TO ORDER. LET THE RECORD SHOW ALL COMMISSIONERS ARE PRESENT AND ACCOUNTED FOR. DIRECTOR'S REPORT. GOOD EVENING. I'M REPORTING ON ACTION TAKEN BY THE CITY COUNCIL. THAT WAS FORWARDED TO THEM BY THE PLANNING AND ZONING COMMISSION. THEY REVIEWED THE THE SPECIAL USE PERMIT AND RECOMMENDED DENIAL. AND THEN KEDYS APPEALED THEIR DECISION. SO IT CAME BACK TO THE COUNCIL FOR A SECOND TIME. AND THEN THEY RECOMMENDED DENIAL AGAIN. SO THAT ONE, THEY CAN'T COME BACK FOR ANOTHER SIX MONTHS UNLESS THEY HAVE A DIFFERENT TYPE OF REQUEST. WE ALSO DID THE PUBLIC HEARING FOR THE PEAK PERFORMANCE PARK ZONING CASE, AND THE COUNCIL RECOMMENDED TO APPROVE THE CASE, AND THAT'LL BE ON FOR SECOND READING NEXT WEEK. AND THAT'S

Conduct a Public Hearing and consider action regarding Zoning Case Z-25-0192 to amend the Journey Bible Church Planned Unit Development (PUD) with base zoning of LO-2-A (Local Office) to include a base zoning district of LC-2-A (Local Commercial) on two (2) parcels of land approximately 3.0 acres ± in size, more particularly described by Williamson Central Appraisal District Parcels R668974 and R668975; and generally located approximately 300 feet east of the intersection of Bull Nettle Drive and Journey Parkway, Leander, Williamson County, Texas.

DASH 0192 TO AMEND THE JOURNEY BIBLE CHURCH PLANNED UNIT DEVELOPMENT WITH BASE ZONING OF LOW TWO A TO INCLUDE A BASE ZONING DISTRICT OF LC TWO A ON TWO PARCELS OF LAND APPROXIMATELY THREE ACRES IN SIZE, MORE PARTICULARLY DESCRIBED BY WILLIAMSON COUNTY CENTRAL APPRAISAL DISTRICT.

PARCELS R6 68974 AND R6 68975, AND GENERALLY LOCATED APPROXIMATELY 300FT EAST OF THE INTERSECTION OF BULL NETTLE DRIVE AND JOURNEY PARKWAY. LEANDER, WILLIAMSON COUNTY, TEXAS. THANK YOU. GOOD EVENING, MAYOR CASTILLO WITH THE PLANNING DEPARTMENT. THIS REQUEST IS THE FIRST STEP IN THE ZONING PROCESS. THE APPLICANT IS SEEKING TO REZONE THE PORTION OF THE PROPERTY. SO IT'S THE OUTER LOT, THE ONE WITH THE DARKER DOTS SO THAT THEY CAN ALLOW FOR THE DEVELOPMENT OF THE SWIM SCHOOL. THIS USE IS NOT LISTED ON OUR ZONING ORDINANCE, BUT WE MADE THE DETERMINATION IT WOULD BE COMPATIBLE IN THE LOCAL USE USE LOCAL COMMERCIAL USE COMPONENT AND IT IS COMPATIBLE WITH THE COMPREHENSIVE PLAN AND APPROPRIATE WITH THE SURROUNDING LAND USES. IT IS IMPORTANT TO NOTE THAT THE PROPOSAL DOES EXPAND THE USES THAT WOULD BE ALLOWED OTHER THAN THE SWIM SCHOOL, SO IT WOULD BE ANYTHING WITHIN LOCAL COMMERCIAL. IN ADDITION TO THAT, SWIM SCHOOL AND SURROUNDING THE PROPERTY IS THE JOURNEY BIBLE CHURCH IN THAT LOT WITH THE LIGHTER CIRCLES, SO THAT ONE'S ALREADY DEVELOPED AND THEY'RE CURRENTLY DOING AN ADDITION TO THAT. THE INITIAL ZONING CASE THAT ADOPTED THE PUD WAS IN 2017, AND THEN IN 2021, THEY HAD AN AMENDMENT THAT ALLOWED FOR OTHER USES ASIDE FROM JUST THE CHURCH. AS PART OF THIS ITEM, THE THE COMMISSION CAN EITHER APPROVE THE PROPOSAL, THE AMENDMENT NUMBER TWO, OR DENY IT, OR THE THIRD OPTION IS TO APPROVE AN ALTERNATE REQUEST THAT MAY INCLUDE MODIFICATIONS TO THE AMENDMENT, SUCH AS ADDING PROHIBITED USES. STAFF RECOMMENDS OPTION NUMBER ONE, WHICH IS TO APPROVE AS IS. WE MADE THE RECOMMENDATION BASED ON THE PROPOSED USE BEING COMPATIBLE WITH THE SURROUNDING LAND USES AND THE FUTURE LAND USE DESIGNATION. WE HAD BEEN HERE RIGHT AT THE END OF JULY TO PRESENT TO YOU ALL PREVIOUSLY A LIST OF PROJECTS FOR THE CAPITAL IMPROVEMENTS, IF NEED BE. I DON'T REALLY HAVE A PRESENTATION, BUT I CAN DO A RECAP IF YOU WOULD LIKE. IF NOT, I'D JUST LIKE TO COME BACK TO YOU AND SAY WE WERE WAITING FOR YOUR GUIDANCE AND YOUR INPUT ON THE PREVIOUS PRESENTATION. SOUNDS GOOD WITH THE COMMISSION. SO THE CAPITAL IMPROVEMENTS OF COURSE WE HANDLE AND MAINTAIN AND MANAGE THE LARGE NUMBER OF IMPROVEMENTS THAT ARE REQUIRED BY THE CITY THAT ARE NEEDED BY THE CITY. MOST ARE USUALLY INFRASTRUCTURE, WATER, WASTEWATER, ROAD SYSTEMS. SOMETIMES THEY ARE FACILITIES AND MANAGEMENT. SOMETIMES THEY'RE PARKS AND TRAILS. WE DO THIS EVERY YEAR. WE GO BACK THROUGH AND WE REVIEW WHAT'S NEEDED, AND WE LOOK AT THE BROAD SPECTRUM OF FUNDINGS THAT ARE AVAILABLE AND HOW ARE WE GOING TO FUND THESE. PER THE ORIGINAL CITY CHARTER, WE ARE TO COME TO PLANNING AND ZONING AND SAY, OKAY, PLEASE DO REVIEW THE PROJECTS IN THE PLAN. AND IF YOU COULD LOOK AT THEM OVER AND GIVE US YOUR INPUT. THE LAST SEVERAL YEARS, OF COURSE, WE HAVE NOT DONE THAT, BUT WE DO WANT TO BE MORE, MORE DILIGENT IN DOING SO. SO FOR THOSE OF YOU WHO DON'T KNOW WHAT A CAPITAL IMPROVEMENT IS, BASICALLY PER THE CITY CHARTER, IT DOES COME IN AND IT DOES CONFIRM THAT, YOU KNOW, WE ARE REQUIRED TO PRESENT A LIST OF THESE PROJECTS WHICH COULD BE AMENDED UP TO TWO YEARS EVERY TWO YEARS. BUT WE DO LIKE TO LOOK AT THEM EVERY YEAR BECAUSE GOALS AND PRIORITIES CHANGE. AND WE WANT TO MAKE SURE THAT WE'RE WE'RE KEEPING TABS WITH THAT. BUT WHEN WE LOOK AT A CIP, IT'S A MULTI YEAR PLAN AND WE LOOK AT THE GOALS AND OBJECTIVES AND IT PROVIDES US FOR WITH REGARDS TO SAY, DEVELOPMENT, MODERNIZATION, REPLACEMENT OF PHYSICAL INFRASTRUCTURE AND FACILITIES AND PARKS AND TRAILS, THE CRITERIA IS THAT IT MUST BE MINIMUM OF 200,000 IN ESTIMATED COSTS, MUST BE NON-RECURRING, MUST HAVE PROVIDED A MINIMUM BENEFIT OF FIVE YEARS. THAT MEANS IT'S USUALLY CONSIDERED PERMANENT AND BEING IN ADDITION TO THE CITY'S CAPITAL ASSETS. AND ONCE AGAIN, IT CAN BE LIMITED TO ROADS, UTILITIES, TECHNOLOGY, MUNICIPAL FACILITIES INCLUDING PARKS AND TRAILS. OUR GOAL IS TO HAVE A MINIMUM PLANNING HORIZON OF ABOUT FIVE YEARS. WE'RE ACTUALLY LOOKING TEN YEARS. BUT IN ALL FAIRNESS, WHEN YOU LOOK AT THE KIND OF MONEY WE'RE GOING THROUGH, IT'S FIVE YEARS FIRST AND THEN WE START PROJECTING LONG DISTANCE 5 TO 10 YEARS. SO WE WE IDENTIFY, WE EVALUATE, WE SCHEDULE FUND THE INFRASTRUCTURE IMPROVEMENT NEEDS COMMUNITY. WHAT WE DO IS WE'LL SET UP A A PROJECT NEED. AND WITH THESE PROJECT NEEDS WE'LL DEVELOP PROJECT WORKSHEETS. AND ON THESE WORKSHEETS WE'LL DEVELOP A SUMMARY OF ALL THESE THAT DETERMINES WHAT WHAT THAT IS AND EXPLAINS. IT DEVELOPS OR PROVIDES AN ESTIMATED COST, SHOWS A DURATION OF AN ESTIMATED SCHEDULE. USUALLY LIKE DO WE THINK IT'S GOING TO BE 12 MONTHS, 18 MONTHS, WHATEVER THAT'S GOING TO BE SOURCES OF FUNDING. WE HAVE A WIDE RANGE OF SOURCES OF FUNDING. WE LIKE TO LOOK AT THOSE AND WE LOOK AT THOSE EXPENSES FOR THAT. WE TRY TO GO THROUGH AND WE PRIORITIZE THESE NEEDS AND THESE PROJECTS, AND WE START WITH EACH OF THE DEPARTMENTS. WELL MY APOLOGIES.

STEP BACK. WE ACTUALLY START WITH ASSESSMENTS, PROJECT MASTER PLANNING AND ANY KIND OF STUDIES. AND WHEN WE LOOK AT THOSE STUDIES, THEN WE'LL TAKE THEM BACK TO EACH OF THE DEPARTMENTS AND SAY, OKAY, EACH OF THE DEPARTMENTS NEED TO LOOK AT WHAT IS IDENTIFIED IN THESE LISTS IN THESE STUDIES. AND YOU DEPARTMENTS LET US KNOW WHAT YOU DETERMINE IS GOING TO BE YOUR HIGHEST PRIORITIES. THEY DEVELOP A LIST AND THEY GIVE THAT BACK TO US. THEN WE GO THROUGH A RANKING. BASICALLY WE DO AN EVALUATION MATRIX. AND WE SHARED THAT PREVIOUSLY. THAT EVALUATION EVALUATION MATRIX. MY APOLOGIES. LOOKS AT MULTIPLE. LET'S SEE. HERE WE GO. MULTIPLE CATEGORIES. YOU KNOW OPERATIONAL CAPACITY ECONOMIC DEVELOPMENT PUBLIC SAFETY QUALITY OF LIFE BALANCED COMMUNITY ENVIRONMENTAL MANAGEMENT. AND IT GRADES IT UPON THOSE. ONCE WE HAVE THOSE ALL SCORED, IT CREATES A LIST ON THOSE SCORINGS NOW THAT'LL COME BACK TO US AND WE REASSESS BASED UPON HOW DO THOSE ACTUALLY WORK WITH ANOTHER SET OF CRITERIA

AND WE'LL ACTUALLY SCORE OR WE'LL RANK THOSE. AND THEN WE GET A RANKING OF PRIORITIZATION.

AND SO WE GO THROUGH THIS MULTIPLE TIMES AND GO THROUGH A SERIES OF DIFFERENT ASPECTS.

AND IT'LL GO BACK THROUGH CAPITAL IMPROVEMENTS MIXED WITH THE THE EXECUTIVE OFFICE. AND THEN WE'LL SIT DOWN AT THE VERY END. AND OF COURSE WE'LL GO THROUGH HOPEFULLY Y'ALL'S INPUT PROVIDES US ANOTHER ROUND OF THAT. AND THEN OF COURSE WE GO THROUGH WITH FINANCE AND WE LOOK AT FINANCING OKAY. WHAT SOURCES OF FUNDS DO WE HAVE AND WHAT MONIES DO WE HAVE. AND THEN WE'LL LOOK AT THOSE AND WE CAN DETERMINE BASED UPON THE CONSIDERATION WE LOOK AT AFTER EVERYTHING'S BEEN EVALUATED, SCORED AND PRIORITIZED, THEN WE GO BACK AND WE SAY, OKAY, WE'RE LOOKING AT WHICH ONES ARE LEGACY PROJECTS. IN OTHER WORDS, WHICH PROJECTS ARE ACTUALLY IN MOTION NOW BEING DESIGNED OR IN CONSTRUCTION, WHICH ARE SPECIALLY FUNDED PROJECTS WHICH MIGHT BE CAPMETRO, COULD BE ARPA, COULD BE TEXT, IT COULD BE ANY OF THESE SPECIAL FUNDS THAT MAY HAVE REQUIREMENTS THAT WE NEED TO GO AHEAD AND GET THOSE FUNDS ENCUMBERED. WE'LL LOOK AT PROJECTS ARE BEING EXECUTED AS A PARTNERSHIP. WE DO OUR PARTNERSHIPS EVIDENTLY WITH CAPMETRO AND WITH WILCO, WILLIAMSON COUNTY AND SEVERAL OTHERS, AND WE NEED TO MAKE SURE THAT THOSE TAKE A CERTAIN LEVEL OF PRIORITY BECAUSE THEY USUALLY PROVIDE FUNDS TO US. WE LOOK AT THE TIMELINE CONSIDERATIONS FOR DURATIONS OF DESIGN, RIGHT OF WAY OR EASEMENT, PROCUREMENT AND COORDINATION OF CONSTRUCTION WITH OTHER PROJECTS. AND HERE'S WHERE IT GETS A LITTLE TRICKY, BECAUSE WE MIGHT HAVE MULTIPLE PROJECTS THAT ARE FAIRLY RANKED HIGH ON THIS PRIORITIZATION, BUT I'M GOING TO USE SAN GABRIEL AS AN EXAMPLE. I'VE GOT RIGHT NOW EIGHT PROJECTS ACROSS SAN GABRIEL FROM BAGHDAD ALL THE WAY OVER TO RONALD REAGAN.

I CANNOT IN GOOD CONSCIENCE DO TWO PROJECTS CONSTRUCTION, THAT ARE WORKING ON TOP OF EACH OTHER BECAUSE I GUARANTEE YOU THE GENERAL PUBLIC WILL HANG US UP. SO WE HAVE TO KIND OF WORK STRATEGICALLY. HOW DO THESE ALL WORK AND HOW WE CAN GET THESE PROJECTS GOING, BUT IN SUCH A WAY THAT WE DO NOT OVERBURDEN THE GENERAL PUBLIC AND MAKE THEIR LIVES MISERABLE, RIGHT? WE ALSO LOOK AT PROJECTS WHICH FULFILL CRITICAL NEEDS AND LIFE SAFETY NEEDS, WHICH MAY NOT RANK HIGHLY, BUT THEY STILL ARE A CRITICAL NEED. AND THEN WE'LL GO BACK THROUGH THAT WHOLE SYSTEM AND WE PUT ALL THESE TOGETHER. AND I THINK WE DID PRESENT YOU WITH A DRAFT BOOK ON THAT. YES. SO THAT DRAFT BOOK SHOWS THOSE PROJECTS, AND YOU CAN LOOK IN THE UPPER RIGHT CORNER. IT'LL SHOW A SCORING AND A RANKING. BUT IT ALSO, IF YOU LOOK WITHIN THOSE BOOKS, THOSE HAVE WHAT WE CALL THE PROJECT WORKSHEETS. THE PROJECT WORKSHEETS. DID I INCLUDE ANY OF THOSE? I DID, YOU CAN SEE OVER HERE ON THE FAR RIGHT THAT'S A PROJECT WORKSHEET.

WITHIN THAT PROJECT WORKSHEET, IT'LL HAVE ITS ITS SCOPE. IT'LL HAVE A GENERAL DURATION OF WHAT THOSE GENERAL MONTHS OF CONSTRUCTION AND DESIGN EVERYTHING MIGHT BE. AND THEN DOWN IN THE LOWER HALF, IT SHOWS THE DOLLARS, IT SHOWS. WHERE DO WE THINK THE MONEY IS GOING TO BE, HOW MUCH WE THINK WE'RE GOING TO BE SPENDING PER EACH FISCAL YEAR? AND WHERE DO THOSE FUNDS APPROXIMATELY COME FROM? SO QUESTION ON THAT FOR YOU. YES. BECAUSE WHILE YOU'RE ON THAT, SO IF I'M LOOKING AT THE FISCAL YEAR FROM 26 TO TO 30 OR 30 1 TO 35, IF THE MONEY IS BUDGETED IN THAT FISCAL YEAR, DOES THAT MEAN THAT THAT'S WHEN THE PROJECT IS GOING TO BE EXECUTED? THAT IS THE ANTICIPATION FOR IT, CORRECT. THAT IS THE ANTICIPATION. AND I AND I SAY ONCE AGAIN WITH ANTICIPATION, BECAUSE THINGS CAN HAPPEN, WE CAN GO INTO DESIGN AND WE COULD WITH LIKE AS AN EXAMPLE, CRYSTAL FALLS EXTENSION. WE'RE CROSSING A VERY LARGE FLOODPLAIN THERE. WE ARE GOING TO HAVE TO GO THROUGH A REQUIREMENT CALLED THE LAMAR PROCESS. THAT LAMAR PROCESS WITH REGARDS TO THE EPA AND THE US CORPS, CORPS OF ENGINEERS AND TC USUALLY TAKES A CERTAIN PERIOD OF TIME, BUT SOMETIMES IT CAN EXTEND LONGER THAN MIGHT ACTUALLY TAKE US A YEAR AND A HALF, WHICH IS VERY PAINFUL. BUT THAT TAKES THAT THAT DESIGN PHASE AND EXTENDS IT OUT A YEAR AND A HALF LONGER THAN WE WANT IT TO BE. GOT IT. SO THIS IS SHOWING YOU YOUR FISCAL YEAR 26, FISCAL YEAR 31 WITH THE BUDGETING I GOT IT. YES, SIR.

AND SO WHAT WE'D LIKE TO EMPHASIZE TO EVERYBODY THIS IS A A PLAN. AND SO IT IS OUR PLAN AND HOPE AND GOAL AND ANTICIPATED THAT WE MEET THIS. BUT WE KNOW AND UNDERSTAND THAT THINGS CHANGE. PRIORITIES SOMETIMES CHANGE FROM YEAR TO YEAR. AND SO THAT'S WHY WE SAY THIS IS A PLAN. AND SO WITH THAT IN MIND WE KNOW AND UNDERSTAND THAT FROM NEXT NOW TO NEXT YEAR IT MAY CHANGE. SO WE WILL MAYBE HERE AGAIN NEXT YEAR IN FRONT OF YOU SAYING HERE'S THE NEW SET. BUT YES SIR, THAT IS CORRECT. GREAT. OKAY. WELL THANK YOU FOR THAT. OH YES SIR, OF COURSE.
