY TAKE A WHOLE LOT TO UPDATE IT, UH, BECAUSE, UH, THE LAST ONE DONE IN 2018 WAS PRE THOROUGH, AND WE'RE ACTUALLY DOING A LOT OF WHAT WE SAID WE NEEDED TO DO. UM, SO IT'S IS GREAT. SO WHAT THIS IS, IS WE'RE UPDATING THE WATER MASTER PLAN AS AN EXHIBIT TO THE COMPREHENSIVE PLAN. SO THIS PLAN WILL REPLACE THE PLAN THAT'S CURRENTLY IN THE COMPREHENSIVE PLAN AS AN UPDATE. UM, AND, AND IF YOU HAPPEN TO LOOK THROUGH IT, UM, YOU CAN SEE FOR THE FIVE YEAR PLAN, IT INDICATES 2 47. AND WE KNOW WE'RE ACTUALLY SLIGHTLY ABOVE THAT IN THE 300 RANGE. SO IT SHOWS OVER THE NEXT FIVE YEARS, WE'RE DOING EXACTLY WHAT THE PLAN SAYS. THERE'S A FEW MORE THINGS IN THERE THAT PIPE WISE PROBABLY NEEDS TO BE DONE. BUT WHAT'S INTERESTING AFTER THAT, FOR THE 10 YEAR AND 20 YEAR, YOU SEE IT DROP OFF TO LIKE 44 MILLION. SO AT THAT POINT, WE'RE JUST UPSIZING THE REST OF THE SYSTEM BECAUSE ALL THE BIG ITEMS WILL, WILL BE IN PLACE FOR, FOR LEANNA TO MOVE FORWARD WITH THAT GROWTH. OKAY. THIS IS A PUBLIC HEARING, RIGHT? DARA? YES, MA'AM. OKAY. SO SHOULD I OPEN IT HERE? YES, MA'AM. ALL RIGHT. PUBLIC HEARING IS, UH, NOW OPEN. THERE'S NOBODY SIGNED UP TO SPEAK ON THIS. IS THERE ANYBODY WHO WISHES TO SPEAK? ALL RIGHT. PUBLIC HEARING IS NOW CLOSED. WE'LL NOW DISCUSS AND CONSIDER ACTION REGARDING COMPREHENSIVE PLAN CASE CPA DASH 24 DASH 0 0 1 AS DESCRIBED PREVIOUSLY. COUNSEL, MOTION TO APPROVE I SECOND MOTION. AND SECOND, ANY FURTHER DISCUSSION? ALL THOSE IN FAVOR PASSES UNANIMOUSLY. THANK YOU. ITEM NUMBER 26, CONDUCT [26. Conduct a Public Hearing regarding the Travisso Voluntary Annexation Case A-23-0010 for the voluntary annexation of 8.04 acres ± in size, more particularly described by Williamson Central Appraisal District Parcels 459396, 459397, 459398, 467190, 467189, and 467188; and generally located approximately 1,200 feet to the north of the intersection of Buck Run and RM 1431 on the east of Buck Run, Leander, Travis County, Texas. Discuss and consider action on Travisso Voluntary Annexation Case A-23-0010 as described above.] A PUBLIC HEARING REGARDING THE TRIVIO VOLUNTARY ANNEXATION CASE, A DASH 23 DASH 0 0 1 0 FOR THE VOLUNTARY ANNEXATION OF 8.04 ACRES, PLUS OR MINUS IN SIZE AS STATED ON THE POSTED AGENDA. EXECUTIVE DIRECTOR OF DEVELOPMENT SERVICES. GRIFFIN, WELCOME BACK. GOOD EVENING. THIS IS THE PUBLIC HEARING FOR AN ANNEXATION CASE FOR THE TRIVIO PROJECT. UM, THIS AREA, UM, WAS PREVIOUSLY IN THE CEDAR PARKS ETJ, AND THE DEVELOPER REQUESTED TO BE ADDED TO OUR CITY LIMITS 'CAUSE THEY'RE EXTENDING O SAGE, UM, DOWN TO CONNECT TO 1431. SO A PORTION OF THEIR ROAD IS GONNA GO INTO THAT PROPERTY. UM, THIS IS JUST A PUBLIC HEARING FOR THE ANNEXATION. IT DOES NOT ESTABLISH ZONING OR APPROVE THE ANNEXATION. THAT WOULD BE AT THE NEXT MEETING. AND I'M GLAD TO ANSWER ANY QUESTIONS AFTER THE PUBLIC HEARING. THANK YOU. THANK YOU. AND THERE'S NO APPLICANT PRESENTATION. ALL RIGHT. PUBLIC HEARING IS NOW OPEN. NOBODY HAS SIGNED UP TO SPEAK ON THIS ITEM. IS THERE ANYBODY WHO WISH TO SPEAK? ALL PUBLIC HEARING IS NOW CLOSED. WE'LL NOW DISCUSS AND CONSIDER ACTION REGARDING TRIBIO, VOLUNTARY ANNEXATION CASE, A DASH 23 DASH ZERO AS DESCRIBED PREVIOUSLY. COUNSEL MOTION TO, NO QUESTION. NO QUESTION, ROBIN. SO WHEN WILL O SAGE GO ALL THE WAY THROUGH TO THAT LOCATION? UM, SO AFTER THE ANNEXATION IS COMPLETED, THEY'RE GOING TO, UM, WORK ON THEIR ZONING AND PLATTING. SO IT'S, ONCE THEY GET THROUGH ALL OF THOSE STEPS, I THINK IT'S PART OF THEIR NEXT PHASE. UM, THE DEVELOPER COULD PROBABLY ANSWER THAT BETTER THAN I CAN, AND THEN I, BUT THIS IS AN, AN ANTICIPATION OF CONNECTING. YEAH. SO MY, MY ONLY CONCERNS IS WITH, WITHOUT THAT CONNECTION, I'M LOOKING AT OUR CITY RESOURCES WITH POLICE AND, WELL, NOT SO MUCH FIRE 'CAUSE THEY HAVE A FIRE STATION IN TRIVIO, BUT JUST RESPONSE TIMES FOR, FOR GREG'S DEPARTMENT AND FOR ANYTHING THAT'S GONNA GO OUT THERE. SO JUST IF THERE'S ANY WAY TO COORDINATE THOSE TWO, JUST SO WE DON'T PUT PEOPLE IN A BAD SITUATION THAT WE CAN'T GET TO 'EM. KIND OF, WE ALREADY TALKED ABOUT THIS, YOU GOTTA DRIVE THROUGH CEDAR [01:05:01] PARK TO GET TO LEANDER . SO, UH, JUST BY CONCERNS. APPRECIATE IT. THANK YOU. MS. GRIFFIN, IS THIS AN EXTENSION OF TRIVIO? CORRECT. IT'LL BE PART OF TRIVIO. OKAY. SO IT WILL CONNECT TO ALL OF THE SAME ROADS BESIDES OSAGE? YES. OKAY. UM, AT THE NEXT PRESENTATION, I CAN ACTUALLY SHOW TRIVIO 'CAUSE I'M SEEING THE PROBLEM. 'CAUSE YOU CAN'T SEE THE ROADS. YES. SO YES, THAT WILL HELP. YEAH. SO, UM, HOW ABOUT THIS, UM, IF WE, IF WE PASS IT UNANIMOUSLY, USUALLY IT GOES ON CONSENT. LET'S MAKE SURE IT DOESN'T GO ON CONSENT. SO WE CAN SEE THAT PRESENTATION THE NEXT TIME. YES. OKAY. ALL RIGHT. DOES ANYBODY WANT TO MAKE A MOTION? WELL, YOU HAD ONE, A MOTION TO ALL SECOND MOTION AND SECOND, IS THERE ANY FURTHER DISCUSSION? ALL THOSE IN FAVOR PASSES UNANIMOUSLY. WHAT? WELL, YOU A COMMENT? OKAY. YEAH. AS LONG AS IT COMES BACK WITH THE, YEAH. ALRIGHT. THANK YOU. I'M NUMBER 27 IS POSTPONED BY THE APPLICANT. SO WE'LL MOVE INTO OUR REGULAR AGENDA. ITEM NUMBER 28, RECEIVE PRESENTATION [28. Receive presentation and accept the Annual Financial Report for fiscal year ending September 30, 2023, from external auditor, Whitley Penn LLP.] AND ACCEPT THE ANNUAL FINANCIAL REPORT FOR FISCAL YEAR ENDING SEPTEMBER 30TH, 2023. FROM EXTERNAL AUDITOR WHITLEY PENN, LLP, EXECUTIVE DIRECTOR OF FINANCE POWERS. GOOD EVENING. GOOD EVENING, MAYOR. THANK YOU. UM, UH, MEMBERS OF THE CITY COUNCIL, IT'S MY PLEASURE TO INTRODUCE, UH, MR. ROGER TOVAR AUDIT PARTNER WITH, UM, WHITLEY, WHITLEY PENN, OUR AUDITORS FOR THIS YEAR. HE'S HERE TO PRESENT THE RESULTS OF THE ANNUAL FINANCIAL REPORT. UM, BEFORE I TURN IT OVER TO MR. TOVAR, I, I DO WANT TO GIVE A BIG SHOUT OUT TO MY STAFF. THEY DID A LOT OF WORK OVER THE LAST SEVERAL MONTHS, AND ESPECIALLY, UH, MS. PAM KB, OUR ACCOUNTING MANAGER, SHE, UH, UH, CARRIED A LOT OF WEIGHT AND NOT JUST MINE. SO I WANT TO THANK HER FOR EVERYTHING THAT SHE DID. SO, GOOD EVENING. GOOD EVENING, COUNSEL. MAYOR, I, UH, UH, MR. POWERS, UH, JUST MENTIONED, UH, THIS, THIS WAS OUR FIRST YEAR WORKING WITH THE CITY, UH, PERFORMING THE FINANCIAL STATEMENT AUDIT. UH, AND, AND WE ISSUED THE AUDIT EARLIER THIS WEEK. AND SO I DO HAVE A PRESENTATION TO GO OVER THAT. UH, I, I ALSO WANT TO THANK, UH, HIM AND HIS WHOLE TEAM, PAM, FOR PUTTING UP WITH US FOR, FOR A FEW MONTHS AND, AND PROVIDING ALL THE RE ALL THE ITEMS THAT WE NEEDED FOR THE AUDIT. UM, I HAVE TO SAY THAT WE TRULY ENJOY WORKING WITH THE, WITH THE CITY AND WITH MANAGEMENT. SO I DIDN'T ASK THEM TO SEE IF THEY FEEL THE SAME ABOUT US, BUT , HOPEFULLY THEY DO. UH, SO YEAH, I'LL GO THROUGH MY PRESENTATION. IT'S A SUMMARY OF THE, OF THE AUDIT. UM, AT ANY POINT, IF YOU HAVE ANY QUESTIONS, FEEL FREE TO ASK ME QUESTIONS AND OR YOU CAN ASK ME AFTER WHAT, WHATEVER WORKS FOR YOU, WORKS FOR ME. SO FIRST I'LL GO, I'LL GO OVER THE, UH, OH, THAT SLIDE LOOKS KIND OF WEIRD. UH, I GO OVER THE, UH, THE, THE AUDIT PROCESS. AND SO THE AUDIT PROCESS ACTUALLY TAKES A FEW MONTHS. SO WE START BACK IN JULY. THAT'S TYPICALLY WHEN WE START DOING, UH, SOME OF THE PRELIMINARY WORK. SO EVEN BEFORE YOUR FISCAL YEAR ENDS, WE'RE ALREADY OUT HERE, UH, LOOKING AT YOUR INTERNAL CONTROLS, DOCUMENTING, UH, YOUR PROCESS, UH, TESTING CONTROLS. UH, SO THAT USUALLY HAPPENS BACK IN JULY, AUGUST, AROUND THAT TIMEFRAME. UH, THEN WE'LL COME BACK A SECOND TIME LATER IN, AFTER YOUR END. UH, WHICH KIND OF LEADS OVER TO NUMBER FOUR WHEN WE PERFORM OUR SUBSTANTIVE TESTING, WHICH AT THAT POINT WE'RE LOOKING AT YOUR ACCOUNT BALANCES, UH, RECONCILIATIONS, THOSE TYPE OF THINGS, CONFIRMING WITH, WITH OUTSIDE PARTIES, THINGS, THINGS LIKE THAT. AND THAT, THAT LEADS OVER TO NUMBER FIVE, WHICH IS WHERE WE ARE TODAY, ISSUING AN OPINION ON YOUR FINANCIAL STATEMENTS. SO THE, AS FAR AS, UH, THE PURPOSE OF THE AUDIT IS FOR, TO, FOR US TO ISSUE AN OPINION ON YOUR FINANCIAL STATEMENTS. SO, UH, THERE ARE SEVERAL OPTIONS WHEN IT COMES TO OPINION. SO YOU CAN SEE 'EM HERE ON THE SCREEN, UH, FROM LEFT TO RIGHT, UH, THE RIGHT HAND SIDE, YOU HAVE YOUR UNMODIFIED OPINION. SO THAT IS THE HIGHEST LEVEL OF ASSURANCE THAT YOU CAN OBTAIN, UH, UH, ON YOUR FINANCIAL STATEMENTS. UM, ANYTHING OUTSIDE OF THAT, UH, THAT'S EITHER THERE'S, YOU KNOW, WE CAN ISSUE A DISCLAIMER, WE CAN QUALIFY THE OPINION FOR SPECIFIC THINGS. UH, BUT OBVIOUSLY THE GOAL FOR EVERY AUDIT AS AN, AS A CITY, AS AN ENTITY SHOULD BE, UH, TO OBTAIN THAT UNMODIFIED OR CLEAN OPINION. SOME PEOPLE CALL IT CLEAN OPINION. AND WITH THAT, UH, WE DID ISSUE AN UNMODIFIED OPINION ON YOUR FINANCIAL STATEMENTS. UH, SO THIS IS THE MAIN REPORT. WE ACTUALLY HAVE A COUPLE REPORTS THAT GO INTO YOUR FINANCIAL STATEMENTS JUST BECAUSE, UH, THAT LAST BULLET POINT THERE. UH, WE DO CONDUCT OUR AUDIT UNDER GOVERNMENT AUDITING STANDARDS, WHICH ADDS AN EXTRA LAYER, UH, UH, OF REQUIREMENTS. SO THAT REQUIRES FOR US TO COME IN, LOOK AT YOUR INTERNAL CONTROLS. WE DON'T ISSUE AN OPINION ON YOUR INTERNAL CONTROLS. HOWEVER, WE DO LOOK AT 'EM, MAKE SURE THAT THEY'RE EFFECTIVE. UH, IF WE, IF AT ANY POINT WE COME ACROSS ANY ISSUES WITH YOUR CONTROLS, WE'RE REQUIRED TO, UH, REPORT THAT TO YOU. SO THAT'S AN NEXT REPORT THAT WE HAVE TO ISSUE. SO THAT'S WHAT THIS, UH, SLIDE GOES OVER. UH, SO WE DON'T, WE DON'T HAVE ANY [01:10:01] MATERIAL WEAKNESSES OR SIGNIFICANT DEFICIENCIES, UH, IN INTERNAL CONTROL OVER FINANCIAL REPORTING TO REPORT TO YOU. UH, WE'RE ALSO, UH, DO NOT HAVE ANY INSTANCES OF NON-COMPLIANCE THAT ARE MATERIAL TO YOUR FINANCIAL STATEMENTS. SO OVERALL, A A, A CLEAN OPINION ON MODIFIED OPINION. SO AGAIN, THAT IS THE HIGHEST LEVEL OF ASSURANCE THAT YOU CAN OBTAIN ON YOUR FINANCIAL STATEMENTS. AND THIS HERE IS JUST A, A SUMMARY SIDE BY SIDE. I PUT 23 AND 22 SIDE BY SIDE. UH, SO THIS IS YOUR GOVERNMENT WIDE STATEMENT. SO THIS INCLUDES, UH, YOUR GOVERNMENTAL ACTIVITIES AS WELL AS YOUR BUSINESS TYPE ENTERPRISE ACTIVITIES. SO THIS IS EVERYTHING. UH, SO YOU CAN SEE THERE JUST TOTAL ASSETS. THERE WAS AN INCREASE IN TOTAL ASSETS OF, UH, ROUGHLY, UH, 9.9% OVER LAST YEAR. YOUR, YOUR DEFERRED OUTFLOWS AND INFLOWS. THOSE TWO MAINLY RELATE TO YOUR PENSION LIABILITY AND OEP LIABILITY. UH, SO YOU CAN SEE THOSE FLUCTUATE FROM YEAR TO YEAR. UH, THOSE, THOSE ESTIMATES ARE BASED ON, ON OUTSIDE PARTIES, UH, ACTUARIAL REPORTS THAT COME IN. UH, AND, AND YOU HAVE TO ADJUST YOUR FINANCIAL STATEMENTS TO THAT. UH, YOUR TOTAL LIABILITIES, UH, THERE WAS A, A ABOUT A 1% DECREASE THERE, UH, OVERALL YEAR OVER YEAR. UH, AT THE VERY BOTTOM THERE, YOUR NET POSITION OVERALL, UH, INCREASED ABOUT 14.3% OVER LAST YEAR. THIS SLIDE HERE PROVIDES A LITTLE MORE DETAIL ON YOUR LONG-TERM LIABILITIES. UH, SO YOU CAN SEE HERE, UH, YOUR, YOUR BONDS, YOUR, YOUR GOS AND REVENUE BONDS. UH, THERE WAS A DECREASE, UH, ON THOSE TWO. UH, AND THOSE THAT JUST RELATES TO YOUR ANNUAL PAYMENTS. UH, AND THEN YOUR, YOUR PREMIUMS JUST, THEY'VE BEEN AMORTIZING OVER, OVER OVER TIME. SO YOU CAN SEE THAT DECREASE THERE. UH, YOUR BIDS THERE, THAT'S THE NEW, A NEW GSB 96 THAT WAS IMPLEMENTED IN THE CURRENT YEAR. UH, SO THAT, THAT WENT ON YOUR FINANCIAL STATEMENTS. AND YOU CAN SEE THAT LIABILITY THERE, UH, IS ROUGHLY, UH, $981,000 AT THE END OF THE YEAR. UH, THEN YOUR LEASES, WHICH WAS IMPLEMENTED LAST YEAR. UH, SO THAT'S ALSO AROUND A MILLION DOLLARS AT THE END OF THE YEAR. THEN YOU HAVE YOUR NOTES PAYABLE THERE, WHICH ALSO DECREASED DUE TO THE PAYMENTS, UH, AND THEN YOUR COMPENSATED ABSENCE. SO OVERALL, YOUR, YOUR LONG-TERM LIABILITIES, UH, DECREASED $18.7 MILLION OVER LAST YEAR. AND THEN THIS SLIDE HERE GOES OVER, UH, JUST THE GOVERNMENTAL FUNDS. SO THIS IS A SUMMARY OF YOUR REVENUES, EXPENDITURES AND OTHER FINANCING SOURCES OR USES. UH, I PUT IT BY, UH, MAJOR FUNDS HERE. SO YOU CAN SEE YOUR GENERAL FUND, YOUR OPERATING FUND. UH, THERE'S, THERE WAS $65.5 MILLION OF REVENUES THAT CAME IN, 56.3 THAT WENT OUT, 4.8 OF OF OTHER FINANCING SOURCES, WHICH ARE TYPICALLY TRANSVERSE, UH, THINGS LIKE THAT. AND SO OVERALL, YOUR INCREASE IN GENERAL FUND WAS $4.4 MILLION. AT THE END OF THE YEAR. YOU'RE SITTING AT 30.6. UH, THAT DOES INCLUDE A COUPLE OF, UH, THAT'S NOT AN UNASSIGNED FUND BALANCE. THE NEXT SLIDE WILL PROVIDE A, A LITTLE MORE DETAIL ON THAT FUND BALANCE THERE. UH, FOR NOW, YOU CAN SEE ALSO ON YOUR CAPITAL PROJECTS FUND AND DEBT SERVICE FUND, HOW, UH, YOUR CAPITAL PROJECTS FUND DECREASED OVERALL 2.2, UH, IN THE CURRENT YEAR. AND THEN YOUR DEBT SERVICE FUND, HOW HAD A $1.4 MILLION INCREASE. UH, EVERYTHING THAT DOESN'T QUALIFY, ALL THE GOVERNMENTAL FUNDS DON'T QUALIFY AS MAJOR FUNDS GET LUMPED INTO ONE, UH, WHICH WE CALL NON-MAJOR FUNDS. AND YOU CAN SEE THAT THAT SUMMARIZED THERE TOO. OVERALL, AT THE END OF THE YEAR FOR ALL YOUR GOVERNMENTAL FUNDS, THERE WAS ABOUT AN $8.1 MILLION INCREASE. AT THE END OF THE YEAR, YOU'RE SITTING AT 99 POINT, ROUGHLY $99.8 MILLION. AND THEN FOR YOUR GENERAL FUND HERE, THE FIRST COUPLE BULLET POINTS HERE, UH, IS JUST POINTING OUT YOUR, YOUR REVENUES WERE $2.8 MILLION, UH, OVER BUDGET. UH, YOUR EXPENDITURES WERE $8.6 MILLION, UH, UNDER BUDGET. AND THAT'S BASED ON YOUR FINAL AMENDED BUDGET. UH, OVERALL, AS I MENTIONED ON THAT PREVIOUS SLIDE IN THE GENERAL FUND, THERE WAS A $4.4 MILLION INCREASE IN FUND BALANCE, AND IT'S 30.6 AT THE END OF THE YEAR. THOSE LAST, UH, FOUR BULLET POINTS THERE WILL SHOW YOU THE BREAKDOWN OF THAT FUND BALANCE. SO YOU HAVE ABOUT $700,000 THAT IS NOT IN NONS SPENDABLE FORM, UH, UH, DUE TO PREPAIDS. THEN YOU HAVE 1.2 COMMITTED FOR DIFFERENT ITEMS. AND THEN YOU'RE ASSIGNED FUND BALANCE, UH, IS 8.4. SO OVERALL, THE $20.3 MILLION IS YOUR UNASSIGNED FUND BALANCE AT THE END OF THE YEAR. AND, UH, JUST A COUPLE, UH, ANOTHER SLIDE HERE ON YOUR $20.3 MILLION OF UNASSIGNED, UH, FUND BALANCE. UH, I WENT BACK FIVE YEARS TO KIND OF SHOW YOU, UH, THIS METRIC THAT YOU CAN COMPARE THAT TO YOUR OPERATING EXPEN, UH, EXPENDITURES. UH, SO TYPICALLY WE, YOU KNOW, WE, THE, THE, THE KIND OF THE METRIC THAT THE, THE METRIC THAT PEOPLE LIKE TO SEE IS ANYWHERE BETWEEN 25%, WHICH IS, WHICH IS 90 DAYS OF OPERATIONS. YOU CAN SEE THIS YEAR, UH, THE CITY'S SITTING AT 36.1, WHICH IS ROUGHLY ABOUT 130 DAYS. SO, UH, YOU'RE, YOU'RE AHEAD OF THAT 25%, AND YOU'VE BEEN OVER THAT 25% OVER THE LAST FIVE YEARS. AND PROBABLY BEFORE THAT, I DIDN'T GET, I DIDN'T GET TO GO BACK FURTHER THAN THAT. BUT, UH, YOU CAN SEE THAT HOW THAT'S BEEN, UH, OVER THE LAST FIVE YEARS. AND THEN WE'LL JUMP OVER TO THE OTHER, UH, YOUR [01:15:01] ENTERPRISE FUND. SO THIS INCLUDES YOUR UTILITY FUND AS WELL AS YOUR GOLF COURSE FUND. UH, AND THEN AT THE, ON THE RIGHT HAND SIDE, YOU CAN SEE THE TOTAL FOR BOTH OF THOSE. UH, ON YOUR UTILITY FUND, THERE WAS A SIGNIFICANT INCREASE OF, UH, 56, ALMOST $56.7 MILLION. THE MAJORITY OF THAT HAS TO DO WITH CAPITAL CONTRIBUTIONS. THAT WAS 43.7. UH, AT THE END OF THE YEAR, YOU'RE SITTING AT 4,469, ALMOST $470 MILLION THERE. AND THEN YOUR GOLF COURSE THERE BROUGHT IN, UH, ALMOST 2.7, 2.1 WENT OUT. OVERALL, THERE WAS AN INCREASE OF ABOUT 570,000. YOU'RE SITTING AT ALMOST $4.8 MILLION AT THE END OF THE YEAR. AND MY LAST COUPLE OF SLIDES THAT I HAVE ON HERE IS JUST REQUIRE COMMUNICATIONS. AS AN AUDITOR, WE ARE REQUIRED TO COMMUNICATE A FEW THINGS TO YOU. SO, UH, AS FAR AS YOUR ACCOUNTING POLICIES, WE DO LOOK AT THAT OVER THE COURSE OF OUR AUDIT. UH, WE DO CONSIDER THOSE TO BE IN ACCORDANCE WITH INDUSTRY STANDARDS. UM, I DID MENTION GSB 96 EARLIER, SO THAT WAS IMPLEMENTED THIS YEAR. SO JUST INFORMING YOU OF THAT. AND THEN, UH, AS FAR AS YOUR, UH, FINANCIAL STATEMENTS, UH, THEY DO INCLUDE ACCOUNTING ESTIMATES. AND SO THESE TWO HERE ARE THE ONES THAT WE CONSIDER TO BE SIGNIFICANT. SO WE HAVE THE ALLOWANCE FOR UNCOLLECTIBLE ACCOUNTS, SO ANY ALLOWANCE ON YOUR RECEIVABLES, AND THEN YOUR O UH, PENSION AND OP E UH, ESTIMATES THERE. AS FAR AS, UH, A RISK ASSESSMENT, SO EVERY AUDIT THAT WE PERFORM IS A RISK BASED AUDIT. SO WE'LL PERFORM A RISK ASSESSMENT, AND THAT'S KIND OF WHAT DRIVES THE REST OF THE AUDIT. SO WITHIN THAT RISK ASSESSMENT, UH, WE DO CONSIDER A MANAGEMENT OVERRIDE OF CONTROLS AS WELL AS IMPROPER REVENUE, RECOGNITIONS AS A RISK. UH, AND SO, UH, IT'S NOT SPECIFIC TO THE CITY. THAT'S JUST HOW WE DESIGN OUR AUDIT. AND AGAIN, I'LL GO BACK TO THAT SLIDE WHERE WE DIDN'T HAVE ANY FINDINGS. SO AT ANY POINT, UH, WE'RE TESTING YOUR CONTROLS, WE'RE LOOKING AT THINGS LIKE THAT. WE ARE IN THE BACK OF OUR HEAD. WE'RE, WE'RE, WE'RE, UH, WE ARE AWARE THAT THESE, UH, RISKS ARE OUT THERE, AND WE DON'T, WE DIDN'T HAVE ANY FINDINGS WHEN IT CAME TO THAT. UM, WE DID NOT ENCOUNTER ANY DIFFICULTIES, UH, WITH MANAGEMENT OR DISAGREEMENTS WITH MANAGEMENT. AND, UM, ALL ADJUSTMENTS, UH, WERE REVIEWED AND APPROVED BY MANAGEMENT. WE ALSO OBTAINED A REPRESENTATION LETTER PRIOR TO US ISSUING OUR FINAL REPORT, AND THAT ESSENTIALLY JUST REPRESENT MANAGEMENT REPRESENTING TO US THEIR RESPONSIBILITIES. WHEN IT COMES TO THE FINANCIAL STATEMENT AUDIT, WE'RE NOT AWARE OF ANY SITUATIONS IN WHICH MANAGEMENT CONSULTED WITH OTHER ACCOUNTANTS OR ACCOUNTING, UH, OTHER ACCOUNTING FIRMS REGARDING, UH, FINANCIAL REPORTING MATTERS. SO BASICALLY WE'RE NOT AWARE THAT THEY GOT A SECOND OPINION OR ANYTHING LIKE THAT. UH, WE ALSO DISCUSSED WITH MANAGEMENT, UH, THE APPLICATION OF DIFFERENT AUDITING STANDARDS. AND OUR RESPONSE TO THOSE INQUIRIES WERE NOT, UH, UH, A CONDITION TO OUR RETENTION AS AUDITORS. AND WITH THAT, DO YOU HAVE ANY QUESTIONS? THANK YOU, COUNSEL. I WAS JUST GONNA SAY THANK YOU FOR BEING CONCISE IN THIS PRESENTATION. I'VE SAT THROUGH MANY OF THESE AND IT'S NOT OFTEN EASY TO FOLLOW WHAT'S HAPPENING. SO THANK YOU FOR DOING THAT. YOU WELCOME. YES, THANK YOU. THIS WAS A, A WONDERFUL PRESENTATION AND KUDOS TO OUR ACCOUNTING AND FINANCE TEAM. Y'ALL DID A WONDERFUL JOB, MR. TURNER, MR. MAYOR MEMBER, MADAM MAYOR, AND MEMBERS OF THE COUNCIL, AS WELL AS MEMBERS OF THE PUBLIC. UH, I'M, I'M A LITTLE TAKEN BACK BY BY THIS WHOLE THING. THIS IS ONE OF THE CLEANEST AUDITS I'VE EVER HAD AN OPPORTUNITY TO EXPERIENCE. SO, UH, THANK YOU FOR THE PRESENTATION WAS VERY WELL DONE. UH, NOT ONLY TO FINANCE, I RECOGNIZE THAT THIS SAYS A LOT ABOUT THE ORGANIZATION AS A WHOLE. UM, AND SO I WANT TO COMMEND ALL THE CITY EMPLOYEES, AND PARTICULARLY THOSE WHO, UH, HANDLE THE PURCHASING AND, AND BUDGETING AND, UH, THINGS THAT A LOT OF FOLKS DON'T LIKE TO DO. IT'S A VERY GOOD AUDIT, AND THANK YOU VERY MUCH FOR DOING THAT. UM, COUNSEL AND MEMBERS OF THE PUBLIC, UH, THIS IS PRETTY GOOD. THIS IS VERY GOOD. AND SO THE, UH, YOU KNOW, COMMEND YOUR STAFF AS YOU ARE DOING FOR, FOR DOING SUCH A GOOD JOB, Y'ALL ARE FANTASTIC. WELL, WITH THAT, I WILL, UM, MAKE A MOTION TO ACCEPT THE REPORT, SECOND MOTION AND A SECOND. IS THERE ANY FURTHER DISCUSSION? ALL THOSE IN FAVOR PASSES UNANIMOUSLY. THANK Y'ALL SO MUCH. WE'RE SO PROUD OF YOU. ALL RIGHT. ITEM NUMBER 29, [29. Council Member Future Agenda Items  [Any deliberation of or decision about the subject of the inquiry shall be limited to a proposal to place the subject on the agenda for a subsequent meeting.]] COUNCIL MEMBER, FUTURE AGENDA ITEMS. ANY DELIBERATION OF OR DECISION ABOUT THE SUBJECT OF THE INQUIRY SHALL BE LIMITED TO A PROPOSAL TO PLACE THE SUBJECT ON THE AGENDA FOR A SUBSEQUENT MEETING? DOES ANYBODY HAVE ANYTHING? I DO. UM, SO, YOU KNOW, WE, WE DID JUST CHANGE OUR SIGN ORDINANCE, AND I THINK THAT WAS A TREMENDOUS IMPROVEMENT. UM, BUT I THINK IT'S, I KNOW WE HAD TALKED ABOUT, UH, REVIEWING IT SINCE WE JUST HAD THE ELECTION. I THINK I, AND I DID TALK TO, TO, UH, CHIEF DAVIS ABOUT IT. IF WE COULD JUST HAVE A, A LITTLE BIT OF FEEDBACK. UM, HE SAID IF WE DID IT THE FIRST WEEK IN APRIL, WE COULD, THAT WOULD GIVE HIM TIME, GET SOME FEEDBACK ON WHAT WORKED, WHAT DIDN'T WORK, SOME CLARIFICATIONS AND JUST SOME MINOR TWEAKS THAT WE MIGHT NEED TO DO JUST TO BE PREPARED FOR THE, THE NEXT ELECTION GOING FORWARD. I THINK THAT'S WHEN IT'S SET TO COME BACK IS SOMETIME, IS IT? I THOUGHT IT WAS AFTER THAT. DARA, [01:20:01] DO YOU KNOW? I'M SORRY. I, OKAY. OKAY. YEAH, HE SAID IF, IF WE CAN GET IT THE FIRST WEEK IN APRIL, THAT'S THE FOURTH. UM, THAT WOULD GIVE HIM TIME TO GET THROUGH THE WATER ISSUES.
