I'M MARK BERMAN, VICE PRESIDENT OF TREVIZO LIMITED, WHICH IS A PARTNERSHIP BETWEEN TAYLOR MORRISON AND TOLL BROTHERS. WE ACTUALLY FOUNDED OR ACQUIRED THE LAND THAT'S TREVIZO BACK IN 2012. WE STARTED DEVELOPMENT IN 2013, AND SOLD OUR FIRST HOME IN 2014 AND THEN CLOSED. BEGIN BEGAN CLOSING HOMES IN 2015. SO PROJECT TO DATE, WE'VE WE'VE SOLD 2000 HOMES AND CLOSED ROUGHLY ROUGHLY 1900. WE'RE LOOKING AT THE END OF THE COMMUNITY BEING AT ABOUT 3000 HOMES TOTAL. BASED ON OUR CURRENT PLAN. WOULD YOU MIND SWITCHING TO SLIDE TWO? DORA. YEP, THE ONE RIGHT BEFORE. I'M SORRY. YES. JUST A LITTLE BIT OF A DEVELOPER OVERVIEW ON WHERE WE'RE AT. SORRY ABOUT THAT, BUT INCEPTION TO DATE WE'VE ACTUALLY THE VALUES OF OUR PROPERTY IS ABOUT $1.7 BILLION, WHICH ROUGHLY IS ABOUT 10% OF THE TOTAL CITY, RESIDENTIAL OR COMMERCIAL REAL ESTATE CERTIFIED VALUES. WE HAVE 2141 ACRES OF LAND, AND WE'RE LOOKING TO ACQUIRE SOME LAND TO THE WEST OF TREVISO, APPROXIMATELY 100 ACRES THAT WOULD YIELD ABOUT 180 HOMES. WE ALSO RECENTLY ANNEXED IN ABOUT EIGHT ACRES OF PROPERTY THAT WAS APPROXIMATELY 20 HOMES THAT WE AND EXTEND FROM THE FORMER CEDAR PARK ETJ. WHAT WE WANTED TO TALK ABOUT REALLY WAS OVERALL OUR BOND CAPACITY. WHEN TREVISO WAS FIRST INITIATED AT ITS INCEPTION, WE DID NOT HAVE ANY TRACK RECORD AND I BELIEVE TREVISO WAS THE THE FIRST IN CITY MUD THAT THE CITY HAD APPROVED AT THAT TIME. WE HAD ESTABLISHED A CAP ON OUR ON OUR BOND CAPACITY OF $220 MILLION. AND THE CAP WAS REALLY IMPLEMENTED BECAUSE WE DIDN'T HAVE A TRACK RECORD AND THERE WAS SOME RISK AS FAR AS WHETHER WE WOULD BE ABLE TO PERFORM. BUT TO DATE, I BELIEVE THAT WE'VE, YOU KNOW, PROVEN THAT WE'VE BEEN ABLE TO BUILD AN EXCELLENT COMMUNITY AND ESTABLISH GREAT PROJECT WITH EXCELLENT HOME VALUES. WE ACTUALLY ARE LOOKING AT WHEN WE ANNEX IN THE ADDITIONAL LAND, AND PROBABLY ADDING ABOUT $25 MILLION OF ADDITIONAL INFRASTRUCTURE COSTS, AND THEN WHICH ALSO INCLUDES THE CEDAR PARK PROPERTY. SO SO IN TOTAL, WE'RE IF YOU TAKE INFLATION INTO CONSIDERATION, WE'VE INFLATION SINCE THE INCEPTION OF PROJECT HAS PROBABLY RUN ABOUT 40%. SO WE'RE REALLY ASKING THAT THE COUNCIL WOULD CONSIDER REMOVING THE CAP ALTOGETHER IF THE ASSESSED VALUES OF THE PROPERTIES WILL SUPPORT ADDITIONAL BOND SALES, SO THAT WE'RE ABLE TO RECOUP SOME OF SOME OF THE ADDITIONAL COSTS THAT WE'VE SEEN FROM INFLATION AND THE COST OF ADDING IN THESE ADDITIONAL PROPERTIES. I THINK THE IMPORTANT THING HERE IS THAT AS AN CITY MUD, THE DEVELOPER IS BUILDING PUBLIC INFRASTRUCTURE AND THEN GIVING THAT TO THE CITY OF LEANDER, WATER, SEWER, DRAINAGE, STREETS AND ALL OF THE UTILITIES ARE OPERATED BY YOU. THE CUSTOMERS ARE ARE YOUR CUSTOMERS BILLED BY YOU? THEY ARE MEMBERS, CITIZENS OF LEANDER. IN ALL REGARDS, THE MUD IS JUST A FINANCING TOOL TO REIMBURSE THE DEVELOPER THE ACTUAL COST OF THE INFRASTRUCTURE, AS APPROVED BY THE STATE OF TEXAS AND AS APPROVED AS APPLICATIONS ARE MADE TO THE T-C-E-Q. IT'S A VERY. I WORK WITH MUDS IN CITIES OUTSIDE OF CITIES, FAR AWAY FROM CITIES. IT'S A VERY EFFICIENT PROCESS BECAUSE IN THIS CONTEXT, BECAUSE THE MUD DOESN'T HAVE TO HAVE MUCH OVERHEAD AT ALL, IT IS JUST ISSUING THE BONDS TO REIMBURSE THE DEVELOPER. WE THINK ABOUT IT AND DESCRIBE IT AS A GROWTH PAYS FOR ITSELF MODEL. THE RESIDENTS OF TREVISO WHO ARE MOVING THERE, INSTEAD OF PAYING FOR THE INFRASTRUCTURE IN THE COST TO PURCHASE THEIR HOUSE, THEY'RE PAYING IT OVER TIME THROUGH THE MUD TAX RATE, AND THEY'RE DOING THAT WITHOUT BURDEN TO THE REST OF OF THE CITY AND THAT THE CITY RESIDENTS AND OTHER PARTS OF THE CITY DON'T HAVE TO PAY FOR THEIR GROWTH. THAT COMMUNITY PAYS FOR ITS GROWTH. WHAT MARK IS POINTING OUT IS BETWEEN INFLATION AND ADDING ACREAGE TO THE PROJECT, THE RESTRICTION ON THE AMOUNT OF BONDS THAT CAN BE SOLD MEANS THAT THE DEVELOPER CANNOT RECOUP THE ACTUAL COST OF THE INFRASTRUCTURE FOR THE HOME, SO THE HOMEOWNERS ACTUALLY NOT PAYING ALL OF THE COST OF THEIR INFRASTRUCTURE, AS WAS CONTEMPLATED AT THE BEGINNING OF THE PROJECT. AND THAT'S MARK ESSENTIALLY ESSENTIALLY REQUESTING HELP ME BE MADE WHOLE FOR MY INVESTMENT IN THE INFRASTRUCTURE THAT THE STATE WOULD OTHERWISE APPROVE AND ALLOW ME TO GET REIMBURSED FOR. WE, THE THREE DISTRICTS ENCOMPASS ABOUT 2100 ACRES, DEVELOPED LOTS TO DATE, WHERE AT ABOUT 2400 LOTS WITH COMPLETED HOMES OF A LITTLE BIT, OVER 2000 COMPLETED HOMES WITHIN THE DISTRICTS, THE PROJECTED LOTS AND HOMES FOR FULL BUILD OUT IS, AS MARK STATED, JUST UNDER 3000 HOMES. SO 2956. THE NEXT INFORMATION DOWN THE TAXABLE VALUE. WE DID RECEIVE THE CERTIFIED VALUES FOR THE THREE DISTRICTS OVER 19, 20 AND 21. MUDS WERE AT ABOUT 1.77 BILLION. AND AS AS MARK DISCUSSED, THAT'S APPROXIMATELY ABOUT 10% OF OF THE CITY'S TOTAL VALUE, WHICH IS IMPRESSIVE FOR THESE THREE THREE DISTRICTS. POTENTIAL FULL BUILD OUT. AFTER WE PROJECT OUT FOR THE FULL 3000 HOMES, WE'RE LOOKING AT ABOUT 2.4 BILLION IN VALUE. SO STILL QUITE A BIT MORE VALUE TO COME FROM THESE THREE DISTRICTS. CAN WE FLIP TO THE NEXT PAGE? THIS PAGE IS JUST DESCRIBING THE MAKEUP OF THE DEBT THAT WE HAVE CURRENTLY ISSUED, AND THE DEBT THAT WE [00:10:04] ARE HOPING TO ISSUE ALONG WITH. JUST TO GIVE YOU GUYS A LITTLE BIT MORE BACKGROUND, THERE'S AN AGREEMENT BETWEEN THE DISTRICTS AND THE CITY THAT A PORTION OF THE TAX RATE IS REBATED. PORTION OF THE CITY TAX RATE IS REBATED BACK TO THE MUDS, AND THAT THAT'S REPRESENTED BY THE GREEN LINE. SO THE DARK BLUE IS WHAT THE DISTRICT ON THE, ON THE TOP SCHEDULES, WHAT THE DISTRICT HAS ALREADY ISSUED. THAT'S THE EXISTING DEBT TO BE PAID OFF. IT LOOKS LIKE IN PROBABLY ABOUT 2050, THE LIGHT BLUE IS THE ADDITIONAL DEBT THAT WE ARE ALLOCATED OR ABLE TO ISSUE IF AND WHEN VALUE DOES SHOW UP FOR THE DISTRICTS, AND WE'RE ABLE TO ISSUE THOSE BONDS. SO YOU CAN SEE HOW THAT'S GOING TO LAYER IN. AND THEN THE GREEN LINE IS THE REBATE THAT IS COMING FROM THE CITY BACK TO THE MUDS. AND YOU CAN SEE HOW THAT'S GOING TO START DECREASING ONCE THE OVERALL DEBT SERVICE OF THE MUDS BONDS START TO DECREASE. THE BOTTOM CHART IS THE SAME INDICATION WITH THE WHAT'S OUTSTANDING AND WHAT THE LIGHT BLUE. WHAT WE PROPOSE TO TO FINISH ISSUING FOR THE 219 MILLION STILL LEAVES THE REBATE DECREASING, JUST LIKE THE FIRST CHART. BUT THEN WE'RE ASKING OR TRYING TO REPRESENT WHAT IT'S GOING TO LOOK LIKE ONCE IF THE BOARD OR SORRY, IF THE COUNCIL ALLOWS US TO REMOVE THAT CAP AND WE'LL LAYER IN THE NEW BONDS ON TOP OF THAT. AGAIN, NO IMPACT WITH THE REBATE. WE'RE NOT ASKING FOR ANY EXTENSIONS OF THE REBATE OR ANYTHING LIKE THAT, BUT JUST GIVING YOU A PICTURE OF WHAT THAT OUTSTANDING DEBT WOULD LOOK LIKE OVER TIME. AND THEN MY LAST PAGE. IS THE VALUE FOR THE TREVISO DISTRICTS AND THE POTENTIAL CITY TAX REVENUE. SOME THINGS THAT I HAD TO MAKE ASSUMPTIONS ON ARE THE CITY LEAVING ITS TAX RATE FLAT, CONSISTENT FOR THE LIFE OF THIS PROJECT? I DON'T KNOW WHERE THE CITY IS GOING TO GO NEXT YEAR, FIVE YEARS FROM NOW, TEN YEARS FROM NOW. SO MY ASSUMPTION WAS JUST LEAVING THE TAX RATE FLAT FOR THE CITY. THE THE LINES INDICATE THE POTENTIAL VALUE FOR THE MUDS. AN AGGREGATE OF ALL THREE OF THEM. AND THEN THE THE DARK BLUE IS THE POTENTIAL REVENUE BACK TO THE CITY FROM TAX REVENUE FROM FROM THE REDUCTION OF THE REBATE OVER TIME AND THE ADDITIONAL VALUE OF THE OF THE THREE MUDS. SO JUST GIVES YOU A SNAPSHOT, A PICTURE OF, OF THE POTENTIAL GOING FORWARD, ALREADY GENERATING QUITE A BIT OF REVENUE FOR THE CITY TO DATE, AND THEN JUST LONG TERM PLAN OF POTENTIAL FOR TAX REVENUE COMING BACK FOR THE CITY. WE NEED TO ISSUE X AMOUNT OF BONDS BECAUSE WE CAN FOLLOW THE RULES AND GET ISSUE X AMOUNT OF BONDS. BUT WE'RE WE'VE EXCEEDED OUR CAP AND NOW WE'RE STUCK. AND WE CAN'T ISSUE THOSE BONDS. WE WE DO THE MUDS DO COME BACK TO YOU EVERY TIME WE ISSUE BONDS. SO THERE'S A MECHANISM IN THE CURRENT AGREEMENTS FOR US TO PROVIDE INFORMATION TO, TO YOUR STAFF. A LOT OF FINANCIAL INFORMATION FOR REVIEW, BUT EVERYTHING IN THE MUD IS REIMBURSEMENT. AND SO THE DEVELOPER PAYS FOR EVERYTHING UPFRONT AND THEN GETS REIMBURSED OVER TIME. THE DEVELOPER NEEDS THE SURETY THAT IF WE ARE ABLE TO SELL THOSE BONDS, AND WHEN WE'RE ABLE TO SELL BONDS, THAT THAT REIMBURSEMENT IS, IS LEGALLY POSSIBLE, THAT THAT THEY CAN EARN THAT REIMBURSEMENT. I GUESS MY FOLLOW UP QUESTION IS LIKE, SO YOU GUYS ARE GREAT, WE TRUST YOU, YOU'RE DOING A GREAT [00:15:03] JOB AND ALL THAT. BUT HOW DO WE HOW DOES THIS WORK? WHEN YOU GET OUT OF WHACK AND YOU'VE ISSUED MORE AND AND KIND OF IT DOESN'T QUITE WORK PERFECTLY. YOU KNOW WHAT I MEAN? LIKE IT HAS BEEN. THOSE RULES WERE PUT IN IN THE 1980S AFTER THE REAL ESTATE BOOM AND AND BUST, AND THERE WERE ISSUES WITH DEFAULTS ON BONDS, POTENTIAL DEFAULTS ON BONDS. AND THE STATE CAME IN AND SAID, WE NEED TO RESCUE THIS TOOL BY PUTTING LIMITS ON IT. AND SINCE THAT POINT IN TIME, THERE HAVEN'T BEEN ANY OF THOSE DEFAULTS OR OR BANKRUPTCIES OR THINGS THAT YOU WOULD SEE IF PEOPLE GOT AHEAD OF THEMSELVES ISSUING DEBT. SURE. SO ONE OF THE THINGS THAT I HAVE TO OR MANY OF THE THINGS THAT I HAVE TO PUT TOGETHER WHENEVER WE'RE SEEKING A BOND ISSUE, IS A BOND APPLICATION THAT GOES TO THE T-C-E-Q. AND WITHIN THAT BOND APPLICATION, THERE ARE SCHEDULES THAT I HAVE TO PUT TOGETHER THAT SHOWS THAT BASED OFF THE CURRENT VALUES WITHIN THE DISTRICT AND OUR CURRENT TAX RATES, THAT WE CAN AFFORD A NEW SERIES OF BONDS. SO THE STATE HAS GUARDRAILS IN PLACE THAT DON'T ALLOW US, AS MUDS TO ISSUE OVER ISSUE BONDS AND BASICALLY GET OUT OF WHACK. THERE'S THERE'S ENOUGH SAFEGUARDS IN THERE THAT PREVENT THAT FROM HAPPENING. THANK YOU. ANYTHING ELSE COUNCIL SO FAR. GOOD. SO WHAT IS THE RISK TO YOUR PROJECT IF THE CAP IS NOT REMOVED. AND SO THEY THEY'D BE IMPOSSIBLE AND WE JUST WOULDN'T PROCEED. SO I MEAN, THE RISK FROM OUR END IS, IS THAT WE STOP DEVELOPMENT WHEN WE RUN OUT OF REIMBURSEMENTS. I THINK THAT, YOU KNOW, WHEN WE WHEN WE ACQUIRED THE PROPERTY AND STARTED DEVELOPMENT, OUR, OUR EXPECTATION WAS THAT WE WOULD BE MADE WHOLE FOR ALL THE SAND AND ROAD IMPROVEMENTS THAT WE PUT INTO THE PROJECT. AND IF WE DIDN'T GET REIMBURSED, THEN WE'D HAVE TO LOOK AT WHERE WHERE DOES IT REALLY END? AND IT REALLY KIND OF PROBABLY ENDS WHEN WE RUN OUT OF OUT OF THE REIMBURSEMENTS JUST BECAUSE. AND IT'S MAINLY THAT, THAT FACTOR OF INFLATION. IF YOU LOOK AT THE INFLATION FACTOR AT 40% FROM 2012 THROUGH 2025, IT JUST IT TAKES THE $220 MILLION CAPACITY THAT WE ORIGINALLY HAD IS NOW AT, YOU KNOW, $308 MILLION. THE CURRENT TAX RATE FOR FISCAL YEAR 2025 IS 41 7282. THIS BUDGET THAT WE HAVE PROPOSED FOR COUNCIL TONIGHT IS BUILT OFF OF A TAX RATE OF 41.7282. THAT'S A 0% INCREASE IN THE TAX RATE. OKAY, EARLIER THIS WEEK, WE ISSUED A PROCLAMATION FOR WORLD HUNGER MONTH. 1 IN 5 CHILDREN DON'T HAVE ENOUGH FOOD TO GROW UP STRONG, AND OVER 50 MILLION PEOPLE HAVE TURNED TO FOOD BANKS FOR HELP. THE CENTRAL TEXAS FOOD BANK IS ALWAYS IN NEED OF DONATIONS, BUT THANKS TO SOME GENEROUS DONORS GIVING MATCHING CONTRIBUTIONS ALL DONATIONS THROUGH TOMORROW, FRIDAY, SEPTEMBER 19TH WILL BE MATCHED SO THAT EVERY $1 WILL PROVIDE NINE MEALS. IT'S A GREAT WAY TO MAKE AN IMPACT RIGHT HERE IN OUR OWN COMMUNITY. TONIGHT WE PICKED UP DINNER FROM SMOKEY MOE'S. WE ALWAYS MAKE A COMMITMENT TO SHOP LOCAL BECAUSE WHEN YOU SHOP LOCAL, YOU KEEP PEOPLE EMPLOYED HERE, YOU KEEP BUSINESSES HERE, AND YOU KEEP YOUR TAX DOLLARS HERE TO PAY FOR ALL OF THE THINGS THAT WE ENJOY TALKING ABOUT EVERY OTHER WEEK. I DO NEED TO MAKE AN ANNOUNCEMENT TONIGHT. SOMETIMES WE MAKE A LOT OF PLANS IN OUR LIVES AND GOD AND LIFE INTERVENE AND THINGS TAKE YOU IN A DIFFERENT DIRECTION. AND I'M SURE WE'VE ALL BEEN THERE. IT'S BEEN A LOT OF DISCUSSION IN MY HOUSEHOLD AND A LOT OF LIFE HAS HAPPENED AND EVERYTHING'S OKAY, BUT WE HAVE MADE THE DIFFICULT DECISION TO RELOCATE. I'M SAD TO NOT SEE A LOT OF OUR PROJECTS THROUGH TO FRUITION, BUT IT IS 100% THE RIGHT CHOICE. I'VE BEEN REFLECTING A LOT ON WHY WHY I'VE BEEN UP HERE, WHAT I WAS ELECTED TO DO. AT FIRST I VOWED TO BRING MORE COMMERCIAL TO THE CITY, AND THEN I WANTED TO BRING SOME MORE FUNCTION AND AND JUST GET THINGS KIND OF STRAIGHTENED OUT. AND THEN WE WERE HIRING A NEW CITY MANAGER [02:40:02] AND REALLY NEEDED TO KEEP THINGS SMOOTH AND STEADY AND GET HIM ONBOARDED. MY CAMPAIGN PROMISES WERE CONSISTENT THAT I WANTED TO DO THESE THINGS. OUR STAFF HAS GROWN, OUR CITY MANAGER ISN'T NEW ANYMORE. KEY POSITIONS THAT DIDN'T EXIST FIVE YEARS AGO NOW EXIST. CHANGES IN STAFF HAVE MADE THIS THE STRONGEST TEAM THAT I'VE EVER WORKED WITH. WE'VE ADOPTED AND MODERNIZED TO CHANGE FROM THE SMALL TOWN WE WERE TO NOW ONE OF THE LARGEST IN BOTH WILLIAMSON AND TRAVIS COUNTIES. WE'VE BECOME A POWERHOUSE LOOKING AT OUR BUDGETS. IN 2018, WHEN I GOT HERE, WE WERE BRINGING IN $5.16 MILLION IN SALES TAX. THIS YEAR, IT'S ESTIMATED WE'RE GOING TO BE JUST UNDER 12 MILLION. OUR TOTAL TAXABLE VALUE OF THE CITY IN 2018 WAS 3.7 BILLION. AND ACCORDING TO THIS BUDGET, IT'S 17 BILLION. WE'VE STARTED GIRLS SOFTBALL, OPENED A REC CENTER, AND WE'RE ABOUT TO OPEN A SENIOR CENTER. WE'VE INVESTED HEAVILY IN OUR WATER SYSTEM, HIRED A CONSERVATION SPECIALIST, ADDING ADDITIONAL CAPACITY NEXT MONTH AND ARMY NEXT YEAR. WHEN I LOOK AT ALL THE PROMISES THAT I MADE TO OUR RESIDENTS, I'VE DONE THEM OVER THESE YEARS. I'VE SERVED WITH FIVE CITY MANAGERS, TWO PLACE SIXES, THREE PLACE FIVES, ONE PLACE FOR BECAUSE I WAS PLACE FOR. SO I'M NOT COUNTING ME TWO PLACE THREES, FOUR PLACE TWOS, THREE PLACE ONES AND TWO DIFFERENT MAYORS BEFORE MYSELF. I'M GOING TO BE OUT NEXT WEEK DEALING WITH A MEDICAL SITUATION.
