UM, THEY APPROVED THE AMENDMENT TO THE ZONING ORDINANCE FOR VAPE SHOPS, SMOKE SHOPS, AND COSMETIC SERVICES.

THEY ALSO, THE PEC PUT AMENDMENT NORTH CREEKSIDE COMMONS MINOR P AND THE A-C-C-L-I-S-D PORTABLE SPECIAL USE PERMIT.

Conduct a Public Hearing and consider action on Subdivision Variance Case VA-24-0018 regarding a variance request from Article III, Section 42 (b)(1) of the Subdivision Ordinance that requires all transportation improvements including streets, trails, driveways, sidewalks, bikeways, traffic control, and parking areas within the City’s jurisdiction shall be designed in accordance with the City of Leander Composite Zoning Ordinance, Transportation Master Plan, Comprehensive Plan and the City of Austin’s Transportation Criteria Manual and Article III, Section 42 (e) of the Subdivision Ordinance that requires sidewalks be installed by the developer on both sides of all streets within and immediately adjacent to a proposed development associated with 4.83 acres ± in size; more particularly described as Silencer Shop Site Development Plans; generally located to the northwest of FM 1431 and Vista Rock Drive, Leander, Williamson County, Texas.

ITEM NUMBER NINE, PUBLIC HEARING AND ACTION ON SUBDIVISION VARIANCE CASE, VA DASH 24 DASH 0 0 1 8 REGARDING A VARIANCE REQUEST FROM ARTICLE THREE, SECTION FOUR, TWO B ONE OF THE SUBDIVISION ORDINANCE THAT REQUIRES ALL TRANSPORTATION IMPROVEMENTS, INCLUDING STREETS, TRAILS, DRIVEWAYS, SIDEWALKS, BIKEWAYS, TRAFFIC CONTROL, AND PARKING.

AREAS WITHIN THE CITY'S JURISDICTION SHALL BE DESIGNATED IN ACCORDANCE WITH THE CITY OF LEANDER COMPOSITE ZONING ORDINANCE, TRANSPORTATION MASTER PLAN, COMPREHENSIVE PLAN, AND THE CITY OF AUSTIN'S TRANSPORTATION CRITERIA MANUAL.

AND ARTICLE THREE, SECTION FOUR, TWO E OF THE SUBDIVISION ORDINANCE THAT REQUIRES SIDEWALKS BE INSTALLED BY THE DEVELOPER ON BOTH SIDES OF ALL STREETS WITHIN AN IMMEDIATELY ADJACENT TO A PROPOSED DEVELOPMENT.

UM, DURING THE REVIEW OF THE ASYLUM FOR SHOP SITE DEVELOPMENT PLANS, THE APPLICANT EXPRESSED CHALLENGES ABOUT THE FUTURE EXTENSION OF IMPROVEMENTS THAT ARE LOCATED ALONG FM 1431.

THE CHALLENGES AS, UM, DESCRIBED IN THE LETTER OF INTENT PROVIDED TO YOU IN THE PACKET INCLUDE ITEMS RELATED TO LIVESTOCK, ROCK LEDGES, STEEP CONTOURS, EXISTING BURIED TELECOM LINES, AND NUMEROUS TREES IN THE AREA.

THE APPLICANT IS REQUESTING A VARIANCE TO THE SUBDIVISION ORDINANCE REGARDING THE REQUIREMENT THAT SIDEWALKS BE INSTALLED BY THE DEVELOPER ON BOTH SIDES OF THE STREETS WITHIN AND IMMEDIATELY ADJACENT TO THE PROPOSED DEVELOPMENT.

THE REMOVAL OF THIS REQUIREMENT WOULD CREATE A SITUATION WHERE THERE WOULD BE NO SIDEWALKS ON THIS SECTION OF FM 1431 WHEN THE NEIGHBORING PROPERTIES ALONG THIS ROADWAY DEVELOP IN THE FUTURE.

SO THIS IS THE LOCATION MAP.

IT'S CURRENTLY, UM, NOT DEVELOPED SURROUNDING IT, AND THIS IS THEIR SITE DEVELOPMENT HIGHLIGHTING THE AREA THAT WOULD NOT HAVE THE SIDEWALK.

AND, UM, STAFF IS, HAS REVIEWED THE SITE DEVELOPMENT PLAN AND SUPPORTS THEIR REQUEST FOR THE VARIANCE.

DUE TO THE SAFETY CONCERNS, THE COMMISSION WILL NEED TO CONSIDER THE FOLLOWING FINDINGS.

WHEN MAKING THIS DETERMINATION, THERE'S A LIST OF EIGHT ITEMS THAT YOU'LL NEED TO CONSIDER.

SO THIS IS JUST A REGULAR AGENDA ITEM.

YOU'RE NOT HAVING A PUBLIC HEARING TODAY.

UM, DURING THE JUNE 27TH MEETING, THE COMMISSION HELD THE PUBLIC HEARING AND DELAYED ACTION.

FOLLOWING THE DISCUSSIONS, COMMISSION HAD ASKED STAFF TO CLARIFY STANDARDS FOR LIGHTING, PROVIDED DEFINITION OF LOCALLY PRODUCED AND ADJUST THE REQUIREMENTS FOR THE VENDOR TYPES.

STAFF HAS PROVIDED AN UPDATE UPDATED RED LINE FOR REVIEW, UM, WHICH INCLUDES THE CHANGES THAT WERE REQUESTED.

WE DID ADD LIGHTING ASSOCIATED WITH THE ENTERTAINMENT DISTRICT TO CLARIFY VISIBILITY FROM RESIDENTIAL PROPERTIES AND PUBLIC RIGHT OF WAY.

WE ADDED A DEFINITION FOR LOCALLY PRODUCED AND WE REDUCED THE PERCENTAGE OF FOOD VENDORS FOR FARMER'S MARKET.

THE, I KNOW IN THE DISCUSSIONS WE TALKED ABOUT SIGNS, THE SIGN ORDINANCE THAT WAS ADOPTED LAST YEAR DOES ALLOW FOR A MASTER SIGN PLAN INTENDED TO PROVIDE FOR THE CONSISTENT AND ARCHITECTURALLY COMPATIBLE PLAN FOR MULTIPLE SIGNS WITHIN A DEVELOPMENT.

THE FARMER'S MARKET WOULD BE ELIGIBLE FOR A PROMOTIONAL EVENT PACKAGE, WHICH IS PART OF THE, THE SIGN ORDINANCE, AND THAT INCLUDES TEMPORARY SIGNAGE WITH THE ADDITION OF SUPER FLAGS, HUMAN SIGNS AND BANDIT SIGNS.

IF STAFF NOTICES THAT THERE ARE ANY CHANGES THAT MAKE IT PROHIBITIVE THAT WE SHOULD MAKE ANY CHANGES, UM, THEN WE CAN GO AHEAD AND REVIEW IT AS WE DO ON AN ANNUAL BASIS AND WE CAN MAKE UPDATES THEN.

UM, IS THAT SOMETHING THEY'LL HAVE TO APPLY FOR SEPARATELY ALONG WITH THE FARMER'S MARKET APPLICATION, OR CAN IT JUST BE FOLDED INTO IF YOU GET AN APPROVAL FOR A FARMER'S MARKET, THEN THIS PACKAGE OF PROMOTIONAL MATERIAL HAPPENS BY, RIGHT.

NO, THEY WOULD HAVE TO APPLY FOR IT.

AND CHANGING THAT WOULD REQUIRE A CHANGE TO THE, TO THE SIGN ORDINANCE.

I THINK THE CORE IDEA IS FANTASTIC.

I THINK THAT IT COULD EVENTUALLY BECOME PART AN ESSENTIAL PART OF OUR CITY'S PLACE BRANDING.

AND, UM, IN THAT REGARD, I'D LIKE TO SEE US DO SOMETHING EXTRAORDINARY.

UM, AND YOU KNOW, WHEN I LOOK AT SOMETHING AS SIMPLE AS A FARMER'S MARKET AND I SEE, UM, THE PERCENTAGES, YOU KNOW, SPECIFIED AND, AND THE MIX OF THE VENDORS, UM, I KNOW I WANTED IT REDUCED LAST TIME.

UH, I, I REALLY WANNA SEE IT ELIMINATED, UM, COMPLETELY.

AND I WANNA SEE ELIMINATION OF THE LOCAL DEFINITION, UM, AND JUST LET, YOU KNOW, GET OUR HANDS OFF OF THIS AND LET THE, THE HAND OF THE FREE MARKET KIND OF DETERMINE THE MIX OF THESE MARKET, OF THESE FARMER'S MARKETS, UH, EVENTUALLY WHAT, WHATEVER THEY ARE, THEY ARE.

UM, I'D LIKE TO SEE THE SIZE REQUIREMENT EITHER REDUCED FROM 10 ACRES TO SOMETHING MORE LIKE TWO OR THREE, OR ALTERNATIVELY SPECIFY A MINIMUM NUMBER OF BUSINESSES THAT COULD PARTICIPATE IN THE ENTERTAINMENT.

I'M TALKING ABOUT THE ENTERTAINMENT DISTRICT PART NOW.

UM, THAT WOULD, WOULD BE ELIGIBLE TO, TO FORM AN ENTERTAINMENT DISTRICT.

UM, COMING BACK TO THE FARMER'S MARKET ISSUE, YOU KNOW, IF WE DEFINE LOCAL AS TEXAS ONLY, WHICH IS MY UNDERSTANDING OF WHAT WE'VE, WE'VE DONE HERE, UM, LET'S SAY WE'VE GOT A FARMER'S MARKET THAT, YOU KNOW, THERE'S A, THERE'S AN ARTIST FROM FLORIDA TRAVELING THROUGH TOWN.

UH, HE OR SHE DOES THE, THE ARTIST CIRCUITS WHERE THEY SET UP AND EXHIBIT AT THESE VARIOUS, YOU KNOW, UM, UH, MARKET TYPE THINGS.

I SEE NO PROBLEM WITH ALLOWING THEM IN, UH, FOR A DAY OR A NIGHT IN LEANDER.

AND THAT'S SOMETHING THAT, THAT I, I, I, I JUST WANNA SEE DONE AS A MATTER OF, RIGHT, WHEN I LOOK AT A LOT OF THESE SPECIFIC REQUIREMENTS THAT WOULD TURN OUT TO BE DISINCENTIVES FOR SOMEBODY EVEN TO EVEN TO PUT TOGETHER ONE OF THESE MARKETS.

I, I WANNA RELIEVE STAFF AND, UH, OF TAKE QUESTIONS OFF OF THE APPLICATIONS FOR THIS AND MINIMIZE THE AMOUNT OF STAFF INVOLVEMENT WHEN WE'VE GOT SOMEBODY WHO'S PLANNING A MARKET AND THEY'RE THINKING, OH GOSH, WE'VE, UM, YOU KNOW, RIGHT NOW WE'VE GOT, UH, SIX VENDORS WHO ARE OF THIS TYPE AND WE'VE GOT FOUR OF THIS TYPE.

WE CAN'T ADD ONE MORE OF THE OTHER TYPE BECAUSE WE'LL BE OUTTA COMPLIANCE.

UM, I, I JUST THINK IT'S, IT'S, IT'S KIND OF SILLY TO BE REGULATING, UH, AT THAT LEVEL OF MINUTIA.

AND I DON'T THINK THERE'S A COMPELLING CITY INTEREST IN DOING IT.

IF, IF AN ARTIST FROM FLORIDA OR A, A RANCHER FROM OKLAHOMA SETS UP TO SELL SOMETHING AT ONE OF THESE FARMER'S MARKETS, NOBODY GETS HURT.

NOBODY DIES.

THERE'S NO ISSUE, THERE'S NO SAFETY CONCERNS.

UM, SO I'D LIKE TO GET RID OF THAT, THAT LOCAL DEF DEFINITION AS WELL.

UM, AND UH, I THINK THAT'S PRETTY MUCH EVERYTHING I'VE GOT RIGHT NOW.

BUT I, YOU KNOW, I REALLY BELIEVE THIS IS AN IMPORTANT PART OF BRANDING.

AND, AND WHEN WE THINK ABOUT A BRAND, I'VE TALKED ABOUT BRAND IN OTHER, UH, CONTEXTS OF OTHER CASES, IT'S EVERY SINGLE THING WE DO EVERY DAY IN THE CITY.

UM, IT'S EVERY INTERACTION THAT STAFF HAS WITH EVERYBODY.

IT'S EVERY ORDINANCE WE PASS.

IT'S, IT'S REALLY A COMMUNITY BASED THING THAT ADDS UP INTO THE TOTALITY OF WHAT IS OUR BRAND.

AND I'D LIKE TO SEE OUR BRAND IN THIS REGARD FOR THE FARMER'S MARKET BE, UH, BE AS HANDS-OFF AS POSSIBLE AND LET'S JUST BE SURPRISED AND DELIGHTED BY WHAT THE FREE MARKET BRINGS US IN THESE THINGS AND LET THE CREATIVITY OF THESE ENTREPRENEURS REALLY KIND OF RULE WHAT HAPPENS.

UM, AND I'LL SAVE, UM, WELL, ONE MORE COMMENT ON, ON THE SIGN ORDINANCE.

I KNOW WE WE'RE, WE'RE LOOKING AT THAT EVERY YEAR FROM A STAFF STANDPOINT.

I KNOW WHEN IT WAS PASSED IN SEPTEMBER OF 2023, IT WAS DONE WITH THE INTENTION OF LOOKING AT IT IN SIX MONTHS, UH, WHICH WOULD'VE BEEN SOMETIME IN MARCH.

AND I KNOW WE'VE BEEN DOING A LOT WITH HIRING A NEW CITY MANAGER AND ALL OF THAT.

UM, BUT, BUT I KIND OF WANNA BRING THAT BACK UP AND JUST PUT IT ON THE RADAR THAT IT'S SOMETHING THAT SHOULD BE LOOKED AT.

I THINK IT WOULD BE A GOOD THING TO LOOK AT IN THE CONTEXT OF THIS ENTERTAINMENT OVERLAY AND THE FARMER'S MARKET.

UM, BUT AS IT STANDS, I'M ABSOLUTELY A NO ON THIS WITHOUT THE CHANGES AND THE ELIMINATIONS OF THOSE REQUIREMENTS.

UM, SO THEY'RE NOT EX PROHIBITED FROM BEING AT THE FARMER'S MARKET IS THEY'RE NOT LOCAL, IT'S JUST A CERTAIN PERCENTAGE NEEDS TO BE LOCAL.

SO IF THERE IS A VENDOR FROM FLORIDA OR OKLAHOMA, THEY CAN STILL BE AT THE FARMER'S MARKET.

YEAH.

THEY JUST WOULDN'T BE COUNTED TOWARDS THAT 40%.

AND I'D LIKE TO SEE THAT PERCENTAGE REQUIREMENT ELIMINATED.

SO QUESTION FOR YOU.

SO THEN IF YOU SAID THE CERTAIN PERCENTAGE NEEDS TO BE LOCAL, LET'S SAY WE HAVE A NEW FARMER'S MARKET THAT'S, THAT'S COMING INTO, YOU KNOW, EXISTENCE AND WE ONLY HAVE 20% LOCAL AND THEN MAYBE, OR I SHOULD SAY 50% OF IT'S LOCAL OR 50%.

I SAID THAT ANSWERS MY QUESTION SO THAT IT TAKES CARE OF THAT.

BECAUSE IF IT'S ONLY LIKE WHAT I'M GETTING AT, IF IT'S LIKE 10 VENDORS YEAH.

AND HALF OF THEM, OR I GUESS, BUT THEN, THEN THERE'S YOUR PERCENTAGE.

BUT IF YOUR, IF YOUR PERCENTAGE GROWS AND LET'S SAY YOU HAVE A LOT MORE OUT OF STATE VENDORS THAT ARE COMING IN, YOU STILL WANNA MAINTAIN THAT 40%.

I I I THINK PERSONALLY WE SHOULD JUST GO AHEAD AND ALLOW THIS TO FLOW THROUGH, BUT I'M ASSUMING THAT WE COULD CHANGE THIS DOWN THE ROAD IF WE SEE A NEED.

TO REDUCE THAT PERCENTAGE FROM 40.

WE ALREADY TOOK THE 80 DOWN TO 40 AND THAT WAS KIND OF THE POINT OF CONTENTION LAST WEEK.

WHY WE POSTPONED THIS WITH THE FARMER'S MARKET.

I FEEL LIKE 40 WAS KIND OF THE, THE, UH, NUMBER THAT WE WOULD ACCEPT.
