I'M REPORTING ON ACTION TAKEN BY THE CITY COUNCIL ON CASES THAT WERE FORWARDED TO THEM BY THE PLANNING AND ZONING COMMISSION. APRIL 16TH. WE HAD A COUPLE OF FINAL READINGS FOR CASES. THE FIRST ONE WAS THE WILEY SPECIAL USE PERMIT. THIS IS A SPECIAL USE PERMIT THAT ALLOWS FOR USED AUTOMOTIVE SALES ON THE PROPERTY OFF OF 183. THE NEXT CASE WAS THE KAUFMAN LOOP PLANNED UNIT DEVELOPMENT. THIS WAS THE CASE WHERE THEY WERE ADDING THE AUTOMOTIVE REPAIR AND CAR WASH, AND THESE WERE APPROVED. AND THEN DURING THAT SAME MEETING, WE ALSO HAD A WORKSHOP WITH THE COUNCIL WHERE WE TALKED ABOUT UPDATES TO THE ORDINANCE WITH REGARDS TO DAYCARES. SO STAFF'S WORKING ON ORDINANCE IN RESPONSE TO THEIR INPUT. SO I WANTED TO GIVE YOU ALL A BRIEF SUMMARY SUMMARY BECAUSE WE DO HAVE A CASE ON TODAY THAT KIND OF RELATES TO THEIR CHANGES. SO RIGHT NOW OUR ORDINANCE LIMITS DAYCARE USES TO FIVE OR FEWER CHILDREN. AND IN-HOME DAYCARES ARE ALLOWED ON ALL PROPERTIES THAT ARE ZONED FOR RESIDENTIAL USE. AND WE PRESENTED THE COUNCIL WITH FOUR OPTIONS TO, TO CONSIDER DURING THE DISCUSSION. OPTIONS ARE UP ON THE SCREEN. SO WE TALKED ABOUT LEAVING IT THE WAY IT IS, UPPING IT TO SIX BY RIGHT OR SIX BY RIGHT, PLUS SIX FOR AFTER SCHOOL CARE OR 12. WE DID SOME RESEARCH ON SURROUNDING COMMUNITIES AND PRESENTED THE FINDINGS TO THE CITY COUNCIL, AND THEY DECIDED ON DIRECTING STAFF TO MOVE FORWARD WITH ALLOWING SIX CHILDREN IN ALL RESIDENTIAL DISTRICTS, ADDING A DEFINITION OF IN-HOME DAYCARE, AND THEN CREATING A PROVISION THAT WOULD ALLOW FOR YOU TO HAVE UP TO 12. YOU WOULD HAVE AN ADDITIONAL SIX FOR AFTER SCHOOL CARE WHEN CERTAIN CONDITIONS ARE MET. I'VE LISTED THE CONDITIONS ON THE SCREEN, BUT IT'S BASICALLY ACCOMMODATING PARKING AND TRAFFIC CIRCULATION WHEN YOU INCREASE THE NUMBER OF CHILDREN AND THEN DEVELOPING STANDARDS THAT THAT HELP WITH GARAGE CONVERSION REQUESTS, BECAUSE WE STILL HAVE TO MAKE SURE YOU MEET PARKING FOR THE HOME AND THE NEIGHBORHOOD STILL LOOKS THE SAME. AND THEN ADDING STANDARDS FOR OUTDOOR PLAY AREAS. SO WE'RE GOING TO WORK ON AN AMENDMENT. Y'ALL WILL PROBABLY SEE IT IN THE NEXT COUPLE MONTHS TO REVIEW. THIS REQUEST IS THE FIRST STEP IN THE ZONING PROCESS TO APPROVE A SPECIAL USE PERMIT FOR THE. REFERRED TO AS A SUP, THE APPLICANT HAS SUBMITTED A REQUEST FOR AN SEP IN ORDER TO ALLOW FOR AN IN-HOME DAYCARE FOR UP TO 12 CHILDREN, AS WELL AS THE GARAGE CONVERSION. THEY GRANT LICENSES FOR DAYCARES, CHILD CARE HOMES WITH UP TO 12 CHILDREN. SO THE APPLICANT HAS BEEN OPERATING UNDER DEWDROPS MONTESSORI PRESCHOOL WITH UP TO 12 CHILDREN AT THE SITE WITH THEIR STATE LICENSE. WE ALREADY TALKED ABOUT THE COUNCIL UPDATES. I'M GOING TO GO AHEAD AND SKIP PAST THAT, BUT THERE WAS ALSO A CODE ENFORCEMENT CASE ON THIS PROPERTY THAT WAS OPEN DUE TO HAVING MORE THAN FIVE CHILDREN, STARTED IN AUGUST OF 2025. WE MET WITH THE APPLICANT IN A PRE DEVELOPMENT MEETING IN OCTOBER TO GO OVER THE NEXT STEPS, AND THEN WE CONDUCTED A FEW VISITS. SO WE DID A COURTESY VISIT TO VISIT TO VERIFY THE ITEMS THAT WERE NEEDING TO BE ADDRESSED REGARDING THE THE GARAGE CONVERSION. AND THEN IN JANUARY, WE MET WITH THEM AGAIN TO HELP THEM SUBMIT THEIR SEP DURING THE REVIEW, WE NOTED THAT THE PERMITS, THOUGH HADN'T BEEN RECEIVED FOR THE GARAGE CONVERSION. SO WE VISITED AGAIN JUST TO MAKE SURE THAT WE GOT THE PROPER PERMITS. AND WE'VE BEEN WORKING WITH STAFF, WITH STAFF, HAS BEEN WORKING WITH THE APPLICANT TO GET THOSE PERMITS ISSUED. AND CURRENTLY THE ZONING LET ME GO THROUGH.THE CURRENT ZONING IS SFU2B, SO IT'S SINGLE FAMILY, URBAN, AND IT'S SURROUNDED BY THE SAME ZONING DISTRICT. IT'S LOCATED AT 1202 DRAKE CODE. THERE'S A TYPO IN THERE AND IT'S APPROXIMATELY 0.2 ACRES. IT IS WITHIN THE WOODS AT MASON CREEK SUBDIVISION. AND THERE HAVE BEEN NO OTHER ZONING CASES SUBMITTED FOR THIS PREVIOUSLY. IN ADDITION TO THE NOTIFICATION THAT WE SENT TO EVERYBODY WITHIN 200FT, THEY HAVE TO ALSO REACH OUT TO EVERYBODY THAT IS A RESIDENT WITHIN 500FT. THEY DID DO OUTREACH BY HAND, DELIVERING LETTERS. JANUARY OF THIS YEAR, WHOEVER DID NOT, WHOEVER WAS NOT AVAILABLE AT THAT TIME WAS MAILED THE LETTER LATER ON. AND THEY ALSO NOTIFIED THE MAGNOLIA HOA. THERE WAS NO CONCERNS OR COMMENTS THAT WERE ISSUED AT THAT TIME. AS PART OF THE EVALUATION OF THIS REQUEST, THE COMMISSION HAS THE FOLLOWING OPTIONS SO THEY CAN APPROVE THE PROPOSED SUP. WITH THE SIX MONTH TIME LIMIT, YOU CAN DENY THE SUP OR APPROVE AN ALTERNATE. THAT WOULD INCLUDE MODIFYING THE PARKING REQUIREMENTS OR THE TIME LIMIT. WE ARE RECOMMENDING OPTION NUMBER TWO TO DENY THE SUP STAFF MADE THE RECOMMENDATION BASED ON THE LACK OF PARKING AVAILABLE FOR BOTH THE RESIDENTIAL HOME AND THE DAYCARE USE. I PURCHASED ONE OF THE PREMIUM LOTS AT THE END OF THE CUL DE SAC, WITH THE EXPECTATION OF A SAFE, LOW TRAFFIC, SINGLE FAMILY RESIDENTIAL ENVIRONMENT FOR MY RETIREMENT. I'M CURRENTLY HERE TODAY IN OPPOSITION TO THE PROPOSED REZONING OF A NEIGHBORING PROPERTY, CURRENTLY OPERATING AS A DAYCARE AND ADVERTISED AS A PRESCHOOL. THIS BUSINESS HAS BEEN OPERATING WITHIN A SINGLE FAMILY HOME IN DIRECT CONFLICT WITH OUR NEIGHBORHOODS. DEED'S RESTRICTIONS AND COVENANTS, THE IMPACT ON MY PROPERTY AND QUALITY OF LIFE HAS BEEN SIGNIFICANT. DAILY. THERE ARE MORE THAN 50 ADDITIONAL VEHICLE TRIPS, DROP OFFS, AND PICKUPS. THIS RESULTS IN CONGESTION, BLOCKED DRIVEWAYS, INCREASED NOISE, EXCESSIVE TRAFFIC, AND ONGOING SAFETY CONCERNS, AND WHAT WAS DESIGNED TO BE A QUIET CUL DE SAC. THERE HAVE ALSO BEEN REPEATED INSTANCES WHERE DRIVERS APPROACH OR RING MY DOORBELL, MISTAKING MY HOME FOR THE DAYCARE OR PRESCHOOL.BEYOND DAILY DISRUPTIONS, THIS SITUATION RAISES SERIOUS CONCERNS ABOUT PROPERTY VALUES.
I INVESTED IN A PREMIUM LOT WITH THE UNDERSTANDING THAT THE NEIGHBORHOOD WILL REMAIN STRICTLY RESIDENTIAL. THE CONTINUED OPERATION AND POTENTIAL REZONING OF A LICENSED BUSINESS DIRECTLY NEXT DOOR UNDERMINES THAT INVESTMENT AND COULD NEGATIVELY IMPACT MY ABILITY TO SELL MY HOME IN THE FUTURE. ADDITIONALLY, ALLOWING THIS REZONING WOULD NOT WOULD SET A PRECEDENT THAT COULD FUNDAMENTALLY CHANGE THE CHARACTER OF OUR NEIGHBORHOOD.
IF ONE PROPERTY IS PERMITTED TO OPERATE A BUSINESS OF THIS NATURE, IT OPENS THE DOOR FOR OTHERS TO DO THE SAME, WHETHER THAT BE ADDITIONAL DAYCARES, SWIM SCHOOLS, DANCE CLASSES, OR OTHER TYPES OF OPERATIONS. DESPITE EXISTING DEED RESTRICTIONS DESIGNED TO PREVENT EXACTLY THIS TYPE OF ENCROACHMENT, THIS ISSUE IS ESPECIALLY IMPACTFUL GIVEN THAT ONLY FOUR PREMIUM LOTS EXIST AT THE END OF DRAKE COVE, WITH EVERY WITH VERY CLOSE PROXIMITY BETWEEN HOMES, THE BURDEN OF THIS ACTIVITY FALLS DISPROPORTIONATELY ON THOSE OF US IN IMMEDIATE ADJACENCY, RATHER THAN THE NEIGHBORHOOD AS A WHOLE. I RESPECTFULLY ASK THAT YOU CONSIDER THE LONG TERM IMPLICATIONS OF THIS DECISION, NOT JUST FOR MY PROPERTY, BUT FOR THE INTEGRITY OF THE NEIGHBORHOOD AND THE EXPECTATIONS OF HOMEOWNERS WHO INVESTED HERE UNDER THE ASSURANCE OF A SINGLE FAMILY RESIDENTIAL COMMUNITY. I DON'T THINK IT CHANGES THE CHARACTER OF THE NEIGHBORHOOD.

THE SCHOOL IS A VERY SMALL SCALE OPERATION. IT'S MAXIMUM OF 12 STUDENTS, SOMETIMES EVEN LESS, AND THERE'S STAGGERED DROP OFF AND PICKUPS. I HAVE NOT SEEN MORE THAN TWO PARENTS OR TWO PARENTS CARS AT ONCE IN THE PARKING LOT. THERE'S CLEAR EXPECTATIONS BY MR. ASHANTI THAT THESE ARE THE TIMELINES FOR DROP OFFS AND PICKUPS, AND WE FOLLOW THEM RELIGIOUSLY.
