I WISH THERE HAD BEEN MORE OF AN EFFORT IN THE DESIGN TO TRY TO PRESERVE ONE OR MORE TREES. COMMISSIONER, MAY I AGREE WITH YOU, MY OTHER COMMISSIONERS, IT REALLY, REALLY HURTS TO SEE ALL THE TREES GOING AWAY. I'M ALSO VERY PRO-BUSINESS PERSON, BUT IT IT IT REALLY DOES HURT TO SEE THESE TREES GO AWAY, THAT'S ALL, MR. MORALES. SO LOOKING AT THE SITE PLAN, I GUESS HERE IT YOU KNOW, IT'S NOT ACTUALLY WHERE THE BUILDING FOOTPRINT IS. I GUESS WITH THE CANOPY OVERLAP THE BUILDING. I KNOW YOU GOT SOME HANDICAP PARKING. THAT WAS IT. IT WAS SAID THAT YOU COULDN'T FIT IT ON HERE OR WE JUST DIDN'T REALLY TRY. LIKE, COULD WE HAVE PUT SOME ON THE OUTSIDE OR WAS IT JUST TRYING TO MAXIMIZE THE AMOUNT OF PARKING DIRECTLY ADJACENT ADJACENT TO THE BUILDING? IF IT'S OKAY IF I CAN ADDRESS THAT. SO THIS UNDERNEATH THE PROPERTY AND I'M THE PROPERTY OWNER. SO UNDERNEATH THE PROPERTY IS A BASKET OF SNAKES OF ELECTRICAL AND PLUMBING AND EVERYTHING ELSE. AND SO THIS IS PROBABLY THE THIRD OR FOURTH ITERATION OF OUR SITE PLAN TO TRY TO SAVE THE TREES. RIGHT NOW, THE TREE THAT YOU HAVE WHICH WASN'T MENTIONED, IT'S IN A DRIVE THROUGH THAT GOES BEHIND THE BUILDING FOR THE EXTRA SPACE. AND SO EVEN THERE'S A SIGNIFICANT GRADE CHANGE BETWEEN THE STREET AND THE BUILDING. EVEN IF YOU FILLED THE WHOLE SITE, THE TREES WOULD DIE.I MEAN, JUST FILLING THE SITE, PUTTING 2 OR 3FT OF DIRT ON TREES IS NOT FEASIBLE FOR THE ROOT SYSTEM. AND SO THE BASKET OF SNAKES UNDER THE PROPERTY, WITH THE WITH ALL THE CANOPIES AND EVERYTHING ELSE WOULD MAKE IT UNSOLVABLE FOR REALLY FOR ALL THE TREES. SECOND OF ALL, THERE'S A LOT OF RULES ON BUILDING A PROFITABLE GAS STATION. AND I THINK IN THE PAST THIS HAS BEEN A FIVE YEAR JOURNEY. IN ABOUT THE LAST, I THINK WE'VE BROKEN ABOUT EVERY RULE TO MAKE A GAS STATION, TO MAKE THIS WORK BETWEEN LAYOUTS AND VISIBILITIES AND HOW CARS CIRCULATE AND EVERYTHING ELSE. AND COVID BROUGHT IN A DRIVE THROUGH REQUIREMENT FOR MOST STUFF TO MAKE THINGS JUST IN CASE, AND TO LOSE THE DRIVE THROUGH. AT THIS POINT, THE ECONOMIC FEASIBILITY WOULD BE REALLY ROUGH ON THIS SITE, GIVEN IT'S BEEN FIVE YEARS OF HOLDING COSTS, FIVE YEARS OF INTEREST. THAT'S PROBABLY THREE YEARS LONGER THAN WE THOUGHT, AS WELL AS JUST LOSING THE DRIVE THROUGH AND LOSING THE DEMAND FOR THE SITE. SO THERE WAS LOTS OF DIFFERENT ITERATIONS 3 OR 4 YEARS AGO ABOUT TRYING TO ALL THE SITE PLANS AND STORMWATER AND EVERYTHING ELSE. IT JUST THIS IS WHILE THE SITE LOOKS BIG, IT'S A TRAPEZOID. THERE'S A LOT OF WASTED SPOT. IT'S A REALLY TIGHT SITE WHERE THE WHOLE THING IS ALMOST USED UP WITH ALL THE REQUIREMENTS BETWEEN BUSINESS REQUIREMENTS AND CITY OF LEANDER REQUIREMENTS. DOES THAT MAKE SENSE? YEP. THANK YOU. NO OTHER COMMENTS FROM MYSELF AND COMMISSIONER MAYHEM. I'M ABOUT AS GOOD AS I'M GOING TO GET ON THIS ONE. SO YEAH. REGARDING REMOVAL OF TWO HERITAGE TREES ASSOCIATED WITH THE WILD SPRINGS SUBDIVISION AND THE CR 175 PUBLIC IMPROVEMENT CONSTRUCTION PLAN CASE, PC P DASH 20 THREE, DASH 0052 GENERALLY LOCATED NORTHWEST OF THE INTERSECTION OF CR 177 AND CR 175. LEANDER, WILLIAMSON COUNTY, TEXAS. STAFF PRESENTATION. THANK YOU. I'M KARINA CASTILLO WITH THE PLANNING DEPARTMENT, AND THIS IS A VERY SIMILAR REQUEST TO THE ONE THAT YOU JUST HEARD. THIS IS GOING TO BE THE FIRST STEP IN THE TREE REMOVAL PROCESS. THIS ONE IS A LITTLE DIFFERENT BECAUSE THIS ONE IS HERITAGE TREES. SO THE APPLICANT HAS SUBMITTED A REQUEST TO REMOVE TWO HERITAGE TREES THAT TOTAL 57 CALIPER INCHES. DUE TO THE PUBLIC IMPROVEMENT CONSTRUCTION PLANS THAT ARE ASSOCIATED WITH COUNTY ROAD 175 EXPANSION AND REALIGNMENT. PER THE COMPOSITE ZONING ORDINANCE, THE REMOVAL OF HERITAGE AND OR SIGNIFICANT TREES THAT ARE GREATER THAN 18 CALIPER INCHES REQUIRE THE APPROVAL OF THE COMMISSION, AND ANY HERITAGE TREES REQUIRE THE APPROVAL OF CITY COUNCIL WHEN THERE ARE OVER 26IN. SO THIS SITE IS CURRENTLY MOSTLY SURROUNDED BY MOSTLY UNDEVELOPED LAND. THERE IS SOME RESIDENTIAL TO THE SOUTH AND TO THE EAST THAT'S CREEK MEADOWS ESTATE AND EDGEWOOD SUBDIVISION, AND THE COUNTY ROAD 175 INCLUDES SIGNIFICANT BENDS IN THE ROAD, WHICH WILL MAKE IT DIFFICULT TO PRESERVE THE ADJACENT TREES WHEN WORKING TO IMPROVE THE ALIGNMEN. SO SIMILAR TO THE OTHER REQUEST, THEY WILL NEED TO PAY FOR MITIGATION FEES AND DO THE MITIGATION 3 TO 3IN FOR EVERY CALIPER INCH THAT THEY'RE REMOVING, AND THE FEE IS $300 PER CALIPER INCH, SO THEY WILL BE PAYING A LITTLE OVER $17,000.AND THAT WILL BE PAID THROUGH THE CONSTRUCTION PLANS. AND IT WILL ALSO BE MITIGATED THROUGH THE CONSTRUCTION PLANS. AND THE APPLICANT IS NOT HERE. THEY WERE NOT ABLE TO MAKE IT TONIGHT, BUT I CAN TRY AND ANSWER ANY QUESTIONS ON THEIR BEHALF. ALL RIGHT. THIS IS DISCUSSION REGARDING THE COMPREHENSIVE PLAN IMPLEMENTATION SCHEDULE. LEANDER WILLIAMSON AND TRAVIS COUNTY, TEXAS, WELCOME BACK. THANK YOU. AND THE CITY COUNCIL ADOPTED THE COMPREHENSIVE PLAN THAT'S IN PLACE TODAY ON APRIL OF 2021. WE HAVE COMPLETED SEVERAL UPDATES SINCE THEN, AND THEY ARE INCLUDED IN THE HISTORY TIMELINE SECTION OF THE EXECUTIVE SUMMARY. IT IS A VERY LONG HISTORY, AND WE'VE HAD A FEW UPDATES THIS YEAR, INCLUDING SEVERAL THAT WERE FROM THE CITY OF LEANDER AND SEVERAL THAT WERE FROM THE APPLICANTS ON FUTURE LAND USE MAP UPDATES. SO I WON'T GO THROUGH ALL OF THEM, BUT I CAN HELP ANSWER ANY QUESTIONS THAT YOU DID HAVE. ANY QUESTIONS ON THOSE? AND THE COMMISSION IS PRESENTED WITH AN UPDATE OF THE COMPREHENSIVE PLAN IMPLEMENTATION SCHEDULE TO IDENTIFY THE PROGRESS MADE TO THE COMPREHENSIVE PLAN, AND TO INFORM OF UPCOMING UPDATES. THE COMMISSION HAS THE OPPORTUNITY TO MAKE RECOMMENDATIONS. I'M SORRY, I THOUGHT THAT WAS UPDATED. WE'LL COME BACK LATER ON FOR SOME RECOMMENDATIONS LIKE WE DID LAST YEAR FOR SOME CAPITAL IMPROVEMENT PROJECTS. SO WE DID HAVE SOME GOALS THAT WERE UPDATED IN THE PAST YEAR THAT HAVE BEEN COMPLETED. SO WE HAVE A LIST OF THINGS I CAN READ THROUGH THEM IF YOU'D LIKE, BUT IT'S A LOT OF WORDS, AND I'M NOT SURE THAT I FEEL LIKE YOU'VE ALREADY READ IT AND I DON'T NEED TO READ IT TO YOU. AND THEN WE DO HAVE SOME UPCOMING UPDATES. SO SOME OF THE THINGS THAT WE DID THIS YEAR WAS THE NOISE ORDINANCE THAT WAS AMENDED TO ADOPT NEW REGULATIONS IN FEBRUARY AND MARCH. WE DID THE WASTEWATER PLAN TO BE UPDATED TO INCLUDE NEW DEMAND PROJECTIONS AND RECOMMEND CAPITAL[00:20:02]
IMPROVEMENT PROJECTS. AND THEN IN JUNE OF 24, WE DID SOME UPDATES TO INCLUDE DEFINITIONS AND REGULATIONS FOR VAPE SHOPS AND SMOKE SHOPS. ALSO IN JUNE, WE DID UPDATES TO OUR SUBDIVISION ORDINANCE TO ALLOW FOR THE APPLICATIONS TO BE APPROVED ADMINISTRATIVELY UNLESS THEY REQUIRE TREE REMOVALS OR A PUBLIC HEARING. AND THEN IN JULY WE DID UPDATES TO INCLUDE AN OVERLAY FOR ENTERTAINMENT DISTRICT AND INCLUDE SOME ADDITIONAL DEFINITIONS AND REGULATIONS. IN SEPTEMBER, WE ADOPTED WE ADOPTED AN ORDINANCE THAT ALLOWS FOR THE LICENSE AGREEMENTS TO BE APPROVED BY THE CITY MANAGER. SEPTEMBER. THE PARKLAND DEDICATION, PARK IMPROVEMENT AND PARKLAND FEE IN LIEU REGULATIONS WERE AMENDED. WE ADJUSTED FOR THE CALCULATION OF THE FEES AND ADOPTED NEW IMPROVEMENT FEES. IN OCTOBER, WE DID AN UPDATE TO THE THOROUGHFARE MASTER PLAN AND THE WASTEWATER MASTER PLAN THAT INCLUDED SOME REALIGNMENTS OF PROPOSED ROADS, REMOVAL OF SOME ROADS, AND THE ADDITION OF NEW ROADS. AND THEN THE WASTEWATER MASTER PLAN WAS AN UPDATE TO JUST CONSIDER THE RECENT GROWTH PROJECTIONS AND RECOMMEND SOME PROJECTS. IN NOVEMBER, WE DID UPDATES TO THE TYPE TWO SITE COMPONENT REGULATIONS TO ADJUST FOR BUILDING SIZE MAXIMUMS WHEN NOT ADJACENT TO RESIDENTIAL USES. AND THEN IN DECEMBER, WE DID THE AN UPDATE TO THE COMPOSITE ZONING ORDINANCE TO INCLUDE NEW STANDARDS FOR DRY UTILITIES AND ADDED EARLY GRADING PHASE WITH SITE DEVELOPMENTS. AND THEN UPCOMING WE HAVE THE WIRELESS COMMUNICATION FACILITIES TO BE ADOPTED IN FEBRUARY. HOPEFULLY, IF EVERYTHING IS ON SCHEDULE AND THAT INCLUDES UPDATED REGULATIONS THAT ACCOMMODATE NEW TECHNOLOGIES. SO THE CHARTER DOES REQUIRE THAT WE LOOK AT THE COMPREHENSIVE PLAN FOR AMENDMENTS OR REVISIONS EVERY FIVE YEARS. THE CITY COUNCIL HAS APPROVED THE REQUEST FOR PROPOSAL FOR THE COMPREHENSIVE PLAN UPDATE IN DECEMBER, AND THAT WILL ALSO INCLUDE AN UPDATE TO THE TRANSPORTATION MASTER PLAN AND SUGGESTED ACTIONS TO SUBSEQUENTLY UPDATE THE COMPREHENSIVE. THE COMPOSITE ZONING ORDINANCE, SUBDIVISION ORDINANCE, AND OTHER DEVELOPMENT REGULATIONS AND STANDARDS. A CRITICAL PIECE OF THE UPDATE WILL BE TO INCLUDE THE ECONOMIC DEVELOPMENT ELEMENT THAT PROVIDES AN ANALYSIS TO INCLUDE A RECOMMENDATION AND RECOMMENDED LAND USE MIX THAT WILL ACHIEVE ECONOMIC SUSTAINABILITY FOR THE CITY. THE NEXT STEP IN THE PROCESS IS FOR STAFF TO ISSUE THE RFP AND EVALUATE SUBMISSIONS. SO I'VE ALSO INCLUDED THE TABLE OF ALL OF THE GOALS THAT WE HAD. ANY MINUTE NOW. SO WE'RE JUST WAITING FOR THE INTERNAL APPROVAL SO THAT WE CAN POST IT. AND THEN WE CAN GET STARTED ON THAT. SO THE TIMELINE FOR US AND YOU KNOW, CAN YOU JUST MAYBE ROUGHLY TALK ABOUT, YOU KNOW, HOW LONG IT'S GOING TO TAKE AND, AND WHEN WE EXPECT IT TO GO BACK TO COUNCIL. AND THERE WILL BE SOME NEGOTIATION OF THE CONTRACTS, MAKING SURE THAT THE SCOPE IS AGREED UPON BEFORE WE DO AN ACTUAL KICKOFF. ONCE WE START THE CONTRACT, IT WOULD BE ABOUT 18 MONTHS. OKAY.
